"An act to continue the improvement of the navigation of the Hudson river, to make an appropriation therefor, and to continue in office the commissioners appointed by an act passed April 13, 1863, for the expenditure of the same."

Mr. Stanford, from the committee on commerce and navigation, to which was referred the bill entitled "An act to incorporate the Merchant's Mutual Petroleum Security Company," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Andrews, from the committee on municipal affairs, to which was referred the bill entitled "An act to amend an act entitled 'An act to incorporate the village of White Plains,' passed April 3, 1866," with power to report complete, reported the same complete, with amendments, which report was agreed to aud said bill ordered engrossed for a third reading.

The Assembly sent for concurrence the bills entitled as follows:

"An act making appropriations for the completion of the New York State Institution for the blind at Batavia," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

"An act for the relief of the Moriah Plankroad Company, and repealing chapter 776 of the Laws of 1865," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

"An act to incorporate the city of Binghamton," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

The Assembly returned the bill entitled "An act to authorize the city of Syracuse to raise money for the establishment of a high school," with a message that they had concurred in the passage of the same, with the following amendments:

Insert as section three the following: "The tax receiver of said city, or other officer or person into whose custody or under whose control the said bonds or the funds therefrom derived shall come, shall execute and deliver to the mayor of said city, bonds to be approved by said mayor, for the faithful discharge of the duties and trusts created by this act, which bonds shall be filed with the clerk of said city, before such officer shall enter upon his duties."

Change number of section 3 to "4."

Mr. White moved that the Senate concur in said amendments.

The President put the question whether the Senate would agree to said motion to concur, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendments.

The Assembly returned the bill entitled "An act to amend an act entitled 'An act to condense and amend the several acts incorporating or relating to the village of Skaneateles,' passed April 16th, 1857," with a message that they had concurred in the passage of the same, with the following amendments:

Insert as sections 1, 2, 3 and 4, the following:

Sec. 1. The number of trustees of the village of Skaneateles, shall consist of three instead of five, who shall be elected at the next charter election.

§ 2. The trustees elected at such election shall be classified by lot, to be publicly drawn by one of the inspectors thereof, immediately after completing the canvass of the votes given at such election: a certificate of such drawing shall be signed by the inspectors thereof, and filed with the clerk of the said village, who shall record the same in the book containing the proceeding of the corporation. The classes shall be numbered, one, two and three. The class having the shortest time to serve being numbered one, and the term of office of the person so drawn in number one shall expire on the first Tuesday in March, 1868; in class number two, on the first Tuesday of March, 1869; and in class number three on the first Tuesday in March, 1870.

§ 3. An election shall be held on the first Tuesday in March, 1868, and on the first Tuesday of March in each year thereafter, for the election of one trustee (and also to fill the vacancy in the office of any other trustee, if any such happen then to be, and also for the election of such other officers as are provided to be elected by the charter), and the term of office of such trustee shall expire in three years thereafter; and the term of office of every trustee thereafter elected shall be three years, except in the case of one elected to fill a vacancy in an unexpired term, in which case it shall only be for such unexpired term.

§ 4. The trustees shall appoint the one of their number having the shortest time to serve, president of the board of trustees, who shall hold the office of president during his term.

Change the number of section 1 to "5."

Insert as section 6, the following:

"All acts or parts of acts inconsistent herewith, or repugnant thereto, are hereby repealed and annulled."

Change number of section 2 to "7."

Mr. White moved that the Senate concur in said amendments.

The Assembly returned the bill entitled "An act to authorize joint stock Fire and Marine Insurance Companies to reduce their capital stock, and to amend the act to provide for the incorporation of Fire Insurance

Companies," with a message that they had concurred in the passage of the same, with the following amendments:

In 1st section, 5th line, engrossed bill, after the word "twenty" insert the word "five." 7th line, same section, strike out the words "such impaired" and insert the words "a reduced." After the word " provided" in the 12th and 13th lines, same section, insert the words "that in fixing such reduced capital no sum exceeding $25,000 shall be deducted from the assets and property on hand which shall be retained as surplus assets, and provided that no part of such assets and property shall be distributed to the stockholders, and provided further."

Strike out in section 5 all after the word "company" first occurring in the 6th line.

Strike out all after the word "to" first occurring in the second line, down to and including the word "induced" in the 3d line, and insert in lieu thereof the words "increase its capital stock."

Strike out the whole of the 7th section, and insert the following:

"§ 7. Section 12 of chapter 466 of the Laws of 1853, as amended, is hereby amended by adding at the end thereof the following:

"The word year, wherever used in this section, shall be construed to mean the calendar year."

Mr. Lent moved that the Senate concur in said amendments.

Mr. Low, from the committee on railroads, to which was referred the Assembly bill entitled "An act for the relief of the Niagara Street Railroad Company in the city of Buffalo," reported in favor of the passage of the same, with amendments and said bill was committed to the com mittee of the whole.

Mr. White gave notice that he would, at an early day, ask leave to introduce a bill for the better protection of emigrants arriving at the port of New York.

Mr. Gibson gave notice that he would, at an early day, ask leave to introduce a bill in relation to the Troy, Salem and Rutland Railroad Company, and to amend the law for its incorporation."
