The bill entitled "An act to confer additional powers upon the American Jockey Club," having been announced for a third reading,

Mr. Pierson moved to recommit the same to the committee, with instructions to amend as follows:

Add as section 5: "The said American Jockey Club is hereby authorized and empowered to offer premiums to be given at any of its regular meetings, and to invite competition for the purpose of improving the breed of horses; but nothing herein contained shall be so construed as to authorize the racing of horses for any bet or wager."

The President put the question whether the Senate would agree to said motion to recommit, and it was decided in the affirmative.

The bill entitled "An act to amend an act entitled 'An act authorizing William C. Bronson to convey certain waters by means of pipes along the highways of the town of Erwin,' passed May 2, 1864," was read a third time.

The President having announced the special order, being the bill entitled as follows:

"An act to authorize the construction of enlarged locks upon the Erie and Oswego canals, and to provide the means to pay the expense thereof."

Mr. Parsons moved that said bill be made the special order to-morrow evening.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Gibson moved that the report of the conference committee upon the bill entitled "An act providing for a convention of the people of the State to revise and amend the Constitution," be made the special order this evening, after the special order already made is disposed of.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

On motion of Mr. Andrews and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to allow increased compensation to the treasurer and late treasurer of Otsego county," was recommitted to the committee on internal affairs of towns and counties, with power to report complete.

Also, the Assembly bill entitled "An act to amend an act entitled 'An act to amend an act incorporating the village of Little Falls,' passed April 10, 1850, and to provide for the election of a police justice in said village," was recommitted to the committee on municipal affairs, with power to report complete.

On motion of Mr. Williams and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend an act entitled 'An act to consolidate road districts 18 and 19 in the town of Ledyard, in the county of Cayuga, and to provide for the election of path-master in said [SENATE JOURNAL.]

Mr. O'Donnell offered the following resolution:

Resolved, That the Secretary of State, Comptroller and Attorney General, are hereby authorized and required to obtain and have in readiness for use by the convention for revising the State Constitution, such information relative to the business of courts, the financial condition of towns and counties, the incorporation under general laws, and such other information as they may deem necessary. For this purpose, they shall have all the power of requiring answers from civil and military officers, that is conferred upon the convention itself, by the act providing for the calling of said convention.

Ordered, That said resolution be laid on the table.

On motion of Mr. H. C. Murphy and by unanimous consent, the rules were suspended, and the bill entitled "An act to release the right of the State to certain lands of Barney Conlon," was referred back to the committee on the judiciary, with power to report complete.

Also, the bill entitled "An act further to amend an act entitled 'An act in relation to sewerage and drainage in the city of Brooklyn,' passed April 15, 1857, passed April 16, 1859," was recommitted to committee on municipal affairs, with power to report complete.

On motion of Mr. Barnett and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to release the title and interest of the people of the State of New York, in and to certain real estate to Amanda A. Meyer," was recommitted to committee on the judiciary with power to report complete.

Mr. Barnett, offered the following resolution.

Resolved, That the bill entitled "An act to secure the navigation of the Oneida Lake canal," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said resolution, and it was decided in the negative, two-thirds of all the Senators present not voting in favor thereof.

On motion of Mr. White and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend chapter 585 of the Laws of 1865, so as to change the mode of electing the trustees of the Cornell University, to extend the time for providing buildings, fixtures and arrangements, and to authorize the trustees to borrow money," was referred to the committee on the judiciary, with power to report complete. Mr. Wood, offered the following resolution:

Resolved, That a committee of three be appointed to investigate the affairs of the Pacific Mail Steam Ship Company, with power to send for persons and papers.

Mr. Wood moved to amend by inserting after the word "Resolved," the words (if the Assembly concur), and also, that said committee act in conjunction with the committee of the Assembly.

Ordered, That said resolution be laid on the table.

On motion of Mr. Folger and by unanimous consent, the rules were suspended, and the bill entitled "An act to release the interest of the State of New York, in lands acquired by escheat to Margaret Furlong, and to authorize her to sell and convey the same," was recommitted to the committee on the judiciary, with power to report complete. Mr. Lent, offered the following resolution:

Resolved, That the bill entitled "An act to further amend 'An act in relation to the fees and compensation of certain officers in the city and county of New York," passed December 10th, 1847, by increasing the

salary of William W. Smith, a clerk in the surrogate's office," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

“An act to further amend an act entitled 'An act in relation to the fees and compensation of certain officers in the city and county of New York,' passed December 10, 1847, by increasing the salary of Wm. W. Smith, a clerk in the surrogate's office.

"An act extending the powers and duties of the commissioners of the Central Park."

"An act to encourage and aid the building of railroads."

After some time spent therein, the President resumed the chair, and Mr. Chambers, from said committee, reported in favor of the passage of the first named bill, without amendment, which report was agreed to and said bill ordered engrosed for a third reading.

Mr. Chambers, from the same committee, reported progress on the two last named bills, and asked and obtained leave to sit again.

Mr. Lent moved to recommit said second named bill, to the committee on municipal affairs, to retain its place on general orders.

The President put the question whether the Senate would agree to said motion to recommit, and it was decided in the affirmative.

On motion of Mr. Humphrey, the Senate took a recess until 7 o'clock, this evening.

The Senate again met.

Mr. Andrews from the committee on municipal affairs to which was recommitted the bill entitled "An act further to amend an act entitled 'An act in relation to sewerage and drainage in the city of Brooklyn,' passed April 15, 1857, passed April 16, 1859," with power to report complete, reported the same complete, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Andrews, from the committee on municipal affairs, to which was recommitted the bill entitled "An act to incorporate the village of Mayville, in the town of Chautauqua, county of Chautauqua, and to repeal its present charter," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Andrews, from the committee on municipal affairs, to which was recommitted the Assembly bill entitled "An act to amend an act entitled 'An act to amend an act incorporating the village of Little Falls,' passed April 10, 1850, and to provide for the election of a police justice in said village," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Lew, from the committee on railroads, to which was referred the bill entitled "An act in relation to the Troy and Boston Railroad Company," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

The Assembly sent for concurrence the bills entitled as follows: "An act to amend an act entitled 'An act to organize the State Lunatic
