On motion of Mr. Low and by unanimous consent, the rules were suspended, and the following entitled Assembly bills recommitted to the committee on the judiciary, with power to report complete:

"An act to provide for draining and reclaiming wet lands in the town. of Montgomery, Orange county."

"An act to provide for the completion of the unfinished business in the office of the surrogate of the county of Orange."

On motion of Mr. Pierson and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to close and discontinue so much of the Second avenue in the Tenth ward of the city of Brooklyn, as lies west of the Gowanus canal, and between the north line of First and the south line of Fourth street, in said ward and city," was recommitted to the committee on municipal affairs, with power to report complete.

Also, the Assembly bill entitled "An act to amend the charter of the Irving Savings Institution of the city of New York," was recommitted. to the committee on banks, with power to report complete.

On motion of Mr. Sutherland and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to extend the powers and jurisdiction of the police justice of the village of Yonkers, in the county of Westchester," was recommitted to the committee on the judiciary, with power to report complete.

Also, the bill entitled "An act to revive, continue in force and amend the act entitled "An act to incorporate the Yonkers Water Company," passed April 12, 1865," was recommitted to the committee on internal affairs of towns and counties with power to report complete.

Also, the following entitled Assembly bills, which were recommitted to the committee on roads and bridges, with power to report complete: "An act to lay out and open a highway leading from the village of West Farms to a highway leading to the village of Westchester, and to build a bridge on said highway over the Bronx river, in the county of Westchester.

"An act to amend an act entitled "An act to amend the Revised Statutes in relation to laying out public roads, and the alteration thereof, in the towns of North Castle, Bedford and Lewisborough, in the county of Westchester,' passed April 12, 1859."

On motion of Mr. Nicks and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to amend the charter of the village of Bath, in the county of Steuben," was recommitted to the committee on municipal affairs, with power to report complete.

On motion of Mr. Lent and by unanimous consent the rules were suspended, and the Assembly bill entitled "An act to incorporate 'The Trustees of the Presbytery of New York," was recommitted to the committee on charitable and religious societies, with power to report complete. Mr. La Bau offered the following resolution:

Resolved, That the Senate hold a session this evening at 7 o'clock, for consideration of bills on preferred calendar and general orders.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

On motion of Mr. H. C. Murphy and by unanimous consent, the rules were suspendnd, and the Assembly bill entitled "An act to authorize Matilda Elizabeth Georgina Pery, to take, hold, convey, devise and otherwise dispose of real estate," was recommitted to the committee on the judiciary, with power to report complete.

Also, the bill entitled "An act to authorize the Durango Silver Mines Company to issue a preferred stock," was recommitted to the committee on the judiciary, with power to report complete.

On motion of Mr. Bennett and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to legalize the acts of the board of excise commissioners of the county of Erie," was recommitted to the committee on the judiciary, with power to report complete. On motion of Mr. E. Cornell and by unanimous consent, the rules were suspended and the bill entitled "An act to incorporate the New York Lumber Manufacturing and Improvement Company," was recommitted to the committee on the judiciary, with power to report complete.

On motion of Mr. White and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to provide for the security and payment of certain indebtedness of the town of Onondaga, in the county of Onondaga," was recommitted to the committee on the judiciary, with power to report complete.

On motion of Mr. Collins and by unanimous consent, the rules were suspended, and the bill entitled "An act to reorganize the Fire Department of the city of Albany," was recommitted to the committee on municipal affairs, with power to report complete.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to reorganize the State Asylum for idiots, and to provide for the government of the same, passed April 12, 1-862," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

On motion of Mr. Platt and by unanimous consent the rules were suspended and the bill entitled "An act to amend chapter 600 of the Laws of 1865, passed April 28, 1865, entitled 'An act to amend an act entitled 'An act in relation to the compensation of the several officers of State Prisons,' passed April 23, 1864," was recommitted to the committee on State prisons, with power to report complete.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the special order, being the bill entitled as follows:

"An act for the protection of persons traveling upon Fourth avenue, in the city of New York."

After some time spent therein, the President resumed the chair, and Mr. Collins, from said committee, reported progress on said bill, and asked and obtained leave to sit again.

Mr. Andrews moved that said bill be made the special order this evening, at 7 o'clock.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Lent, from the committee on municipal affairs, to which was recommitted the Assembly bill entitled "An act to amend an act to incorporate the city of Poughkeepsie,' passed March 28, 1854, and the acts
