The Senate again met.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the Assembly bill entitled "An act to incorporate the trustees of the Presbytery of New York," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Williams, from the committee on State prisons, to which was referred the bill entitled "An act to amend chapter 600 of the Laws of 1865, passed April 28, 1865, entitled 'An act to amend an act entitled 'An act in relation to the compensation of the several officers of the State Prisons,' passed April 23, 1864," with power to report complete, reported the same complete, with an amendment, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. Sutherland and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate Washington Fire Engine Company No. 1, in the town of Eastchester, county of Westchester," was recommitted to the committee on internal affairs of towns and counties, with power to report complete.

Also, the Assembly bill entitled "An act to change the name of Headingville Methodist Episcopal Church of South East, Putnam county," was recommitted to the committee on charitable and religious societies, with power to report complete.

On motion of Mr. Folger and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to enable Ludovic de Noue and Elizabeth B. Harney, his wife, and their children, to take and hold real estate, and releasing the title of the State by escheat in certain lands," was recommitted to the committee on the judiciary, with power to report complete.

The Assembly sent for concurrence the bills entitled as follows:

"An act to amend an act entitled 'An act to amend chapter 196 of the Laws of 1854, regulating pilotage of the port of New York,' passed March 17, 1865," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

"An act to authorize the Commissioners of the Land Office to make a grant of lands under water, to David and Reuben Miller, at Livingston Station, on the Hudson River Railroad, for the purpose of constructing a dock," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

"An act to incorporate the Young Men's Christian Association of the city of Poughkeepsie," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

On motion of Mr. T. Murphy and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend an act entitled 'An act for the incorporation of the trustees of the Parochial Fund of the Protestant Episcopal Church in the Diocese of New York,' passed April 15, 1860," was recommitted to the committee on charitable and religious societies, with power to report complete.

On motion of Mr. Pierson and by unanimous consent, the rules were suspended, and the following entitled Assembly bills recommitted to the committee on the judiciary, with power to report complete:

"An act to amend an act passed March 22, 1865, entitled 'An act in relation to the appointment of a phonographic reporter to the city court of Brooklyn.""

"An act to direct the employment of a stenographer for the county court and court of sessions, and surrogate's court of Kings county."

On motion of Mr. La Bau and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate Snow

Drift Hook and Ladder Company No. 2 of Middletown, Richmond county," was recommitted to the committee on internal affairs of towns and counties, with power to report complete.

Also, the following entitled Assembly bills, were recommitted to the committee on the judiciary, with power to report complete:

"An act to amend an act to provide for the drainage of lands in the town of Flushing, in Queens county, passed April 17, 1866."

"An act to release to Bonaventura Kuttruff the interest of the State of New York in certain land in the town of Southfield, in the county of Richmond."

Mr. Andrews, from the committee on municipal affairs, to which was referred the bill entitled "An act to reorganize the fire department of the city of Albany," with power to report complete, reported the same complete, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Andrews, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act to close and discontinue so much of the Second avenue, in the Tenth ward of the city of Brooklyn, as lies west of the Gowanus canal and between the North line of First and the South line of Fourth street in said ward and city," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the special order, being the bill entitled as follows:

"An act for the protection of persons traveling upon Fourth avenue, in the city of New York."

After some time spent therein, the President resumed the chair, and Mr. Collins, from said committee, reported in favor of the passage of the same, with amendments.

Mr. Low renewed the amendment offered by him in committee of the whole, to strike ont all after enacting clause, and insert the following: Section 1. The New York and Harlem Railroad Company, are hereby directed to construct, at their own cost, an arch of brick or stone over their railroad tracks in Fourth avenue, in the city of New York, commencing at the southerly end of their arch or tunnel, at or near the intersection of Ninety-second street and Fourth avenues, and extending along and over their said tracks to the southerly side of Eighty-fifth street; the said arch to be constructed under the direction of the engineer of the Croton Aqueduct Department, that portion thereof between the southerly side of Ninety-second street and the southerly side of Eightyseventh street, to be completed on or before the first day of November, 1867, and the remainder thereof to be completed on or before the first day of November, 1868.

§ 2. For any failure or neglect on the part of the said New York and Harlem Railroad Company, to comply with the provisions of this act, the said company shall be liable to a penalty of two hundred and fifty dollars for every day and part of a day so offending, the said penalty to be sued for and collected in the name of the people of this State, in any court of record in the county of New York, by any freeholder, onehalf of said penalty, when collected, to belong to the person so suing
