Mr. Gibson offered the following resolution:

Resolved, That the canal committee be instructed to report forthwith, a bill for the construction of the five enlarged locks on the Champlain canal, not yet enlarged.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Andrews called from the table the bill entitled "An act to authorize the construction of enlarged locks upon the Erie and Oswego canals, and to provide the means to pay the expense thereof."

The President stated the question pending to be on the motion of Mr. Parsons to recommit said bill to the committee on canals, with instructions, as offered by him yesterday.

The President then put the question whether the Senate would agree to said motion of Mr. Parsons, and it was decided in the affirmative. Mr. Andrews called from the table the joint resolution, in the words following:

Resolved, (if the Assembly concur,) That the bill entitled "An act to authorize the construction of enlarged locks upon the Erie and Oswego canals, and to provide the means to pay the expense thereof," be referred to the Convention to revise and amend the Constitution of this State; and that in the judgment of this Legislature, the subject matter of the bill is commended to the consideration of the Convention in their adjustment of the organic financial policy of the State, so that the expenditure necessary for the enlargement of the canals to a capacity adequate to the prospective requirements of the trade of the adjoining and Western States, and of the North, may be met by such loan as shall wisely and fairly equalize the burden of the payment on the present and future resources of the State, as they shall be developed and augmented by such enlargement.

Resolved, That the Secretary of State is hereby requested to transmit to the Convention, at the opening thereof, an engrossed copy of said bill.

Mr. Barnett moved to lay said resolution upon the table.

The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the affirmative.

By unanimous consent, Mr. H. C. Murphy asked and obtained leave to introduce a bill entitled "An act to authorize the board of supervisors of Kings county to borrow money to erect an addition to the lunatic asylum for said county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

By unanimous consent, Mr. H. C. Murphy asked and obtained leave to introduce a bill entitled "An act to authorize the board of supervisors of Kings county to take additional land adjoining the county court house, for public use," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

By unanimous consent, Mr. H. C. Murphy asked and obtained leave to introduce a bill entitled "An act to authorize the board of supervisors of the county of Kings to borrow money for the purpose of enlarging or erecting an additional building for nursery purposes," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties. Mr. Williams, from the committee on railroads, to which was referred thebill entitled "An act to authorize the town of Queensbury, in the county of Warren, to issue bonds to aid in the construction of a railroad from the village of Glens Falls to intersect the Saratoga and Whitehall Railroad," with power to report complete, reported the same complete, with amendments, which report was agreed to and said bill ordered to a third reading.

Mr. Williams, from the committee on railroads, to which was referred the bill entitled "An act authorizing railroad companies to pay the taxes when assessed in the county, to the treasurer of the county where assessed," reported that they have amended the title so as to read "An act to facilitate the payment of taxes by railroad companies," and as amended, recommend its passage; said bill was committed to the committee of the whole.

Mr. Williams, from the committee on railroads, to which was referred the bill entitled "An act in regard to over-crowding of omnibuses, stages and horse cars on railroads," reported adversely thereto, which report was agreed to and said bill rejected.

Mr. Williams, from the committee on railroads, to which was referred the application for "An act to regulate the construction of the High Bridge Railroad within the corporate limits of the city of New York," reported adversely thereto, which report was agreed to and said bill rejected.

Mr. Collins, from the committee on canals, to which was referred the bill entitled "An act granting consent of the State of New York for the construction of a ship canal around the falls of Niagara," reported the bill as directed by the Senate, and said bill was committed to the committee of the whole.

Mr. Collins, from the committee on canals, to which was referred the bill entitled "An act authorizing the construction of five enlarged locks upon the Champlain canal, and to provide the means to pay the expense thereof," reported the bill as directed by the Senate, and said bill was committed to the committee of the whole.

Mr. Collins, from the committee on canals, to which was referred the bill entitled "An act to authorize the construction of enlarged locks upon the Erie canal, and to provide the means to pay the expense thereof," reported the bill as directed by the Senate, and said bill was committed to the committee of the whole.

Mr. Kline, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to amend sec. 3 of chap. 817, of the Laws of 1866, entitled 'An act to lay out and construct a road from the river road, in township No. 14, in the town of Johnsburgh, to the Carthage road near the head of Long Lake, in the county of Hamilton,"" reported in favor of the passage of the same, with amendments.

On motion of Mr. Kline and by unanimous consent, the rule was suspended and said bill recommitted to the committee to report complete. Mr. Godard, from the committee on militia and public defense, to which was referred the Assembly bill entitled "An act to incorporate the Soldiers' Home in the city of Brooklyn," reported in favor of the passage of the same, and said bill was committed to the committee of the whole. Mr. Barnett called from the table the resolution in the words following: Resolved, (if the Senate concur,) That 500 extra copies of the annual report of the trustees of the New York State Institution for the Blind, be printed for the use of the officers of that institution.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly, with a message informing that the Senate have concurred in the passage of the same, without amendment.

Mr. Godard, from a majority of the committee on claims, to which was referred the Assembly bill entitled "An act for the relief of John Harvey," reported in writing, and in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Parsons offered the following resolution:

Resolved, That the Clerk be authorized to furnish to each of the messengers of the Senate, five copies of the Manuals for 1867.

The President put the question whether the Senate would agree to said resolution, and it was decided in the negative.

On motion of Mr. E. Cornell and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate the city of Binghamton," was recommitted to the committee on municipal affairs, with power to report complete.

Also, the bill entitled "An act to amend an act to facilitate the construction of the Ithaca and Towanda Railroad, and to authorize towns to subscribe to the capital stock thereof," was recommitted to the committee on railroads, with power to report complete.

On motion of Mr. Folger and by unanimous consent, the rules were suspended, and the bill entitled "An act to allow the persons associated as the Sigma Phi Society, to incorporate under chapter 419 of the Laws of 1848, and to take and hold real and personal estate," was recommitted to the committee on literature, with power to report complete.

On motion of Mr. T. Murphy and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend an act entitled 'An act to incorporate the Franklin Savings Bank, in the city of New York,' passed April 14, 1860," was recommitted to the committee on banks, with power to report complete.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act in relation to the appointment of a commissioner of excise in the county of Herkimer," reported in favor of the passage of the same.

On motion of Mr. Andrews and by unanimous consent, the rule was suspended, and said bill recommitted to the committee to report complete.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act directing the board of town auditors of the town of Manheim, Herkimer county, to audit and allow certain claims against the said town, and providing

for the payment of the same," reported in favor of the passage of the

same.

On motion of Mr. Andrews and by unanimous consent, the rule was suspended, and said bill recommitted to the committee to report complete.

On motion of Mr. Chambers and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to amend chapter 380 of the Laws of 1866, authorizing the trustees of the village of Ellenville, Ulster county, to borrow money," was recommitted to the committee on municipal affairs, with power to report complete.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the Assembly bill entitled "An act to authorize the First Free Methodist Church in Clyde, to sell and convey a portion of their church property," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the Assembly bill entitled "An act to incorporate the Young Men's Christian Association of the city of Poughkeepsie," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

On motion of Mr. Wilbor and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to provide for the correction of errors in the equalization of the assessments in the various towns of Dutchess county, as made by the board of supervisors of said county," was recommitted to the committee on the judiciary, with power to report complete.

Mr. Wolcott moved to make the Niagara ship canal bill, the first bill in order to be considered.
