Mr. Humphrey, from the committee on railroads, to which was referred the bill entitled "An act to authorize the construction of a railroad on the Albany and Schenectady turnpike, and Washington avenue in the city and county of Albany, and city and county of Schenectady," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Sessions, from the committee on finance, to which was referred the bill entitled "An act for the relief of George Pettys, and to release to the heirs-at-law of August Pequinot, late of the town of Palermo, and county of Oswego, deceased, the right, title and interest of the State of New York, in and to certain surplus moneys," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. Wilbor and by unanimous consent, the rules were suspended and the Assembly bill entitled "An act to authorize the Commissioners of the Land Office to make a grant of lands under water to David and Reuben Miller, at Livingston Station, on the Hudson river railroad, for the purpose of constructing a dock," was recommitted to the committee on commerce and navigation, with power to report complete. The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to facilitate the construction of the New York Northern Railroad."

"An act to authorize the construction of five enlarged locks on the Champlain canal, and to provide the means to pay the expense thereof." "An act granting consent of the State of New York for the construction of a ship canal around the falls of Niagara."

After some time spent therein, the President resumed the chair, and Mr. White, from said committee, reported in favor of the passage of the first named bill, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. White, from the same committee, reported progress on the second named bill, and asked and obtained leave to sit again.

Mr. White, from the same committee, reported in favor of the passage of the last named bill, with amendments.

The question being upon agreeing to the report of the committee of the whole,

Mr. Parsons moved the amendment offered by him in committee of the whole, as follows:

"On condition only, that whatever sum or sums of money may be appropriated by the General Government for constructing such canal around the Falls of Niagara, a sum equal to each of such appropriations / shall be made at the same time by the General Government to the State of New York for the purposes of enlarging the Erie and Champlain canals; and that if such condition is not fulfilled and performed, the grant and cession hereby made shall cease and be null and void."

The President put the question whether the Senate would agree to said motion of Mr. Parsons, and it was decided in the negative:

The President then put the question whether the Senate would agree to the report of the committee of the whole, and it was decided in the affirmative.

Ordered, That said bill be engrossed for a third reading.

On motion of Mr. Pierson, the Senate took a recess until 71⁄2 o'clock P. M.

"An act to amend chapter 37 of the Laws of 1848, entitled 'An act to authorize the formation of Gas Light Companies,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on manufactures.

"An act to incorporate the New York and African Transportation Company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

"An act in relation to the acknowledgment and proof of deeds, mortgages and other instruments in writing, and the taking of affidavits," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.
