The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to incorporate the National Safe Deposit Company of the city of New York."

"An act to authorize the construction of a railroad on the Albany and Schenectady Turnpike, and Washington Avenue, in the city and county of Albany, and city and county of Schenectady."

"An act for an additional appropriation for the erection of an arsenal in the city of Rochester."

After some time spent therein, the President resumed the chair, and Mr. White, from said committee, reported that they have made some amendments to the first named bill, and amended the title by striking out the word "National" and inserting the word "American," and as amended, recommend its passage, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. White, from the same committee, reported in favor of the passage of the second named bill, without amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. White, from the same committee, reported that they have made some amendments to the last named bill, and amended the title so as to read "An act for a renewal of the appropriation for the erection of an arsenal in the city of Rochester," and as amended, recommend its passage, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. Parsons and by unanimous consent, the rule was suspended and said bill read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Cornell, from the committee on banks, to which was referred the bill entitled "An act to authorize the Institution for the Savings of Merchants' Clerks to change the location of its place of business," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Lent, from the committee on insurance, to which was referred the bill entitled "An act to authorize life insurance companies to make special deposits of securities in the Insurance Department," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Lent, from the committee on insurance, to which was referred the the bill entitled "An act to amend an act entitled 'An act to amend the act to provide for the incorporation of fire insurance companies,' passed June 25, 1853, passed March 26, 1865, and to require receivers and trustees of insurance companies to make annual and other statements," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act authorizing supplementary proceedings for the collection of taxes," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Lent, from the committee on insurance, to which was referred the bill entitled "An act to amend the charter of the Adriatic Fire Insurance Company of New York," reported in favor of the passage of the same.

On motion of Mr. T. Murphy and by unanimous consent, the rule was suspended, and said bill recommitted to the committee with power to report complete.

The Assembly returned the following entitled bills, with a message that they had concurred in the passage of the same, without amend-⚫ ment, to wit:

"An act to legalize the special town meeting of the town of Homer, held on the 2d day of April, 1867, to raise money to erect a new academy building in the village of Homer, Cortland county, New York."

"An act to change the name of the Rutger's Female Institute to 'Rutger's Female College,' and in relation to said college."

Mr. White presented a remonstrance of certain Onondaga Indians, against the sale of their stone quarry; which was read and referred to the committee on Indian affairs.

Mr. Folger presented a memorial and petition to incorporate the trustees of the Peabody Education Fund; which were read and referred to the committee on the judiciary.

Mr. Platt presented a petition of citizens of Warren county, for the passage of a law to amend the act relating to public instruction; which was referred to the committee of the whole.

Mr. Wilbor presented a remonstrance against the relief asked for by the Troy and Boston Railroad Company; which was laid on the table. Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend an act passed April 10, 1850, entitled

'An act to amend an act entitled An act to provide for the incorporation and regulation of telegraph companies,' passed April 12, 1848," with power to report complete, reported the same complete, which report. was agreed to and said bill ordered engrossed for a third reading.

Mr. Folger, from the committee on insurance, to which was referred the bill entitled "An act to amend the charter of the Adriatic Insurance Company of New York," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to make a separate road district of the village of Wellsville," reported in favor of the passage of the same.

On motion of Mr. Humphrey and by unanimous consent, the rule was suspended, and said bill recommitted to the committee with power to report complete.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the bill entitled "An act to provide for rebuilding the bridge across the State ditch at Jack's reefs," reported and asked to be discharged from the further consideration of the same, and that it be referred to the committee on finance; which report was agreed to.

The Assembly sent for concurrence the following resolution: IN ASSEMBLY, April 5, 1867. Resolved, (if the Senate concur,) That 2,000 copies of the proceeding of the State Medical Society be printed and bound in the usual manner for the use of the society, and ten copies each bound in like manner for the use of each member of the Legislature, and one copy to each officer and reporter.

Also, the following preamble and resolution:

IN ASSEMBLY, April 8, 1867. Whereas, the Honorable Walter L. Sessions, a member of the New York State Senate, has, at sundry times and in divers ways, during the last and present sessions of the Legislature, made charges and direct insinuations seriously, reflecting upon the official character and action of the past and present canal officers and legislators; and whereas, he is reported by a leading journal of last Saturday to have said in his place as a senator, that "he did not believe there was a single sealed bid for canal work during the last five years that was not opened by somebody before the day named for opening the bids. These bids are now required to be sent to the contracting board, and they cannot be opened except by some member of that board; and yet he did not hesitate to say that the secrecy thus enjoined has been repeatedly violated, and always against the interests of the State. Contracts that did not suit certain gentlemen are rejected on the mere pretence of informality,' and sub. sequently awarded to the highest bidder;" and whereas it is the bounden duty of the Legislature to investigate such accusations made by a senator; and whereas a committee has been duly appointed by concurrent resolutions of the Senate and Assembly to investigate such charges of corruption and fraud; therefore,

Resolved (if the Senate concur), that said committee be and they are hereby directed immediately to summon the said Hon. Walter L. Sessions to appear before them, and examine him in relation to alleged frauds of past and present canal officers, and all such other matters as the committee may deem proper, to the end that he may furnish the committee with all such information as he may possess on the subjects above named, and said committee are directed to report said testimony as soon as possible.. On motion of Mr. Lent and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate the Commercial Warehouse Company of the city of New York," was recommitted to the committee on commerce and navigation, with power to report complete.

On motion of Mr. E. Cornell and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate the National Telegraphic Union Association," was recommitted to the committee on the judiciary, with power to report complete.

Mr. Sessions, from the committee on finance, to which was referred the Assembly bill entitled "An act appropriating moneys for the building a new Capital," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Godard, from the committee on militia and public defense, to which was referred the Assembly bill entitled "An act to authorize the
