On motion of Mr. E. Cornell and by unanimous consent, the rule was suspended, and said bill recommitted to the committee with power to report complete.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to incorporate The National Telegraphic Union Association," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to confirm the title of Annanias F. Smith to certain lands in the village of Cape Vincent, county of Jefferson," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. White, from the committee on literature, to which was referred the Assembly bill entitled "An act relative to schools in the town of Seneca Falls," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

On motion of Mr. Folger and by unanimous consent, the rule was suspended and said bill read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to legalize the election of village officers of the village of Phelps, Ontario county, held March 19, 1867, and to authorize the respective officers elected at such election to take the oath of office, and to enter upon and continue the discharge of the duties of their respective offices," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. E. Cornell and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend part 4, chapter 1, title 6, of the Revised Statutes," was recommitted to the committee on the judiciary, with power to report complete.

Mr. E. Cornell offered the following:

Whereas, The large and rapidly increasing sums on deposit in the savings banks of this State render it an object of special importance that these investments should be properly secured, and the control and [SENATE JOURNAL.]

management of the institutions holding this trust should be carefully guarded by clear, consistent and uniform provisions of law, and whereas, the report of the Superintendent of the Banking Department relative to savings banks discloses many defects and many conflicting and incongruous provisions in existing laws relating to these institutions; therefore,

Resolved (if the Assembly concur), That the Superintendent of the Banking Department be and he is hereby authorized and directed to revise and consolidate the laws relating to savings banks, and institutions for savings in this State, with such amendments thereto as he may deem important, and report the same in the form of one complete and general act, together with such facts and suggestions in relation thereto as he may find it desirable and expedient to communicate to the Legislature, at the commencement of its annual session in 1868. And for the purpose of enabling him the more thoroughly and intelligently to perform the duty hereby imposed, he is further authorized and empowered, and it shall be his duty to make or cause to be made by one or more persons, appointed by him for that purpose an examination of such and so many of the savings banks and institutions for savings in this State as he shall find it necessary or expedient for this purpose to visit and exomine, in order to inquire into their interior working and management; their methods of conducting business; ther expenditure, their investments and their general and particular financial condition, and all other matters pertaining to their control and operation that he may deem necessary and desirable for his information; and for this purpose he shall have, during reasonable hours of the day, full and free access to all the books, papers and securities of such institutions, and shall possess all the authority to such examination of savings banks and institutions for savings as is now conferred upon him in regard to banks of issue and deposit by chapter 242 of the Laws of 1854. The expenses of such examination shall be audited by the superintendent and paid from and charged to the savings banks expense account, and shall be assessed upon the savings banks and institutions for savings in this State, and collected in the same manner as is now provided by law for other expenses of their institutions.

Ordered, That said resolution be laid on the table.

On motion of Mr. Sutherland and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to amend an act entitled 'An act to authorize the board of supervisors of the county of Westchester to purchase the Westchester turnpike road,' passed March 30, 1866," was recommitted to the committee on roads and bridges, with power to report complete.

Mr. White, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act to authorize the city of Syra cuse to issue bonds for an educational purpose," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

By unanimous consent, Mr. E. Cornell-asked and obtained leave to introduce a bill entitled "An act for the better protection of orphan and destitute children," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

By unanimous consent, Mr. Campbell asked and obtained leave to introduce a bill entitled "An act to release to Robert Jones, as trustee and executor, the title and interest of the people of this State in and to certain lands in the city of Utica, Oneida county, and empowering him

to convey the same," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

By unanimous consent, Mr. Sessions asked and obtained leave to introduce a bill entitled "An act to provide means for the construction of a court house, clerk's office and jail, at Little Valley, in the county of Cattaraugus, and to legalize certain bonds and obligations heretofore issued and executed to aid in the construction thereof," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act authorizing the Second and Third Avenue Railroad Companies, in the city of New York, to extend their tracks and operate the same."

Assembly, "An act to change the county seat, and county buildings, and courts of Schuyler county, from the village of Havana to the village of Watkins."

Assembly, "An act to prevent fraud and fraudulent practices upon hotel keepers, restaurant keepers, boarding house keepers, and inn keepers."

After some time spent therein, the President resumed the chair, and Mr. Parsons, from said committee, reported in favor of the passage of the first named bill, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Parsons, from the same committee, reported progress on the two last named bills, and asked and obtained leave to sit again.

Mr. Nicks moved that the second named bill be made the special order to-morrow, after the special orders already ordered are disposed of.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the Assembly bills entitled as follows:

"An act for the relief of Joseph W. Corning."

"An act to amend an act entitled 'An act to incorporate the New York Steam Transit Company,' passed April 19, 1866."

"An act to authorize the consolidation of the Maspeth Avenue and Toll Bridge Company and the Williamsburgh and Newtown Railroad Company into one corporation."

After some time spent therein, the President resumed the chair, and Mr. Low, from said committee, reported in favor of the passage of said named bills, without amendment, which report was agreed to and said bills ordered to a third reading.

The Assembly returned the following entitled bills, with a message that they have concurred in the amendments of the Senate thereto:

"An act renewing the charter of the Susquehanna Bridge Company of the village of Binghamton."

"An act to authorize the construction of an iron bridge over the Genesee Valley canal, in the village of Mount Morris."

"An act to incorporate the New York and Loug Island Bridge Company' for the purpose of constructing and maintaining a bridge over the East river between the city of New York and Long Island."

"An act to amend an act entitled 'An act to revise and consolidate

the laws in relation to the village of Waterloo, in the county of Seneca, and to enlarge the boundary of said village,' passed April 10, 1865."

"An act further to amend the act for the incorporation of insurance companies."

"An act to suppress intemperance and to regulate the sale of intoxicating liquors in the county of Dutchess."

"An act to amend section four of the act entitled 'An act to authorize the formation of town insurance companies,' passed April 17, 1857."

"An act to amend chapter 61, Laws of 1856, entitled 'An act to amend an act entitled An act to provide for taking acknowledgments of deeds and other written instruments, by persons residing out of the State of New York,' passed March 28, 1856."

"An act to authorize the Hartford Accident Insurance Company to effect insurance upon the lives of individuals.”

"An act to exempt the counties of New York and Kings from the provisions of chapter 353 of the Laws of 1865, entitled 'An act to amend the act in relation to the State Lunatic Asylum,' passed April 10, 1865." "An act to authorize the Canal Commissioners to construct a highway bridge over the Champlain canal, in the village of Fort Edward."

"An act to legalize the official acts of Richard Terry, justice of the peace in the town of Deauville, Jefferson county, and to authorize him to file his oath of office."

Ordered, That the Clerk return said bills to the Assembly.

The Assembly returned the following entitled bill:

"An act to incorporate the Soldiers' Business Messenger and Dispatch Company."

"An act to amend an act entitled 'An act in relation to taxes and assessments in the city of New York, and to amend the several acts in relation thereto,' passed April 14, 1859."

Ordered, That the Clerk deliver said bills to the Governor.

The Assembly returned the bill entitled "An act to regulate and increase the salaries of certain members of the Capital Police force, and to provide for the payment thereof," with a message that they had consented to a committee of conference, and appointed as such committee, on their part, Messrs. H. Smith, Potter, Ellis, Gurley and Robertson. Ordered, That the Clerk return said bill to the Assembly.

The Assembly returned the following entitled bill, with a message that they had concurred in the passage of the same, without amendment, to wit:

"An act in relation to the Croton Aqueduct Department in the city of New York."

Ordered, That the Clerk deliver said bill to the Governor.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act amending the act for the supply of Water for the State Lunatic Asylum from the Chenango canal,' passed April 18, 1859," reported in favor of the passage of the same.

On motion of Mr. Campbell and by unanimous consent, the rule was suspended and said bill recommitted to the committee with power to report complete.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend the Code of Procedure;" also, "An act to amend the 399th section of the Code of Procedure," reported that they have made some amendments thereto, and amended the title so as to read "An act to amend an act entitled 'An act to simplify and abridge the practice, pleadings and proceedings of the courts of this State known as the Code of Procedure,'” and as amended, recommend its passage; said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend part 4, chapter 1, title 6, part 27 of the Revised Statutes, in relation to telegraphic dispatches," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.
