Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in the passage of the same, without amendment.

The bill entitled "An act authorizing the Second and Third Avenue Railroad Companies, in the city of New York, to extend their tracks and operate the same," being announced for a third reading,

On motion of Mr. Low and by unanimous consent, said bill was amended as follows:

"Strike out in section 1, line 38, the words 'Stuyvesant and Tenth street,' and insert in lieu thereof the words 'St. Mark's place, on Eighth street.' Strike out in section 1, line 39, the words 'Stuyvesant street,' and insert in lieu thereof the words 'St. Mark's place, on Eighth street.' "Also, strike out in section 2 the words "also, commencing at the junction of the Third avenue and Seventy-first street, with their present tracks, and extending through and along Seventy-first street with a double track to the easterly side of the Fifth avenue.' Said bill, as amended, was read a third time.

The Assembly bill entitled "An act to release the title of the people of the State of New York, in and to certain real estate, to Mary Daley, Norah Daley, Eliza Daley and Delia Daley," was read a third time.

The Assembly sent for concurrence, the following resolution:

IN ASSEMBLY, March 13, 1867.

Resolved, (if the Senate concur,) That the Governor be and he is hereby authorized to confer on any officer of the National Guard of the State of New York, who has been honorably discharged from the military service of the United States, a brevet commission corresponding in rank to the commission of the highest grade which such officer may have received from the President of the United States, or from the Governor of this State.

IN ASSEMBLY, April 10, 1867. Resolved, (if the Senate concur,) That the Comptroller require the payment of the loan authorized by chapter 296 of the Laws of 1840, within three months after notice; and in default thereof, that all requisite legal proceedings be resorted to for its collection.

Mr. H. C. Murphy, from the committee on the judiciary, to which was referred the bill entitled "An act to incorporate the trustees of the Peabody Education Fund," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. H. C. Murphy and by unanimous consent, the rule was suspended, and said bill read a third time.

Mr. Andrews moved to take from the table the Assembly bill entitled "An act to amend the charter of the village of Penn Yan."

The President put the question whether the Senate would agree to said motion to take from the table, and it was decided in the affirmative. Mr. Andrews moved to recommit said bill to the committee on municipal affairs, to retain its place on general orders.

On motion of Mr. La Bau and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act in confirmation of the conveyance of lands to the Queens County Agricultural Society, and extending the powers of the officers of said society," was recommitted to the committee on agriculture, with power to report complete.

Also, the Assembly bill entitled "An act to authorize the New York Submarine Company to issue preferred stock," was recommitted to the committee on the judiciary, with power to report complete.

On motion of Mr. Pierson and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend an act passed April 23, 1861, entitled 'An act supplemental to an act entitled 'An act to consolidate the cities of Brooklyn and Williamsburgh and the town of Bushwick into one municipal government, and to incorporate the same,' pasesd April 17, 1854,'" was recommitted to the committee on municipal affairs, with power to report complete.

On motion of Mr. H. C. Murphy and by unanimous consent, the rules were suspended, and the following entitled Assembly bills recommitted to the committee on banks, with power to report complete:

"An act to incorporate the Hamilton Savings Bank, to be located in the city of Brooklyn."

"An act to incorporate the Germania Savings Bank in the city of Brooklyn."

On motion of Mr. Lent and by unanimous consent the rules were suspended, and the Assembly bill entitled "An act to amend the charter of the Guardian Life Insurance Company of New York," was recommitted to the committee on insurance, with power to report complete.

On motion of Mr. Low and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate the village of Douglas," was recommitted to the committee on municipal affairs, with power to report complete.

Also, the bill entitled "An act to amend an act entitled 'An act in regard to Union Free School District No. 1, in the town of Deerpark, and to enlarge its boundaries, and authorize the board of education thereof to raise money to purchase sites, and to build or purchase school houses," was recommitted to the committee on literature, with power to report complete.

Also, the Assembly bill entitled "An act to provide for the laying out of streets and roads in the city of Newburgh, and for other purposes," was recommitted to the committee on municipal affairs, with power to report complete.

Also, the Assembly bill entitled "An act to provide for the establishment of free schools in the village of Middletown," was recommitted to the committee on literature, with power to report complete.

On motion of Mr. Chambers and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to extend the bounds of the village of Kingston," was recommitted to the committee on municipal affairs, with power to report complete.

On motion of Mr. Crowley and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to provide for the effectual and thorough drainage of certain low lands situated in the
