Mr. Pierson called for the consideration of the concurrent resolution heretofore offered by him, as follows:

Resolved, (if the Assembly concur,) That the joint rules of the last session of the Legislature, be the joint rules for the present session.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly, and request their concurrence therein.

Mr. Andrews moved that the bill entitled "An act relating to the Metropolitan Board of Health, and to the duties and powers of said board," be committed to the first committee of the whole, on Wednesday next.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to amend an act entitled 'An act to prevent fraud in the opening and laying out of streets and avenues in the city of New York,' passed April 24, 1862."

"An act to provide for a supply of water in the city of Schenectady." "An act to amend an act entitled 'An act to provide for the supply of the city of Brooklyn with water,' passed April 16, 1859."

After some time spent therein, the President resumed the chair, and Mr. Lent, from said committee, reported progress on the two first named bills, and asked and obtained leave to sit again.

Mr. Lent, from the same committee, reported in favor of the passage of the last named bill, without amendment, which report was agreed to and said bill ordered engrossed for a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to release to Lewis I. Bazzain and Daniel D. Lord, trustees, a lot of land in the city of New York."

Assembly, "An act to establish a board of education in and for the village school district of the town of Malone, in the county of Franklin, and for other purposes."

Assembly, "An act to amend an act entitled 'An act to incorporate Vassar Female College,' passed January 28, 1861.

After some time spent therein, the President resumed the chair, and Mr. Bennett, from said committee, reported in favor of the passage of the first named bill, without amendment, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Bennett, from the same committee, reported in favor of the second named bill, without amendment, which report was agreed to and said bill ordered to a third reading.

Mr. Godard moved that the Assembly bill entitled "An act to establish a board of education in and for the village school district of the town of Malone, in the county of Franklin, and for other purposes," be now read a third time.

Mr. O'Donnell moved that the committee on internal affairs of towns and counties be discharged from the further consideration of the bill entitled "An act to reduce the expenses of maintaining prisoners supported by the county of Oswego," and that the same be referred to the committee on the judiciary.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Pierson, the Senate adjourned.

The Senate met pursuant to adjournment.

The journal of yesterday was read and approved.

The President announced the special order, being the consideration of the case of the County Judge of Oneida county.

Mr. Andrews moved to postpone until the order of business of "special orders."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. O'Donnell presented a petition of citizens of Lewis county, for a bridge over the Black river, in Lewis county; which was read and referred to the committee on canals.

Mr. Kline presented a petition of 123 citizens of the county of Saratoga, praying for the passage of a law authorizing the Canal Commissioners to construct a bridge across the Champlain canal at the village of Waterford, in said county; which was read and referred to the committee on canals.

Mr. Nicks presented a petition of citizens of Elmira, for the construction of a bridge over the Chemung canal, in said town; which was read and referred to the committee on canals.

Mr. Andrews presented a petition of Banks in Ulster county, for relief; which was read and referred to the committee on the judiciary.

Mr. Wolcott presented a petition of the Board of Trade of the city of Oswego, asking for the excavation of the channel of the Oswego river,

so as to improve the facilities for the transaction of commercial business in said city; which was read and referred to the committee on canals. Mr. Folger, from the committee on the judiciary, to which was referred the petition of Wm. Everitt for an act giving him the right of citizenship in the State of New York; reported adversely thereto, and in favor of the adoption of the following resolution:

Resolved, That the prayer of the petitioner be denied.

Mr. La Bau moved to lay the question of agreeing to the report of the committee on the table.

The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the affirmative.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend an act entitled 'An act to authorize the Emanuel Congregation of the city of New York to hold, grant and convey real estate," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act in relation to settling and closing up the affairs of the president, directors and company of the Bank of Monroe, a corporation whose charter has expired," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to authorize the board of supervisors of the county of Orange, to correct illegal assessments for town, county and State taxes," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the petition of the trustees of the First Street Presbyterian Church, for an act to enable them to donate and convey their property to the New York City Mission; reported by bill entitled "An act to enable the trustees of the First Street Presbyterian Church, to donate and convey their property to the New York City Mission," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend chapter 690 of the Laws of 1866, entitled 'An act to provide for the publication of legal notices in the county of Hamilton,' passed April 19, 1866," reported in favor of the passage of the same, and said bill was committed to the committee of the whole. Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act authorizing the Medina and Alabama Plankroad Company to reduce its number of directors," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Lent, from the committee on municipal affairs, to which was referred the bill entitled "An act to amend an act entitled 'An act in relation to taxes and assessments in the city of New York, and to amend the several acts in relation thereto,' passed April 14, 1859," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Wolcott, from the committee on public printing, to which was referred the resolution to print copies of the official list of members and officers of the Legislature, reported in favor of the adoption of the following resolution:
