Assembly, "An act providing for relief against illegal taxation."

After some time spent therein, the President resumed the chair, and Mr. Chambers, from said committee, reported that they have made some amendments to the first named bill, and amended the title by adding thereto the words: "and in relation to a uniform for the employees thereof," and as amended, recommend its passage; whch report was agreed to and said bill ordered to a third reading.

Mr. Chambers, from the same committee, reported progress on the second named bill, and asked and obtained leave to sit again.

Mr. Chambers, from the same committee, reported in favor of the passage of the last named bill, with amendments.

Mr. Low moved to disagree with the report of the committee of the whole, and that said bill be recommitted to the committee of the whole. Pending the question,

The journal of yesterday was read and approved.

Mr. Folger presented a remonstrance of citizens of Canandaigua, who signed the petition for a highway therein, against the passage of any law authorizing the same; which was read and referred to the committee on roads and bridges.

Also, a petition of John Van Arsdale, justice of the peace, for a law to confirm his acts; which was read and referred to the committee on the judiciary.

Mr. Campbell presented a remonstrance of citizens of Rome, against raising money for educational purposes; which was read and referred to committee on literature.

Also, four petitions of citizens of Rome, to raise money for educational purposes; which were read and referrred to the committee on literature. Mr. Parsons presented a petition of T. J. Jeffords and other citizens of Monroe county, for the Metropolitan Excise Law over the State; which was referred to the committee of the whole.

The President presented a communication from the Methodist Episcopal Conference, New Haven, Conn., relative to the subject of temperance; which was read and referred to the committee on internal affairs of towns and counties.

Mr. Pierson presented a petition of citizens of Brooklyn, in favor of the passage of a bill constituting eight hours a legal day's work; which was read and referred to the committee on the judiciary.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act to provide for the erection of a town hall in the town of Fort Edward, in the county of Washington," reported in favor of the passage of the same. On motion of Mr. Gibson and by unanimous consent, the rule was suspended and said bill recommitted to the committee, with power to report complete.

Mr. Andrews, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act to incorporate the Metropolitan Bathing Association," reported in favor of the passage of the same, with amendments.

On motion of Mr. C. G. Cornell and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Low, from the committee on railroads, to which was referred the Assembly bill entitled "An act to authorize the consolidation of the Buffalo and Oil Creek Cross-cut Railroad Company, in the State of New York, and the Cross-cut Railroad Company in the State of Pennsylvania," with power to report complete, reported the same complete, which report was agreed to and said hill ordered to a third reading.

• Mr. Low, from the committee on railroads, to which was referred the Assembly bill entitled "An act in relation to the Troy and Albia Horse Railroad Company," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on insurance, to which was referred the Assembly bill entitled "An act to amend the charter of the Security Life Insurance and Annuity Company," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on insurance, to which was referred the Assembly bill entitled "An act to amend the charter of the Home Life Insurance Company, filed April 28, 1860, pursuant to the provisions of the act entitled 'An act for the incorporation of life and health insurance companies, and in relation to agencies of such companies,' passed June 24, 1853," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to incorporate the New York Real Estate Exchange," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to authorize the election of a police justice in the village of Fishkill Landing, the building of a jail, and appointing police officers therein, and keeper of a jail," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Tyler of the town of Red Hook, in the county of Dutchess, to set apart a plot of land for a family cemetery," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Pierson, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act for the improvement of lands in and near the Wallabout bay, in the city of Brooklyn, and for laying out and constructing a basin, dock, and streets therein," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. White, from the committee on literature, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to amend an act to establish a free school in district No. 3, in the town of Newtown, county of Queens,' passed March 5, 1863," reported in favor of the passage of the same, with amendments.

On motion of Mr. H. C. Murphy, and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. White, from the committee on literature, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to incorporate the village of Jamaica, in the county of Queens into a separate school district, and to establish free schools therein,' passed July 18th, 1853," reported in favor of the passage of the same.

. On motion of Mr. La Bau and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Gibson, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to release the title and interest of the people of the State of New York in and to certain real estate, to Sarah Longstaff," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. White, from the committee on literature, to which was referred the Assembly bill entitled "An act to incorporate the Ulster Female Seminary," reported in favor of the passage of the same.

On motion of Mr. Chambers and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to repeal an act to authorize the improvement of the Boston Post road running through Port Chester, in the town of Rye, and of the cross streets intersecting the same, and laying out and regulating of sidewalks and fences therein, passed April 10, 1865," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to amend chapter 255 of the Laws of 1857, entitled 'An act to provide for straightening and working the highway leading from Losce's Corners to the village of Sing Sing, in the town of Ossining,' passed April 6, 1857," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

The Assembly returned the bill entitled "An act to incorporate Ellsworth Hose Company No. 5, of the town of Castleton, in the county of Richmond," with a message that they had concurred in the passage of the same, with the following amendment:

Section 4, line 2, after the word "shall," insert the words "forever thereafter."

Mr. La Bau moved that the Senate non-concur in said amendment. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have non-concurred in their amendment. Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to authorize the commissioners of highways to construct bridges in the town of Ellisburgh, county of Jefferson, and to levy tax for that purpose," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Wilbor, from the committee on internal affairs of towns and counties to which was referred the Assembly bill entitled "An act to enable the towns of Middletown and Southfield, of the county of Richmond, to purchase the property and franchise of the Richmond County Plankroad Company in said county, and to provide for the payment of the same," reported adversely thereto.

Mr. Folger moved to lay the report of the committee on the table. The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the affirmative.

By unanimous consent, Mr. Kline asked and obtained leave to introduce a bill entitled "An act to enable the supervisors of Montgomery county to refund illegal taxes," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Kline and by unanimous consent, the rule was suspended, and said bill read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Mr. Wolcott, from the committee on banks, to which was referred the Assembly bill entitled "An act to incorporate the Binghamton Savings Bank, in the village of Binghamton, Broome county, New York," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Andrews, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act to repeal certain laws in relation to the village of Niagara Falls, and providing for the election of trustees and their terms of office in said village," reported in favor of the passage of the same.

On motion of Mr. Crowley and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

The Assembly bill entitled "An act declaring Mill brook, in the counties of Essex and Warren, a public highway," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:
