The Assembly returned the bill entitled "An act to legalize the proceedings of the annual town meeting of the town of De Kalb, in the county of St. Lawrence, held on the 12th day of February, 1867, in relation to the appropriation and disbursement of certain surplus money which was paid over to the supervisor of said town by the late recruiting committee of said town of De Kalb," with a message that they had concurred in the passage of the same, with the following amendment: Add at the end of section one the words "or invested for such other purpose as the board of town auditors may determine."

Mr. Gibson offered the following resolution:

Resolved, That the Senate bill entitled "An act to amend the Code of Procedure," be recommitted to the committee on the judiciary, with power to report complete.

Mr. Chambers moved that the report of the committee of the whole on the quarantine bill, be taken from the table.

On motion of Mr. H. C. Murphy and by unanimous consent, said bill was amended, as follows:

Strike out the words "lands adjacent or near to the waters of the harbor of New York upon which to erect a suitable structure," in the 4th and 5th lines of section 1, and insert "Barren Island to erect a temporary structure if it become necessary until a suitable permanent structure shall be erected on west bank, which the said board above named, are hereby directed to construct as soon as practicable."

Insert after the words "boarding station," in 10th line, the words "on the west end of Coney Island."

Strike out all after "health officer" in the amendment adopted in committee of the whole.

Mr. Sessions, from the committee on finance, to which was referred the Assembly bill entitled "An act making appropriations for certain expenses of government, and for supplying deficiencies in former appropriations," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Sessions moved that said entitled bill, and the Assembly bill entitled "An act to provide means by tax to pay certain awards made by the Canal Appraisers and Canal Board, and to pay the expenses of sundry improvements upon the canals not chargeable to ordinary repairs," be made a special order this afternoon at 4 o'clock, and that a session be held at that time for that purpose.

Mr. Wood moved that the Assembly bill entitled "An act to incorporate the New York Joint Stock Company," be considered in the same committee of the whole.

Section two, line one, strike out the words "five-tenths," and insert the words "one-third." Line five, strike out the word "seven," and insert the word "five," and in lines five and six, strike out the words "and fifty." Lines eleven and twelve, strike out the words "the Albany and Susquehanna and other."

Section three, line two, strike out the words "each year," and insert "1867." Strike out in line ten, all after the word "act," down to and including the word "county" in line thirteen. Same section, strike out all after the words "or otherwise," in line sixteen to the end of said section.

Section four, line two, after the word "exclusively," insert the words "or partly." Line three, after the word "bonds," insert the words "used in the construction of said road." Add at the end of same section the words "for State purposes."

Mr. Godard moved to concur in the amendments of the Assembly thereto, except the first as follows: "except that the ten mile restriction shall not apply to any steam railroad now being constructed, or hereafter to be constructed on Long Island."

Mr. Pierson moved to amend that Senate concur in all the amendments. Mr. Kline moved to concur with the further following amendment: "Amend the bill so that the said restriction shall not apply to the Fonda, Johnstown and Gloversville railroad."
