Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in the passage of the same, with amendments.

The Assembly bill entitled "An act for the relief of John Underwood, and to provide for the payment of extra work in building a bridge in the village of Penn Yan," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in the passage of the same, with amendments.

The Assembly returned the bill entitled "An act to legalize the proceedings of the annual town meeting of the town of De Kalb, in the county of St. Lawrence, held on the 12th day of February, 1867, in relation to the appropriation and disbursement of certain surplus money which was paid over to the supervisor of said town by the late recruiting committee of said town of De Kalb," with a message that they had concurred in the passage of the same, with the following amendment: Add at the end of section one the words "or invested for such other purpose as the board of town auditors may determine."

Mr. Godard moved that the Senate concur in said amendment: The President put the question whether the Senate would agree to said motion to concur, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and threefifths of said members being present, as follows:

The Assembly sent for concurrence the bills entitled as follows: "An act to incorporate the United States Safe Deposit Company of the city of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to incorporate the Mutual Safe Deposit Company of the city of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act for the relief of the Monterey, Cooper's Plains, Painted Post and Corning Plankroad Company," which was read the first time, and by

unanimous consent was also read the second time, and referred to the committee on roads and bridges.

"An act to legalize the official acts of John A. Canady, a justice of the peace of the county of Albany," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Collins, and by unanimous consent, the rules was suspended, and said bill referred to the committee on the judiciary, with power to report complete.

"An act relating to building or repairing sidewalks in the village of Andes, in Delaware county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

"An act to legalize the official acts of William A. Wait as notary public," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to impose tolls for the use of the State basin at West Troy, in certain cases," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on canals.

"An act to amend an act entitled 'An act to consolidate the several school districts and parts of districts within the corporate limits of the village of Saratoga Springs, and to establish a free union school or schools therein," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on literature.

"An act to legalize the acts of Nash Dyke, a justice of the peace of the county of Franklin," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act for the appointment of a harbor master for Hempstead harbor in the county of Queens," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation

"An act to incorporate the Newburgh Bay Ferry Company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

"An act to provide for the hearing and determination of the claims of Margaret Shannon and others, for damages caused by the Oswego canal enlargement," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on claims. A message from the Assembly was received and read, in the words following:

The committee of conference of the two Houses upon the matters in difference between the two Houses upon the Assembly bill entitled "An act to incorporate the Ontario County Soldiers' Monument Association, and to raise money by tax to erect a monument," reported as follows:

That they recommend that the Senate recede from its amendments made to said bill.

The President put the question whether the Senate would agree to the report of the conference committee, and it was decided in the affirmative,

On motion of Mr. Stanford and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate the Producers' Warehouse, Guaranty and Commission Company," was referred to the committee on the judiciary, with power to report complete. Mr. Gibson offered the following resolution:

Resolved, That the Senate bill entitled "An act to amend the Code of Procedure," be recommitted to the committee on the judiciary, with power to report complete.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Chambers moved that the report of the committee of the whole on the quarantine bill, be taken from the table.

The President put the question whether the Senate would agree to said motion to take from the table, and it was decided in the affirmative. The President announced the question to be upon agreeing to the report of the committee of the whole.

On motion of Mr. H. C. Murphy and by unanimous consent, said bill was amended, as follows:

Strike out the words "lands adjacent or near to the waters of the harbor of New York upon which to erect a suitable structure," in the 4th and 5th lines of section 1, and insert "Barren Island to erect a temporary structure if it become necessary until a suitable permanent structure shall be erected on west bank, which the said board above named, are hereby directed to construct as soon as practicable."

Insert after the words "boarding station," in 10th line, the words "on the west end of Coney Island."

Strike out all after "health officer" in the amendment adopted in committee of the whole.

The President put the question whether the Senate would agree to the report of the committee of the whole, as amended, and it was decided in the affirmative

Ordered, That said bill be read a third time.

Mr. Sessions, from the committee on finance, to which was referred the Assembly bill entitled "An act making appropriations for certain expenses of government, and for supplying deficiencies in former appropriations," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Sessions moved that said entitled bill, and the Assembly bill entitled "An act to provide means by tax to pay certain awards made by the Canal Appraisers and Canal Board, and to pay the expenses of sundry improvements upon the canals not chargeable to ordinary repairs," be made a special order this afternoon at 4 o'clock, and that a session be held at that time for that purpose.

Mr. Wood moved that the Assembly bill entitled "An act to incorporate the New York Joint Stock Company," be considered in the same committee of the whole.

The President put the question whether the Senate would agree to said motion of Mr. Wood, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to said motion as amended, and it was decided in the affirmative, twothirds of all the Senators present voting in favor thereof.

The Assembly returned the bill entitled "An act to aid and encourage the building of railroads," with a message that they had passed the same, with the following amendments to engrossed bill:

Line five, section one, after the word "thereof," insert the words "except that this ten mile restriction shall not apply to any steam railroad now being constructed, or hereafter to be constructed on Long Island."

Section two, line one, strike out the words "five-tenths," and insert the words "one-third." Line five, strike out the word "seven," and insert the word "five," and in lines five and six, strike out the words "and fifty." Lines eleven and twelve, strike out the words "the Albany and Susquehanna and other."

Section three, line two, strike out the words "each year," and insert "1867." Strike out in line ten, all after the word "act," down to and including the word "county" in line thirteen. Same section, strike out all after the words "or otherwise," in line sixteen to the end of said section.

Section four, line two, after the word "exclusively," insert the words "or partly." Line three, after the word "bonds," insert the words "used in the construction of said road." Add at the end of same section the words "for State purposes."

Mr. Godard moved to concur in the amendments of the Assembly thereto, except the first as follows: "except that the ten mile restriction shall not apply to any steam railroad now being constructed, or hereafter to be constructed on Long Island."

Mr. Pierson moved to amend that Senate concur in all the amendments. Mr. Kline moved to concur with the further following amendment: "Amend the bill so that the said restriction shall not apply to the Fonda, Johnstown and Gloversville railroad."

The President put the question whether the Senate would agree to said motion of Mr. Kline, and it was decided in the negative, as follows:

Mr. O'Donnell moved that a committee of conference be appointed on the part of the Senate, and a like committee requested on the part of the Assembly on the matters in difference.

Messrs. O'Donnell, Humphrey and Pierson were appointed as such committee.

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have agreed to all their amendments except the first named, and on that they have appointed a committee of conference, and request like committee.

Mr. Low offered the following resolution:

Resolved, That a committee of three Senators be appointed, with power to sit during the recess of the Legislature, and examine into the financial management and condition of the canals and salt springs of the State, and to report to the Constitutional Convention the propriety of selling
