Chap. 541.

AN ACT to amend an act entitled "An act to
authorize the making and opening of a road or
avenue in the towns of White Plains, Harrison
and Rye, in the county of Westchester, to be
known as and called Westchester avenue."

Passed May 3, 1869; three-fifths being present.
The People of the State of New York, represented in
Senate and Assembly, do enact as follows:

SECTION 1. Section six of the act entitled "An act to
authorize the making and opening of a road or avenue
in the towns of White Plains, Harrison and Rye, in the
county of Westchester, to be known as and called West-
chester avenue," passed June fifth, eighteen hundred and
sixty-eight, is hereby amended so as to read as follows:

§ 6. The moneys necessary to make, grade, work and bonds, for otherwise improve said Westchester avenue, shall be raised by the issue of bonds, which shall be a charge upon and paid by the towns through which said avenue Proportion may be laid, but each town shall only be required to pay for the making, working and improving so much of said Westchester avenue as shall be within its limits; How exe- such bonds shall be issued from time to time as required on the requisition of the commissioners for opening and making said avenue by the county treasurer of the county of Westchester, and shall be signed by said county treasurer, and attested by the clerk of the board of supervi sors of the county of Westchester, who shall each keep Rate of in a record of the same in his office. The said bonds shall bear interest at a rate not to exceed seven per cent per annum; shall be in sums not less than one hundred dollars each, and shall not run over fifteen years. The commissioners, for the opening and making said avenue, shall receive said bonds and convert them into money at not less than their par value, and shall expend the proceeds thereof in making, grading, working and improving said avenue, and the expenses authorized by this act. The said board of commissioners shall make a full exhibit in detail of all bonds and moneys received therefrom, and of all moneys expended therefrom by

2. AN ACT in relation to certain bounty moneys in the town of Mansfield, in the county of Cattaraugus.

AN ACT authorizing the trustees of the village
of Mount Morris to subscribe to the capital
stock of the Mount Morris Water Works Com-
pany.

The People of the State of New York, represented in
Senate and Assembly, do enact as follows:

SECTION 1. In addition to the powers now vested in the trustees of the village of Mount Morris, they shall have the power and authority, when authorized by the taxable inhabitants of said village as hereinafter proable vote. vided, to subscribe in the name and for the corporation of said village to the capital stock of "The Mount Morris Water Works Company," to an amount not exceed ing ten thousand dollars, and such subscription, when so authorized, shall be made by the president of said village.

§ 2. When such subscription to such stock is so authorized and made, it shall be lawful for the trustees of said village, and they are hereby authorized and empowered to borrow, on the faith and credit of said village of Mount Morris, the amount of money necessary to pay such subscription or any part thereof, and the interest thereon, and to issue the bonds of said corporation therefor to secure the payment thereof, to be signed by the president and clerk of said village in their official capacity, and sealed with the seal of the said corporation in such form in other respects, and for such amount,

§3. This act shall take effect immediately.

AN ACT supplementary to an act entitled "An act for the relief of Elizabeth Craft, the widow of Edwin Craft," passed April nineteenth, eighteen hundred and sixty-nine.

Passed May 3, 1869; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The sum of two thousand three hundred and forty dollars is hereby appropriated to Elizabeth Craft under and in accordance with the provisions of an act entitled "An act for the relief of Elizabeth Craft, the widow of Edwin Craft," passed April nineteenth, How pay eighteen hundred and sixty-nine, and the treasurer is directed to pay the same on the warrant of the comptroller out of any moneys in the treasury unappropriated. 2.
