AN ACT to increase the powers of the Sisterhood of Saint Mary, a corporation.

Passed May 3, 1869.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The Sisterhood of Saint Mary, a corporaof corpora- tion incorporated under the provisions of the act entitled "An act for the incorporation of benevolent, charitable, scientific and missionary societies," and the several amendments thereto, may provide for the appointment of an advisory committee of not less than three, nor more than eight persons, which committee shall have charge of the property and funds of the incorporation; but the liability of the trustees of such corporation shall not be affected thereby, nor shall such committee be liable as trustees of the corporation on account of the same.

§2. The said corporation may take, receive and hold, by devise or otherwise, real and personal estate for the purposes of its incorporation, provided the whole of said real and personal estate so taken and held, shall at no time yield an annual income of over twenty thou sand dollars, exclusive of the real estate actually in use by the said corporation for the purposes of the same, subject to all existing provisions of law relative to devises and bequests by last will and testament.

§ 3. This act shall take effect immediately.

AN ACT to authorize the construction and main-
taining of a free bridge over the Chemung
river, in the town of Chemung, in the county
of Chemung.

Senate and Assembly, do enact as follows:

§2. §3. The board of supervisors of the county of Chemung are hereby authorized and required to levy upon and cause to be collected from the taxable inhabitants and property of the town of Chemung, in the same manner as other town charges are levied and collected in said town, sufficient moneys to pay the principal and interest on said bonds, in time to meet such principal and interest at maturity. The said moneys when collected shall be paid over to the supervisor of said town, and by him be applied in payment of such principal and

§ 5. Whenever at any time it shall become necessary to rebuild the whole or any considerable part of the bridge herein provided for, on request of the commissioners of highways of said town, a town meeting shall be called therein, at which three bridge commissioners shall be appointed, and such sum as shall be deemed proper for the rebuilding of the said bridge shall be voted, and the provisions of this act, so far as applicable, shall apply to and define the duties of said commissioners, of the supervisor of said town, and of the board of supervisors of said county, relative to the rebuilding of said bridge.

§ 6. As soon after the passage of this act as possible, taxpayers it shall be the duty of the commissioners appointed by the first section thereof to obtain the consent in writing of a majority of the tax payers of said town of Chemung, owning or representing as agent, president or otherwise, including owners of non-resident lands, more than onehalf of the taxable property of said town assessed and appearing upon the assessment roll for the year eighteen hundred and sixty-eight, that the tax herein authorized for the purposes aforesaid may be levied on and collected from the property of the town as in this act provided. And said commissioners shall not proceed with their duties under this act, nor, shall said supervisor countersign said bonds until the consent of a majority

of the tax payers, representing a majority of the prop-
erty as hereinbefore provided for, shall first be obtained,
proof of which shall be made by a certificate of one of
the assessors of said town, filed in the town clerk's office
thereof, and shall be verified by the affidavit of one or
more of said bridge commissioners, filed in said town
elerk's office, that the said consent of a majority of the
tax payers aforesaid was fairly and honestly obtained.
§ 7. This act shall take effect immediately.

Association.'

SECTION 1. The board of commissioners of excise of Excise Steuben county shall, within ten days after the receipt thereof, pay, or cause to be paid, to the treasurer of the Hornell Library Association of Hornellsville, all moneys received by them or either of them for licenses granted by said board within the town of Hornellsville under and by virtue of an act to suppress intemperance and regu late the sale of intoxicating liquors, passed April sixteenth, eighteen hundred and fifty-seven, instead of pay ing the same to the county treasurer of Steuben county as now provided by said act. And all moneys received by said board of commissioners of excise, or either of said commissioners, from penalties or fines for the violation of said act to suppress intemperance and regulate the sale of intoxicating liquors, passed April sixteenth, eighteen hundred and fifty-seven, within the town of Hornellsville, shall also be paid by said board of commissioners of excise, or either of said commissioners of excise, to the said treasurer of the Hornell Library Association within ten days after the receipt thereof by them, or either of them.
