§ 41. The board of trustees shall have power to renew, from time to time, any warrant annexed to any tax or assessment roll authorized by said trustees, provided the time for collecting such taxes is not extended beyond the first day of April next succeeding the date of said warrant.

42. All tax or assessment rolls filed with the clerk or delivered to the collector shall, in all courts and places, be presumptive evidence of the imposition of the taxes therein contained.

§ 43. Upon receiving the tax roll, the said collector tice of re- shall cause notice to be posted in three public places in said village, that the said roll has been delivered to him for the collection of the taxes therein contained, and that he will be ready, at such place, and on such days in the week (which shall be at least two) as shall be designated by him, between nine and twelve o'clock in the forenoon, and two and seven o'clock in the afternoon of each day, for three weeks ensuing the first publication of such notice, to receive payment of taxes thereon; and that persons paying taxes within that period will be charged only one per cent for the collecCollectors tion thereof. after such publication, at such place and on such days as shall be designated by him, between the hours aforesaid, to receive taxes on such roll, and shall be entitled to charge on those taxes paid within that period, one per cent in addition, for the collection thereof. 44. At the expiration of the three weeks mentioned in the preceding section, the collector shall then proceed to collect the uncollected taxes upon the tax roll delivered to him, in the same manner and with the same powers and duties as a town collector, in the collection of taxes imposed by the board of supervisors, and shall be entitled to charge, in addition to said taxes, five per cent for the collection of the same; and, in case any person shall neglect to pay his or her tax or the fees aforesaid, to levy and collect the same by levy and sale

§ 45. If the collector shall neglect or refuse to pay to Trustees the treasurer of the village any moneys by him col- actions lected, or shall be guilty of any default in the perform- collector ance of his duties, the said board of trustees may cause an action to be brought against him and his sureties in the corporate name of the said village, upon his official bond, in any court having cognizance thereof, without further proceedings prior thereto.

46. The board of trustees shall have power to collect, by civil action, any tax imposed pursuant to the provisions of this act, against any person or corporation, which shall be returned by the collector as unpaid; but such action shall be commenced within one year after such return by the collector.

§ 47. This act shall take effect immediately.

TITLE ONE.

§ 2. All that part of the town of Springport, in the county of Cayuga and State of New York, which is contained within the following boundaries and limits, to wit: Beginning at the shore of Cayuga lake, at the northwest corner of the Cayuga residence reservation, being the southwest corner of lot number one hundred and three of East Cayuga reservation, and runs from thence south eighty-eight degrees east seventy-nine chains and sixtyfive links to the southeast corner of said lot number one hundred and three; thence north two degrees east one hundred and forty-five chains and four links to H. G. Hammond's south line; thence north eighty-eight degrees west forty-two chains and fifty-seven links to the west side of the lake road; thence south twenty degrees east six chains and five links to R. B. Howland's north line; thence north eighty-eight degrees west fiftynine chains and sixty links; thence south two degrees west ten chains and sixty-two links to the lake shore; thence southerly along the east shore of the Cayuga lake to the place of beginning.

TITLE SECOND.

OF OFFICERS AND ELECTIONS.

SECTION 1. The officers of said village shall consist of three trustees, one clerk, one treasurer, one collector, one police justice, one police constable and such other officers as are hereinafter authorized to be appointed, all of whom shall be inhabitants of said corporation qualified to vote under this act.

§ 2. An election shall be held on the second Tuesday in March, in each year, for the election of one trustee and the other officers aforesaid, and all laws relating to general elections of State officers, as far as the same shall be applicable, shall be deemed to apply to all elections authorized by this act.

§3. Every person residing within the bounds of said corporation who shall have been a resident thereof for thirty days previous to any election under this act and possessing the qualification prescribed by the Constitu

tion of this State to authorize him to vote for elective offices, may vote at any election held in pursuance of this act, but no person shall vote upon any proposition to raise a tax or appropriate the same at any meeting or election, unless he shall at the time be liable to be assessed for such tax.

§ 4. To regulate or prohibit the rolling of hoops, playing at ball, flying kites, sliding down hill on sleds, or any other amusements or practices having tendency to annoy persons passing on the streets or sidewalks, or to frighten teams or horses in said village; and to regulate and prevent the firing of guns, pistols, fire-arms, and the use or firing of crackers, rockets, squibs and fire-works in said village.

4. To regulate and determine the time and place of bathing in any of the waters of the Cayuga lake or millponds or outlets in said village, or adjacent thereto, or to prevent the same.

5. To restrain the running at large of cattle, horses, swine, sheep, goats and geese, and to authorize the dis training, impounding and sale of the same, for the penalty incurred and costs of proceeding, and to appoint one or more persons to drive any of the aforesaid animals so running at large, to the pound, and to deter mine their fees and duties; to establish and regulate public pounds; to appoint pound keepers, and to pre scribe their powers and duties, and to regulate and prevent the running at large of dogs owned by persons residing in said village.
