SEC. 2. The act entitled an act for the protection of sheep, approved December 11, 1875, is on and after the passage of this act repealed.

SEC. 3. This act shall take effect and be in force from and after its passage.

CHAPTER 87.
Woods-Firing Of.

AN ACT to Prevent the Firing of Woods, Prairie and other Grass Lands.

Be it enacted by the Council and House of Representatives of the Territory of Wyoming:

SECTION 1. If any person or persons shall wilfully or aring woods. negiigently set on fire any woods, prairies or other grass lands, such person or persons shall be deemed guilty of a crime, and shall upon conviction thereof, pay a sum not exceeding five hundred (500) dollars each, nor less than one hundred (100) dollars, and be imprisoned not more than six months nor less than thirty days; and said fine shall go to the school fund of the county in which said offense was committed.

SEC. 2. If any person or persons shall set on fire any woods, prairie or other grass lands, either wilfully or negligently, so as thereby to occasion damage to any other person or persons, such person or persons first named shall make satisfaction for such damages to the party injured, to be recovered in an action.

SEC. 3. Nothing herein contained shall be so conagainst fire. strued as to prevent any persons from firing against fires so as to protect property from being destroyed. Nor shall this act be construed to apply to any person who may in the months of March, April and October set fire to the grass land and sage brush upon his own land or upon the public land unclaimed or unoccupied, which fire he shall keep within proper control and prevent it from doing injury or damage to property of others; but should the property of others he injured by said setting on fire, it shall be prima facie evidence of negligence.

SEC. 4. An act to prevent the firing of woods and marshes, approved November 23, 1869, and found on page

853 of the compiled statutes, and any other acts or parts of acts inconsistent with this act are hereby repealed. This act shall take effect aud be in force from

Council Joint Resolution No. 1.

Be it enacted by the Council and House of Representatives of the Territory of Wyoming:

That the secretary of the council and chief clerk of the house be respectively instructed to procure and furnish to each member daily, one copy of all the daily newspapers published in the Territory of Wyoming. Approved November 11, 1879.

Council Joint Memorial No.1.

To R. B. Hayes, President of the United States:

Your memorialists, the legislative assembly of the Chief Justice Territory of Wyoming, would most respectfully represent of the supreme that the Hon. Wm. W. Corlett, late delegate in congress

court of Wyoming.

from our Territory, has, through his undoubted honesty, sterling integrity and eminent legal abilities, rendered himself most acceptable to the people of Wyoming Territory, as a suitable person to be appointed the successor of the Hon. Joseph W. Fisher, chief justice of said Territory, who, we learn, has tendered his resignation of said responsible position. Therefore, we, your memorialists, the legislative assembly of the Territory of Wyoming, believing that we truly represent, in this respect, our respective constituents, would most respectfully request that in your sound judgment, you do appoint the Hon. William W. Corlett to supply the

vacancy which may occur by the acceptance of the resig nation of Chief Justice Joseph W. Fisher.

Resolved, That a copy of this memorial be transmitted by the secretary of Wyoming Territory without unnecessary delay to R. B. Hayes, President of the United States.

That the conncil and house of representatives are cach hereby authorized to employ an assistant clerk at a Assistant secsalary not to exceed five dollars per day for the time retary and which assistant clerk is employed during the session of the sixth legislative assembly..
