CHAPTER 1.

Adoption Amendments to Act Relating to.

AN ACT to Amend Chapter Two, of the Compiled Laws of Wyoming, being an
Act Relating to Adoption.

Be it enacted by the Council and House of Representatives of
the Territory of Wyoming:

SECTION 1. That chapter two of the compiled laws of Abandonment Wyoming, be amended by adding to section nine of said of children. chapter the following: In any case of parents abandoning their children without providing for their support and education, the county commissioners shall have the same authority to act as in case of the parents' death. Provided, That if the residence of the parents is known, the county commissioners shall notify them to take away Duty of Comor provide for their children, and if the parents do not claim such children within three months after such notice is given, the county commissioners shall have authority to provide for the children's adoption as in case of the parents' death, or to bind them out to suitable persons under a written agreement for a certain number of years, a copy of such agreement to be approved, and filed with the probate judge of the county.

SEC. 2. SEC. 3. Any person having the natural or lawful charge of any minor child under the age of sixteen years, who shall wilfully abandon such child, so that such child becomes a charge upon the county, wherein such abandonment took place, shall be deemed guilty of a misdemeanor, and, upon conviction, be fined in any sum not exceeding one hundred dollars, or imprisoned in the county jail for a period of time sufficient to pay such fine, at the rate of one dollar per day, should such fine not be obliga-paid.

SEC. 4. If any person in any county in this Territory, having the natural or legal charge of any such child, shall abandon such child, so that such child shall become a charge upon the county wherein such abandonment Duty of Com- took place, the person so abandoning such child shall be liable to a civil action by attachment without undertaking, by the board of county commissioners, for all expenses that may be, or have been incurred by such county in consequence of such abandonment. The affidavit for attachment and petition in the district court, or summons, if the action is in a court of a justice of the peace, shall allege that the person so abandoning such minor child was a person able to support it, and if the proof shall show that the ability of such person was equal to that of any other person in the community with means no greater than of the person so abandoning such child, the allegation of ability to support such child shall be deemed proved; Provided, That the defendant in such action may give in evidence sickness or other cause tending to lessen his or her ability to support such child.

SEC. 5. This act shall take effect and be in force from and after its passage.

Appropriations.

AN ACT Making Divers Appropriations and for Other Purposes.

Be it enacted by the Council and House of Representatives of the Territory of Wyoming:

SECTION 1. That the sum of nine hundred and six and sixty-hundredths dollars be and the same is hereby penses. appropriated out of the funds in the Territorial treasury, in so far as the same may be necessary, to pay and defray the expenses of the sixth legislative assembly for which provisions are not otherwise made, viz: For pay of the assistant clerk of the council, one hundred and sixty-five dollars; for pay of the assistant clerk of the house, one hundred and ninety-five dollars; for pay of the assistant enrolling clerk of the council, ninety-five dollars; for pay of the assistant enrolling clerk of the house, ninety-five dollars; for pay of the clerk of the joint committee of ways and means, sixty dollars; for pay of the Leader Printing Company, for newspapers and printing, eightyone and thirty-hundredths dollars; for pay of E. A. Slack, for newspapers and printing, seventy-five and thirtyhundredths dollars; for pay of L. D. Pease, for newspapers, sixty-six dollars; for pay of W. B. Trufant, for extra clerk work, forty dollars; for pay of W. G. Provines, for extra clerk work, fifty dollars; for pay of A. G. Lee, for extra clerk work, twenty-five dollars.

SEC. 2. SEC. 4. That the sum of four thousand dollars, or so much thereof as may be necessary, be and the same is hereby appropriated out of the Territorial treasury to pay for keeping and transporting the insane of Wyoming Territory for the two years next ensuing.

SEC. 5. That the sum of four thousand eight hundred Stenographer. dollars be and the same is hereby appropriated out of the Territorial treasury to pay the salary and mileage of the Territorial stenographer for the ensuing two years.

SEC. 14. That the sum of one thousand dollars, or so Penitentiary much thereof as may be necessary, be and the same is hereby appropriated out of the Territorial treasury to pay the penitentiary commission and all contingent expenses connected therewith.

SEC. 15. That the sum of two hundred dollars, or so Ordnance and much thereof as may be necessary, is hereby appropriated arms. out of any funds in the Territorial treasury not otherwise appropriated, to pay for the care and transportation of arms and ordnance belonging to or in the custody of the Territory.

SEC. 16. That the sum of fifteen hundred and fifty Territorial dollars or so much thereof as may be necessary, be and the same is hereby appropriated out of any funds in the treasury of the Territory not otherwise appropriated, to pay the contingent expenses of Territorial offices, as follows, viz: For the governor's office, one thousand dollars; for the secretary's office, three hundred dollars; for the auditor's office, one hundred and fifty dollars; for the treasurer's office, one hundred dollars.

SEC. 17.
