And after some time spent therein, Mr. Scott, from said committee reported progress on said first mentioned bill, and asked and obtained leave to sit again.

Mr. Scott, from said committee, reported in favor of the passage of said second mentioned bill, with amendments, which report was agreed to, and said bill ordered engrossed for a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to incorporate the Corpus Christi Ship Channel Company."

"An act to change the name of John Peter Bayer to John Peter Chatillon."

"An act to change the name of Emrilous Janette Hadlock to Emrilous Janette Williams."

And after some time spent therein, Mr. Loveland from said committee, reported progress on said first mentioned bill, and asked and obtained leave to sit again.

Mr. Loveland, from said committee, reported in favor of the passage of said second and third mentioned bills, which report was agreed to, and said bills ordered engrossed for a third reading.

"An act to amend an act entitled 'An act revising, amending and consolidating the several acts in relation to the village of Kingston,' passed April 10, 1854."

And after some time spent therein, Mr. Ames, from said committee, reported in favor of the passage of said first mentioned bill, which report was agreed to, and said bill ordered engrossed for a third reading.

Assembly bill, "An act to amend an act entitled 'An act to revise, amend and consolidate the several acts relating to the village of Whitesboro.""

"An act to amend title 1, of chapter 2, of the 4th part of the Revised Statutes, relative to proceedings to prevent the commission of crimes."

And after some time spent thereon, Mr. Foote, from said committee, reported in favor of the passage of said first mentioned bill with amendments, which report was agreed to, and said bill ordered engrossed for a third reading.

Mr. Foote, from said committee, reported progress on said second mentioned bill, and asked leave to sit again.

On motion of Mr. Hubbell, and by unanimous consent, the committee of the whole was discharged from the further consideration of said bill, and it was ordered referred to a select committee to report complete.

Mr. Ames, from said committee, reported progress on said third mentioned bill, and asked and obtained leave to sit again.

The President appointed as the select committee on the Assembly bill to amend the charter of the village of Whitesboro', Messrs. Hubbell, J. A. Willard and Burhans.

Mr. Loveland, from the committee on public printing, to whom was referred the resolution to print extra copies of the report of the Superintendent of Public Instruction, reported the following resolu

tion:

Resolved, That two thousand extra copies of the report of the Superintendant of Public Instruction, be printed for the use of the Senate.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Loveland from the committee on public printing, to whom was referred the resolution to print extra copies of the report of the State Engineer and Surveyor, reported the following resolution :

Resolved, That fifteen hundred extra copies of the report of the State Engineer and Surveyor, be printed for the use of the Senate. The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

On motion of Mr. Paterson, the Senate adjourned.

The journal of yesterday, was read and approved.

Mr. Darling presented the petition of Sally Mullett for relief of the estate of James Mullett, deceased, which was read and referred to the committee on the judiciary.

Mr. Boardman presented the petition of Geo. Cooke, for an act of incorporation of an insane asylum at Canandaigua, which was read and referred to the committee on charitable and religious societies.

Mr. John D. Willard presented a petition to amend the charter of the village of Whitehall, which was read and referred to the committee on the incorporation of cities and villages.

Mr. Foote presented a remonstrance of citizens of Sherburne village, against the passage of the act relating to said village, which was read and referred to the committee on the incorporation of cities and villages.

Mr. Loveland presented two petitions of citizens of Warren and Clinton counties, for aid to the Troy University, which were read and referred to the committee on literature.

Mr. Smith presented two petitions of taxable inhabitants of school district No. 4, in the town of Newtown, Queens county, for a law legalizing the acts of the county commissioners of said county, which was read and referred to the committee on literature.

Mr. Smith presented a petition of trustees of districts, Nos. 4 and 11, for a law legalizing the act of the school commissioners, which was read and referred to the committee on literature; also, the petition of James Ferguson, for relief from an escheat, which was read and referred to the committee on the judiciary.

Mr. Williams presented a petition of citizens of Wolcott, Wayne county, for aid to Troy University, which was read and referred to the committee on literature.

Mr. Halsted presented a petition of tax payers of the town of Cuba, for an act for the relief of Jas A. Storey, Caleb M. Pierce, and Chas Amsden, which was read and referred to the committee on the internal affairs of towns and counties.

Mr. Diven presented a petition of members of the Canandaigua Walton Club, praying for an act of incorporation, which was read and referred to the committee on the internal affairs of towns and counties.

Mr. Ely presented a memorial of the Commissioners of the Sinking Fund of the city of New York, which was read and referred to the select committee, to which is referred the petition of Croton commissioners.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the petition of the board of supervisors of Ulster county, for a law authorizing the election of an additional superintendent of the poor, reported a bill entitled "An act to provide for the election of two additional superintendents of the poor in Ulster county," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the Assembly bill, entitled “An act for the compensation of a clerk for the treasurer of the county of Kings," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act relating to the term of office of the county treasurer of the county of Monroe," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the Assembly bill, entitled "An act authorizing persons convicted before magistrates or courts of special sessions, in the town of Waterford, in the county cf Saratoga, and sentenced to imprisonment into the county jail at hard labor, to be transported directly to the Albany penitentiary," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Laflin, from the committee on literature, to which was referred the Assembly bill entitled "An act to appropriate the proceeds.

of the State tax for the support of schools," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Prosser, from the committee on canals, to which was referred the bill, entitled "An act to provide for the performance of certain duties imposed upon a canal commissioner in cases where he is disqualified from acting," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was referred the petition of George Guenther for an amendment of chapter 548, of the Laws of 1857, reported a bill entitled "An act to amend chapter 548, of the Laws of 1857, entitled 'An act authorizing the payment of money to George Guenther, for work done on the Erie canal," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act to amend the act passed February 17, 1857, entitled 'An act to enable Peter Cooper to found a scientific institution in the city of New York;"" and also to amend the act passed March 21, 1857, entitled "An act to amend the act entitled 'An act to enable Peter Cooper to found a scientific institution in the city of New York,' passed February 17, 1857," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Hubbell, from the select committee, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to revise, amend and consolidate the several acts relating to the village of Whitesboro','" with power to report complete, reported the same complete, which report was agreed to, and said bill ordered to a third reading.

The Assembly returned the concurrent resolution in relation to an increase of postage, with a message that they had concurred in the passage of the same without amendment.

Mr. Halsted gave notice that he would, at an early day, ask leave to introduce a bill entitled "An act for the relief of Jas. A. Story, Caleb M. Pier and Chas. Amsden."

Mr. Diven gave notice that he would, at an early day, ask leave to introduce a bill, entitled "An act to incorporate the Canandaigua Walton Club."

Mr. John D. Willard gave notice that he would at an early day ask leave to introduce a bill in relation to the village of Whitehall. In pursuance of previous notice, Mr. John D. Willard asked and obtained leave to introduce a bill entitled "An act to protect the liberty of witnesses," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary
