Mr. Mather moved that the question be made the special order for Friday, 25th inst., immediately after reading the journal.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The bill entitled "An act to amend an act entitled 'An act for the incorporation of cities and villages, passed December 7, 1847, so far as the same relates to the village of Oneida, in the county of Madison, and to provide for the erection of a watch house in said village," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

Mr. Truman moved that the Senate now adjourn.

Mr. Boardman moved to recommit the bill entitled "An act to amend an act entitled 'An act to regulate the sale of keg oysters,' passed April 10, 1849," to the committee on the judiciary, with instructions to strike out the following words: "and not more than one quarter of the quantity so marked on any keg or can shall be liquid."

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

Said bill was then read a third time.

The Assembly bill entitled "An act to amend chapter 9, title 9, article 8, part 1st of the Revised Statutes, entitled 'Regulations and

Mr. Laflin offered the following resolution:

Resolved, That Senate bill "120," entitled "An act to extend the time for the collection of taxes in the county of Herkimer," be referred to the first committee of the whole.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, two-thirds of all the members elected to the Senate voting in favor thereof.

On motion of Mr. Scott,

Resolved, That the petition of sundry inhabitants of Saratoga Springs, for an amendment of the excise law, be referred to the select committee having in charge the amendments to said law.

On motion of Mr. Foote,

Resolved, That there be printed for each member, officer and reporter of the Senate, ten copies of the report of the Superintendent of the Banking Department, on Savings Banks.

Mr. Brandreth offered the following resolution :

Resolved, That there be printed for each member, officer and reporter of the Senate, ten copies of the annual report of the State Medical Society.

Mr. Pratt moved to amend the resolution, by striking out "ten,” and inserting "two."

Mr. Boardman moved to amend the amendment, by striking out "two," and inserting "twenty-five."

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

The President appointed as the select committee on the resolution offered yesterday, by Mr. Loveland, to investigate charges made by the Senator from the 9th, Messrs. Loveland, Scott and Darling.

Also, as the select committee on the bill to amend the act to suppress intemperance, &c., Messrs. Johnson, John D. Willard and Foote.

Mr. John D. Willard offered the following resolution:

Resolved, That the bill entitled "An act to authorize the Troy and Boston Railroad Company to erect a freight depot and construct a track in the City of Troy," be referred to the first committee of the whole.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, two-thirds of all the members elected to the Senate voting in favor thereof. On motion of Mr. Halsted, the Senate adjourned.

The Senate met pursuant to adjournment.

Prayer by the Rev. Mr. Roof.

The journal of yesterday was read and approved.

Mr. Mather presented a petition of citizens of New York and Kings counties, in regard to the annual rental charged by gas companies for gas metres, which was read and referred to the committee on the incorporation of cities and villages.

Mr. Foote presented a petition of 137 citizens of De Ruyter, Madison co., for the passage of a law prohibiting the sale of intoxicating liquors as a beverage, which was read and referred to the committee on the internal affairs of towns and counties.

Mr. Brandreth presented three remonstrances of citizens of Westchester co., for the repeal of the law creating a police justice in the village of Peekskill, which were read and referred to the committee on the incorporation of cities and villages.

Mr. Brandreth presented a remonstrance of citizens of Peekskill, against the repeal of said law, which was read and referred to the committee on the incorporatoin of cities and villages.

Mr. Ames, from the committee on commerce and navigation, to which was referred the bill entitled "An act vesting the control of the piers, booms and dams, on Salmon river, in the commissioners for improving the said river," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act requiring the commissioner of jurors for the city and county of New York, to make semi-annual reports," reported adversely to the passage of said bill, which report was agreed to.

Mr. Scott, from the committee on the erection and division of towns and counties, to which was referred the Assembly bill entitled "An act to annex a part of the town of Italy, in the county of Yates, to the town of Naples, in the county of Ontario," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act requiring monthly reports from the corporation attorney of the City of New York," reported adversely to the passage of said bill, which report was agreed to.

Mr. Pratt gave notice that he would at an early day ask leave to introduce a bill to amend an act entitled "An act to amend and consolidate the several acts relative to the village of Athens, passed April 16, 1857."

Mr. W. A. Wheeler gave notice that he would at an early day ask leave to introduce a bill entitled "An act requiring thirty six jurors. to be drawn for circuit courts in the county of Franklin."

Mr. Williams gave notice that he would at an early day ask leave to introduce a bill entitled "An act to enlarge the Auburn State Prison."

Mr. Ely gave notice that he would at an early day ask leave to introduce a bill entitled "An act in relation to the court of special sessions in the city and county of New York."

In pursuance of previous notice, Mr.W. A. Wheeler asked and obtained leave to introduce a bill entitled "An act for the relief of Nathan Webb, a justice of the peace in the town of Champlain, in

the county of Clinton," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. Darling asked and obtained leave to introduce a bill entitled "An act relating to special county judge of Chautauque county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

By unanimous consent, Mr. Ely asked and obtained leave to introduce a bill, entitled "An act in relation to the court of special sessions in the city and county of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

On motion of Mr. Williams,

Resolved, That the Inspector in charge at Clinton prison, be requested to take testimony in relation to the claim of Jacob D. Kingsland, against the State, and notify the Senate committee on State prisons, what day he will be ready to take said testimony.

Mr. Williams moved to take from the table the motion to reconsider the vote on the bill entitled "An act authorizing the board of supervisors of the county of Wayne, to abolish the fees of the offices of county judge and surrogate of said county."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to said motion to reconsider, and it was decided in the negative.

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

Mr. W. A. Wheeler offered the following resolution:

Resolved, That the Auditor of the Canal Department be respectfully requested to inform the Senate at the earliest practicable moment, whether any drafts have been drawn by the Canal Commissioners since the commencement of the present session of the Legislature, on account of work done on the canals, when there was no money in his hands to pay the same; and if so, at what dates, in what amounts, by what Commissioner, and in whose favor. And that he be also requested, on Wednesday, of each week, during the present sitting of the Legislature, to communicate the like information as to any and all such drafts as shall be drawn during the week preceding his report.

Mr. Ames moved to lay the resolution on the table.
