The Senate met pursuant to adjournment.

Prayer by Rev. Dr. Mayo.

The journal of Saturday was read and approved.

Mr. Mather presented a memorial of Jas. Boorman, and others, in favor of the extension of Albany street, and the widening of Trinity Place and Morris street, in the city of New York, which was read and referred to the committee on the incorporation of cities and villages.

Mr. Mather presented a petition of N. H. Wolfe, and other merchants and citizens of New York, asking for increased capacity to the canals of this State, to enable her to maintain her preeminence for the trade of the west, which was read and referred to the committee on canals; also, a petition of citizens of New York and Brooklyn, for relief in regard to the rental charged for gas metres, which was read and referred to the committee on the incorporation of cities and villages; also, a memorial of Jos. S. Smith, and others, in reference to the laws regulating the traffic in intoxicating drinks, which was read and referred to a select committee.

Mr. W. A. Wheeler presented a petition of sundry inhabitants of the town of Canton, in the county of St. Lawrence, for an amendment to their village charter, which was read and committed to the committee of the whole.

Mr. J. A. Willard presented a petition of 242 citizens of Lewis county, for the passage of a personal liberty bill, which was read and referred to the committee on the judiciary; also, a petition of John Bradley, of Brownville, Jefferson co., for relief, which was read and referred to the committee on claims.

Mr. Foote presented a petition of 82 citizens of the town of Nelson, Madison co., for the passage of an act prohibiting the sale of intoxicating liquors as a beverage, which was read and referred to a select committee.

Mr. Halsted presented a petition of sundry veterans of the war of 1812, for an amendment of the law of April 15, 1857, which was read and committed to the committee of the whole.

Mr. Prosser presented a petition of James P. White, and others of the city of Buffalo, for aid to the Buffalo Lying-in-Hospital and Widow's and Foundling's Asylum, which was read and referred to the committee on charitable and religious societies.

Mr. Diven presented a petition of Wm. Rockwell, and others, praying for a law to provide for draining certain lands destroyed by the Chemung canal, which was read and referred to the committee on canals.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the petition of the proprietor of Hugg Town Pond, and others, for the better protection of

fish in said pond, reported a bill entitled "An act for the protection of the proprietor or proprietors of Hugg Town Pond, in Spencer, Tioga county, in the production and preservation of fish in said pond," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Smith, from the committee on charitable and religious societies, to which was referred the petition of the First Sabbatarian Baptist Church of Brookfield, for a change of name, reported a bill entitled "An act to change the name of the First Sabbatarian Baptist Church and Society of Brookfield, to that of the First Seventh Day Baptist Church of Brookfield," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Truman, from the committee on charitable and religious societies, to which was referred the petition of the trustees of the First Baptist Society in Pomfret, for a change of the name of said society, reported a bill entitled "An act to change the name of the first Baptist Society in Pomfret, to the Fredonia Baptist Society," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill entitled "An act for the construction of a road from the town of Osceola, in the county of Lewis, to the town of Martinsburgh, in said county," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill entitled "An act in relation to plankroads and turnpike companies," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole

Mr. Foote, from the committee on militia and public defence, to which was recommitted the bill entitled "An act to amend an act passed April 15, 1857, entitled 'An act to provide for the appointment of commissioners for the adjustment and payment of certain claims for services of the militia of this State in the war of 1812,'' reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted presented the annual report of the Physician of the Marine Hospital, which was laid on the table and ordered printed. (See Doc. No.

Mr. Ely, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act to amend an act entitled 'An act to amend and consolidate the several acts relative to the village of Athens,' passed April 16, 1857," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Darling, from the committee on railroads, to which was referred the bill entitled "An act to cancel and discharge certain mortgages, on property of the Auburn and Syracuse Railroad Co., reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole. Mr. Loveland from the committee on public printing, to whom was referred the resolution to print extra copies of the report of the select committee on the sanitary condition of the City of New York, reported the following resolution:

Resolved, That 1,000 additional extra copies of the report of the select committee on the sanitary condition of the city of New York, be printed for the use of the committee.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Loveland, from the committee on public printing, to whom was referred the resolution to print extra copies of the report of the State Engineer and Surveyor on railroads of this State, reported the following resolution:

Resolved, That there be printed for the use of the Senate, 1,000 extra copies of the report of the State Engineer and Surveyor on railroads of this State.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Darling, from the committee on railroads, to which was referred the bill entitled "An act to reduce the capital stock of the Cayuga and Susquehanna Railroad Company," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Darling, from the committee on engrossed bills, reported as correctly engrossed, the bills entitled as follows:

"An act to incorporate the Corpus Christi Ship Channel Company."

"An act to amend the charter of the village of Herkimer."

"An act to amend an act passed February 17th, 1857, entitled 'An act to enable Peter Cooper to found a Scientific Institution in the City of New York;'" and also to amend the act passed March 21st, 1857, entitled "An act to amend the act entitled 'An act to enable Peter Cooper to found a Scientific Institution in the City of New York,' passed February 17th, 1857."

Mr. Ely, from the select committee, to which was referred the bill entitled "An act relative to the public health of the city of New York," with power to report complete, reported the same complete, with amendments, which report was agreed to.

A message from the Assembly was received and read informing that they had concurred in the amendments of the Senate to the bill entitled as follows:

"An act to provide for the payment to John A. King, the amount of money paid by him for the troops stationed at Quarantine, Staten Island."

Ordered, That the Clerk return said bill to the Assembly.

The Assembly returned the bill entitled "An act to extend the time for the collection of taxes in the counties of Herkimer, Suffolk, Queens and Chemung, in the town of Pomfret, Chautauque county, in the town of Kingston, Ulster county, and in the town of Chateaugay, Franklin county," with a message that they have concurred in the passage of the same with the following amendments: First, strike out of the title all after the word "taxes," in the second line of engrossed bill.

Section first amended, by adding after the word "towns," in the 5d line, engrossed bill, the words "of this State, except the towns in the county of Schuyler, and the towns in the First Assembly District, in the county of Westchester."

Also, strike out of the engrossed bill, all after the word "towns," in 2d line, to and inclusive of the word "Franklin," in the 7th line. Also, insert after the word "complying," in the 7th line, the words "within ten days after the passage of this act." Also, insert after the word "State," in the 10th line, the words "except so far as that act requires a compliance with its conditions, within ten days after the time which is now or shall hereafter be provided by law for the collection of taxes.”

Insert the following, as section 2.

§2. If the collectors of taxes in the several towns in the county of Schuyler, and the towns in the First Assembly District, in the county of Westchester, shall, within the time now provided by law, pay over all moneys by them collected, to the county treasurer, and shall renew their securities to the satisfaction of the supervisors of each town in said county of Schuyler, and the First Assembly District of Westchester, the time for the collection and making the final return of taxes in said counties shall be, and is hereby extended to the second day of May, 1859.

Change section 2, of engrossed bill, to section 3.

Mr. Laflin moved to lay the bill on the table.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

By unanimous consent, Mr. Laflin asked and obtained leave to introduce a bill entitled "An act to extend the time for the collection of taxes in the several towns and cities in this State, and to provide for a more speedy payment of the taxes into the treasury of this State," which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Smith, and by unanimous consent, the rule was suspended, and the Senate resolved itself into a committee of the whole and proceeded to the consideration of said bill; and after some time spent therein, the President resumed the chair, and Mr. Ely reported that the committee of the whole had had under consideration the bill entitled "An act to extend the time for the collection of taxes in the several towns and cities in this State, and to provide for a more speedy payment of the taxes in the Treasury of this [SENATE JOURNAL.]

State," have gone through the same, made no amendments thereto, and have directed their Chairman, to report the bill to the Senate, and recommend its passage.

Mr. Hubbell moved to recommit said bill to the committee on the internal affairs of towns and counties.

Mr. Ely moved to lay the report of the committee of the whole on the table, and that the bill be printed.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

In pursuance of previous notice, Mr. Truman asked and obtained leave to introduce a bill, entitled "An act to amend the act entitled 'An act to amend the several acts incorporating the village of Owego, in the county of Tioga,' passed April 9, 1851," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the incorporation of cities and villages.

In pursuance of previous notice, Mr. W. A. Wheeler asked and obtained leave to introduce a bill entitled "An act providing for copying the books of record when necessary, in the office of the clerk of the county of Franklin," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

In pursuance of previous notice, Mr. Ely asked and obtained. leave to introduce a bill entitled “An act in relation to the North Western Dispensary in the City of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the incorporation of cities and villages.

In pursuance of previous notice, Mr. Halsted asked and obtained leave to introduce a bill entitled "An act to amend the charter of the village of Attica," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the incorporation of cities and villages.

The bill entitled "An act to amend an act passed Feb. 17, 1857, entitled ‘An act to enable Peter Cooper to found a Scientific Institution in the City of New York;"" and also to amend the act passed March 21, 1857, entitled "An act to amend the act entitled 'An act to enable Peter Cooper to found a Scientific Institution in the City of New York,' passed Feb. 17, 1857," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:
