The President announced that under the previous rule of the Senate, the hour had arrived at which the final vote must be taken on the resolution, without debate or delay.

The President then put the question whether the Senate would agree to said resolution of Mr. Diven, and the vote was as follows:

Mr. Brandreth having voted, asked leave to withdraw his vote, and objection being made,

Mr. Mather moved that Mr. Brandreth have leave to withdraw his vote.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

No quorum voting on the resolution, the President decided the resolution lost.

By unanimous consent, Mr. Diven asked and obtained leave to introduce a bill entitled "An act to submit to the people a law authorizing a loan of $2,500,000, to provide for the payment of the floating debt of the State," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

The order of third reading of bills being announced,

Mr. Diven moved to lay that order of business on the table. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:

The Senate met pursuant to adjournment.

Prayer by the Rev. Mr. Yates.

The journal of yesterday was read and approved.

Mr. Johnson asked and obtained leave to have his name recorded in the affirmative, on the bill to provide means for the enlargement and completion of the canals.

Mr. Mather presented a petition of citizens of the city of New York, asking for an appropriation for the canal across the Cayuga marshes, which was read and referred to the committee on canals.

Messrs. Schell and Spinola presented remonstrances of shipping agents and ship owners of New York, against increase in rates of wharfage, which were read and committed to the committee of the whole.

Mr. Hubbell presented a petition of citizens of Utica, for the passage of the Assembly bill to pay certain moneys to George Cessford, which was read and committed to the committee of the whole.

Mr. Scott presented a remonstrance of inhabitants of Galway, Saratoga county, against the proposed law for constructing a free bridge across the Hudson river, at Luzerne, which was read and referred to the committee on roads and bridges.

Also a petition of inhabitants of Northampton, Fulton county, for aid to the Troy University, which was read and referred to the committee on literature.

Messrs. Mather, Spinola and Schell, severally, presented remonstrances from merchants and others, of New York, against increase in rates of wharfage, which were read and committed to the committee of the whole.

Mr. Boardman presented a petition of firemen of Penn Yan, in favor of the passage of bills now before the Legislature to exempt firemen from taxation to the amount of $500, which was read and referred to the committee on the incorporation of cities and villages.

Mr. Williams presented a petition of inhabitants of Macedon Centre, in favor of a personal liberty bill, which was read and referred to the committee on the judiciary.

Mr. W. A. Wheeler presented a petition of A. B. James and others, relative to right of suffrage for colored persons, which was read and referred to the committee on the judiciary.

Mr. Brandreth presented a memorial of the heirs of the late James Raymond, for the incorporation of the Raymond Collegiate Institute, at Carmel, which was read and committed to the committee of the whole.

On motion of Mr. Brandreth, and by unanimous consent, Resolved, That the bill entitled "An act to incorporate the Raymond Collegiate Institute," be referred to the committee on charitable and religious societies, with power to report complete.

Mr. Mather offered the following resolution:

Resolved, That 1,000 extra copies of the report of the State Engineer and Surveyor, on the canals of the State, be printed, one half for the use of the Canal Committee and one half for the Senate; also 500 copies of the annual report of the Superintendent of Public Instructions, for the use of that officer.

Ordered, That said resolution be referred to the committee on public printing.

On motion of Mr. Spinola, and by unanimous consent,

Resolved, That the bill entitled "An act in relation to costs in actions upon notes given to Mutual Insurance companies," be recommitted to the committee on the judiciary, with power to report complete.

Mr. Foote, from the committee on banks, to which was referred the bill entitled "An act to authorize the reduction of the capital stock of the Kingston Bank, of Kingston, Ulster county," with power to report complete, reported the same complete, which report was agreed to, and said bill ordered engrossed for a third reading.

Mr. Foote, from the committee on banks, to which was referred the Assembly bill entitled "An act to change the name and location of the Niagara River Bank," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ames from the committee on commerce and navigation, to which was referred the Assembly bill entitled "An act to incorporate the Union Navigation company," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the Assembly bill entitled "An act to provide for the organizatian and government of the police force of the city of Albany," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Prosser, from the committee on canals, to which was referred the proceedings of the Canal Board relative to reduction of canal tolls, reported in favor of the adoption of the following resolutions:

Resolved, (if the Assembly concur,) That the Legislature concur with the Canal Board in the reduction of tolls on the articles of property named in the resolution of that board, dated 2nd instant, when the same is transported on the canals of this State.

Resolved, (if the Assembly concur,) That the Legislature recommend that the Canal Board so adjust the rates of toll from time to time as to command the largest tonnage and revenue, and to this end that the Legislature consent that the said board may reduce the rate of toll on any and all articles now charged more than one mill per thousand pounds per mile, to any rate not less than one mill. Ordered, That said resolutions be laid on the table.

relation to the public health of the city of New York," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was referred the Assembly bill entitled "An act authorizing the Canal Board to determine the claim of George W. Bullard for the loss of his canal. boat," reported the same for the consideration of the Senate, which report was agreed to and said bill committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was referred the petition of Silas A. Dakin, for relief, reported a bill entitled "An act for the relief of Silas A. Dakin," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was referred the petition of Lewis Benedict for the appraisal of canal damages, reported a bill entitled "An act for the relief of Lewis Benedict for canal damages," which was read the first time, and by unanimous. consent was also read the second time, and committed to the committee of the whole.

Mr. Paterson moved that the committee on claims be discharged from the further consideration of the petition of Dewitt C. Parshall and John Young, for payment of canal damages.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative:

Mr. Williams, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act granting to the Otsego Lake turnpike company, all the rights and privileges which have been granted to and enjoyed by the Springfield turnpike company," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act for the more effectual draining of certain swamp and low land in the towns of Pine Plains and Stanford, in the county of Dutchess," with power to report complete, reported the same com

plete, with amendments, which report was agreed to and said bill ordered to a third reading.

Mr. Darling, from the committee on engrossed bills, reported as correctly engrossed, the bills entitled as follows:

"An act to change the names of James Bryant, Agnes Bryant and Carl Bryant."

“ 'An act to amend an act to provide against unsafe buildings in the city of New York, passed April 14, 1856."

"An act for the relief of the trustees of the Onondaga Academy." The Senate then resolved itself into a committee of the whole and proceeded to the consideration of the special calendar, being the bills entitled as follows:

"An act for the relief of I. Jewett White."

"An act in relation to the compensation of justices of sessions in the county of Westchester."

“An act in relation to the auditing of accounts of ministerial officers for certain services and expenses.'

And after some time spent therein, Mr. Halsted, from said committee, reported in favor of the passage of said bills, with amendments, which reports were agreed to, and said bills ordered engrossed for a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the special calendar, being the bills entitled as follows:

"An act to release to Aaron Remsen the title of this State, acquired by escheat, in and to certain lands, and to confirm his title thereto."

"An act authorizing the certificates of notaries public of other states and countries to be received in evidence with the same effect as the certificates of notaries public of this State."

Assembly bill, "An act to authorize the formation of companies for the recovery of stolen horses, cattle and sheep, and the apprehension of the thieves."

And after some time spent therein, Mr. Prosser, from said committee, reported in favor of the passage of said first and second mentioned bills, which reports were agreed to, and said bills ordered engrossed for a third reading.

Mr. Prosser, from said committee, reported in favor of the passage of the third mentioned bill, with amendments thereto, also amended the title, which report was agreed to, and said bill ordered to a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of .the special calendar, being the bills entitled as follows:

"An act to amend an act entitled 'An act to incorporate the Manhattan Savings Institution,' passed April 10, 1857.”

"An act to confirm the official acts of Albert A. Drake, as notary public."
