The Senate again met.

Mr. Burhans offered the following resolution:

Resolved, That the Assembly bill entitled "An act for the relief of Stephen H. Keeler;" also the Assembly bill "relating to a Law Library for the 6th Judicial district," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, two-thirds of all the members present voting in favor thereof.

On motion of Mr. Scott, and by unanimous consent,

Resolved, That Assembly bill No. 115, entitled "An act authorizing the election of trustees and other officers in the village of Fonda," be referred back to the committee on the incorporation of cities and villages, with power to report complete.

On motion of Mr. Scott, and by unanimous consent,

Resolved, That Assembly bill No. 8, entitled "An act in relation to all companies transacting the business of life insurance within this State, passed April 8, 1851,” be referred back to the committee on insurance companies, with power to report complete.

On motion of Mr. Laflin, and by unanimous consent,

Resolved, That the bill No. 244, amending the charter and changing the name of the Central Amenica, Commercial and Industrial company, passed April 16, 1858, be referred to the committtee on commerce and navigation, with power to report complete.

On motion of Mr. Laflin, and by unanimous consent,

Resolved, That the bill entilled "An act to change the name and location of the Niagara River Bank," be referred to the committee on banks, with power to report complete.

On motion of Mr. Halsted, and by unanimous consent,

Resolved, That the bill entitled "An act to legalize the election, classification and official acts of the trustees of the Lima Baptist church and society," be referred to the committee on charitable and religious societies, to report complete.

On motion of Mr. Spinola, and by unanimous consent,

Resolved, That the bill entitled "An act to incorporate the New York Railroad and Steamboat Accident Insurance company," be re

ferred back to the committee on the internal affairs of towns and counties, with power to report complete.

On motion of Mr. Pratt, and by unanimous consent,

Resolved, That the bill entitled "An act for the better preservation of the public records," be referred back to the joint library committee, with power to report complete.

On motion of Mr. Prosser, and by unanimous consent,

Resolved, That the Assembly bill entitled "An act to legalize the acts of George Talbot, as justice of the peace," be referred back to the committee on the judiciary, with power to report complete.

On motion of Mr. Prosser, and by unanimous consent,

Resolved, That the Assembly bill entitled "An act to authorize the construction of a breakwater along the shore of Lake Erie, within the bounds of the city of Buffalo, and to provide for the payment of the cost thereof," be referred back to the committee on commerce and navigation, with power to report complete.

Mr. Foote, from the committee on militia and public defence, to which was referred the bill entitled "An act to continue and extend❤ an act entitled 'An act to authorize the sale of the State Arsenals in New York and Albany, to provide for the purchase of the New York Arsenal property in New York by the city of New York, and for the appropriation of the proceeds of such sales, passed April 15, 1857, and to make certain appropriations," with power to report complete, reported the same complete, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Foote, from the committee on banks, to which was referred the Assembly bill entitled "An act in relation to the Bank Department," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

On motion of Mr. Smith, and by unanimous consent,

Resolved, That the Assembly bill entitled "An act authorizing Jonathan Preston to establish and continue a ferry across Deering's Harbor, from Greenport to Shelter Island," be referred to the committee on commerce and navigation, to report complete.

On motion of Mr. W. A. Wheeler, and by unanimous consent, Resolved, That the bill reported this morning, from the committee on the judiciary in relation to the publication of legal notices," be referred back to the committee, with power to report complete.

Mr. Foote, from the committee on banks, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to incorporate the Newburgh Savings Bank,' passed April 13, 1852," reported in favor of the passage of the same, with an amendment, which report was agreed to, and said bill committed to the committee of the whole.

On motion of Mr. J. A. Willard,

Resolved, That the bill entitled "An act to establish an Asylum in the village of Watertown, in the county of Jefferson, under the following title: 'The Home for Orphan and Destitute Children," " [SENATE JOURNAL.]

On motion of Mr. Williams, and by unanimous consent,

Resolved, That the bill entitled "An act to confirm the acts of the trustees and officers of the village of Lyons, who were elected on the 8th day of March, 1859," be referred to the committee on the incorporation of cities and villages, with power to report complete.

On motion of Mr. Loveland, and by unanimous consent, Resolved, That the bill entitled "An act to release the interest of the people of this State in certain lands in Essex county, which escheated on the death of Henry Quinn," &c., be recommitted to the committee on the judiciary, with power to report complete.

On motion of Mr. John D. Willard, and by unanimous consent, Resolved, That the Assembly bill entitled "An act to enlarge the bounds of the village of Fort Edward, make the same a separate road district, and conferring additional powers upon the trustees and taxable inhabitants of said village," be referred back to the committee on the incorporation of cities and villages, with power to report complete.

The Assembly bill entitled "An act for the relief of the Black River Steamboat company," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have passed the same, without amendment.

A message from the Assembly was received and read, requesting the concurrence of the Senate to the following entitled bill :

"An act authorizing the levying a tax to purchase or erect a town. house in the town of Lewiston, in Niagara county," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Lamont, and by unanimous consent, the rule was suspended, and said bill referred to the committee on the internal affairs of towns and counties, to report complete.

The Assembly bill entitled "An act to revive the powers of the Hedding Society of the First Methodist Episcopal church in the town of Van Etten, Chemung county," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the Assembly bill, entitled "An act to authorize the levying a tax to purchase or erect a town house, in the town of Lewiston, Niagara county," with power to report complete, reported the same complete, which report was agreed to, and said bill ordered to a third reading.

By unanimous consent, Mr. Schell moved that said bill do now have its third reading.
