The Assembly bill entitled "An act to authorize the construction of a breakwater along the shore of Lake Erie, within the bounds of the city of Buffalo, and to provide for the payment of the cost thereof," was read a third time.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the special order, being the bill entitled as follows:

"An act to protect the liberty of witnesses."

And after some time spent therein, Mr. Prosser, from said committee, reported progress on said bill, and asked and obtained leave to sit again.

Mr. John D. Willard moved that said bill be made the special order for Tuesday, at 12 o'clock.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

A message from the Assembly was received and read, informing that they had concurred in the passage of the bill entitled "An act making appropriations for the canal debt and the maintenance of the canals for the fiscal year commencing on the 1st day of October, 1859, and to supply a deficiency in a former appropriation," with the following amendment:

In line 4, subdivision 6, section 1, of engrossed bill, strike out the word "four," and insert in lieu thereof the word "three."

Mr. Prosser moved that the Senate concur in the amendment made by the Assembly.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendments.

On motion of Mr. Ely, and by unanimous consent,

Resolved, That the bill entitled "An act to incorporate the South Pacific American Mail Steamship company," be recommitted to the committee on commerce and navigation, with power to report complete.

On motion of Mr. Paterson, and by unanimous consent,

Resolved, That the Assembly bill entitled "An act to incorporate the Clarkson High School," be referred to the committee an literature, with power to report complete.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders.

After some time spent therein, the hour of 2 o'clock having arrived, the President resumed the chair and announced that under the rule, the Senate would take a recess until 7 o'clock.

The Senate again met.

On motion of Mr. Smith, the Senate took a recess for one hour.

The Senate again met.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, pending at the time of the recess, being the bills entitled as follows:

Assembly bill, "An act to establish a law library in the 6th judicial district, to be called 'The Supreme Court Library,' and for other purposes."

"An act to authorize the Canal Board to hear and investigate the claim of John McIntyre, for dredging the harbor of Whitehall." "An act to increase the powers and duties of public administrators."

And after some time spent therein, Mr. Smith, from said committee, reported in favor of the passage of said bills, with amend

ments, which reports were agreed to, and said bills ordered engrossed for a third reading.

The President appointed as the seclect committee of eight, to whom are referred the bills on the general orders, Messrs. Noxon, Mather, Sloan, John D. Willard, W. A. Wheeler, Foote, Williams and Halsted.

The President then announced the special order, being the bill entitled as follows:

"An act for ascertaining by proper proofs the citizens who are entitled to the right of suffrage, and to prevent fraudulent voting." Mr. Spinola moved that the consideration of said bill be indefinitely postponed.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of said bill.

And after some time spent therein, Mr. Ames, from said committee, reported progress on said bill, and asked and obtained leave to sit again.

Mr. Mather moved that the Senate adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

Mr. Ames moved that the bill entitled "An act to ascertain by proper proofs the citizens who are entitled to the right of suffrage, and to prevent illegal voting," be made the special order for Wednesday evening.

Mr. Spinola moved to amend by striking out "Wednesday" and inserting "Thursday."

The President put the question whether the Senate would agree to said amendment, and it was decided in the negative.

The President then put the question whether the Senate would agree to said motion of Mr. Ames, and it was decided in the affirmative.

Mr. Paterson, from the committee on claims, to which was referred the Assembly bill entitled "An act for the relief of Thomas F. Woodworth," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was referred the Assembly bill entitled "An act to stay proceedings in relation to claims on awards for the diversion of water from the Black River," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

On motion of Mr. Smith, the Senate adjourned.
