Mr. Brandreth moved to recommit the Assembly bill entitled "An act in relation to the Bank Department," to the committee on banks, with instructions to insert the first two sections of the bill which were stricken out by the committee on banks.

Mr. Paterson moved to recommit the Assembly bill entitled "An act in relation to the publication of legal notices," with instructions to make the first publication "sixty cents per folio, and subsequent publications twenty-five cents."

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

Mr. Noxon moved to recommit said bill to the committee on public printing, with instructions to substitute the Senate bill.

Pending the call on the above, the President directed the Clerk to call the roll; when the following Senators answered to their

When the name of Mr. Lamont was called on the question of the passage of the above bill, Mr. Paterson objected, as Mr. Lamont was not within the bar of the Senate when the question was stated. The President decided that Mr. Lamont could not vote.

From this decision Mr. Spinola appealed.

When the name of Mr. Wetmore was called, that gentleman asked to be excused from voting.

Mr. Diven, from the committee on finance, to which was recommitted the bill entitled "An act to submit to the people a law authorising a loan of $3,000,000, to provide for the payment of the floating debt of the State," with power to report complete, reported that they had substituted in lieu thereof a bill entitled "An act to submit to the people a law authorizing a loan of $2,500,000, to provide for the payment of the floating debt of the State," and in favor of the passage of the same, with amendments, which report was agreed to, and said bill ordered engrossed for a third reading.

A message was received from His Excellency the Governor, in the words following:
