On motion of Mr. O. B. Wheeler,

Resolved, That the Auditor of the Canal Department be requested to report to the Senate a statement showing at what period the accumulation of the Sinking Fund, under section one, of article seven of the Constitution, will liquidate the "canal stock debt" of this State, with a surplus of $1,700,000, at the close of each fiscal year; and at what periods the said liquidation will be accomplished with an annual surplus of one million of dollars.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to enable the supervisor of Lowville, the President of the board of trustees of Lowville Academy, and the town clerk of the town of Lowville, to take and hold title to certain premises in Lowville, upon trust."

"An act in relation to courts of special sessions, courts of sessions, and police courts

"An act to authorize the adjustment of certain claims and their application upon a debt held by the State against the Bank of Orleans."

And after some time spent therein, Mr. Ely, from said committee, reported in favor of the passage of said first mentioned bill with amendments, which report was agreed to, and said bill ordered engrossed for a third reading.

Mr. Ely, from said committee, reported in favor of the passage of said second mentioned bill, without amendment, which report was agreed to, and said bill ordered engrossed for a third reading.

Mr. Ely, from said committee, reported progress on said third mentioned bill, and asked and obtained leave to sit again.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to incorporate the German Savings Bank, in the city of New York."

"An act for the relief of Lewis Clement."

"An act to amend an act entitled 'An act to incorporate the village of Warsaw,' passed April 17th, 1843."

And after some time spent thereon, Mr. O. B. Wheeler, from said committee, reported in favor of the passage of said bills, with amendments, which report was agreed to, and said bills ordered engrossed for a third reading.

A message from the Assembly was received and read, requesting the concurrence of the Senate to the following entitled bill:

66 'An act in relation to the town meeting in the town of Cicero, in the county of Onondaga," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties. On motion of Mr. Darling, the Senate adjourned.

The Senate met pursuant to adjournment.

Prayer by Rev. Mr. Cheeseman.

The journal of yesterday, was read and approved.

Mr. Johnson presented a petition of citizens of the county of Albany, for aid to the Troy University, which was read and referred to the committee on literature.

Mr. Johnson presented the petition of Albert G. Sage, contractor for lock No. 2, enlargement Erie canal, for relief, which was read and referred to the committee on canals.

Mr Mather presented a petition of E. L. Fancher, and others, for an appropriation for the N. Y. State Inebriate asylum, which was read and referred to the select committee on that subject.

Mr. Ames presented a petition of John V. Cole, and others, for removal of the Quarantine, which was read and referred to the committee on commerce and navigation.

Mr. Boardman presented a petition of citizens of Seneca county, for repeal of the act passed April 7, 1857, for preservation of trout in the inland waters of this State, which was read and referred to to the committee on the internal affairs of towns and counties.

Mr. Boardman presented a petition of veterans of the war of 1812, for an act to amend the law passed April 15, 1857, so as to require the commissioner to certify immediately on all claims presented and audited, which was read and referred to the committee on militia and public defence.

Mr. Diven, from the committee on the judiciary, to which was referred the bill entitled "An act to increase the powers and duties of public administrators," reported the same for the consideration of the Senate, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Hubbell, from the committee on insurance companies, to which was referred the petition of receiver of the Farmers' Insurance company, for relief, reported a bill entitled "An act for the relief of the receiver of the Farmers' Insurance Company of Oneida county," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Diven, from a majority of the committee on the judiciary, to whom was referred the petition of Josiah Blackwell, asking to be refunded certain moneys expended by him, reported the following resolution:

Resolved, That the judiciary committee be discharged from the further consideration thereof, and that the same be referred to the committee on claims.

The President put the question whether the Senate would agree to said resolution, and it was decided in the negative.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the Assembly bill, entitled "An act in relation to the town meeting in the town of Cicero, in the county of Onondaga," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act to amend an act revising, amending and consolidating the several acts in relation to the village of Kingston, passed April 10, 1854," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the Assembly bill entitled “An act to amend an act, entitled 'An act to revise, amend and consolidate the several acts relating to the village of Whitesboro'" reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill entitled "An act to change the name of the Cypress Hill plankroad company to the Macademized road company,' reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Darling, from the committee on engrossed bills, reported as correctly engrossed, the bills entitled as follows:

"An act to enable the supervisor of Lowville, the President of the board of trustees of Lowville academy, and the town clerk of the town of Lowville, to take and hold title to certain premises in Lowville, upon trust."

Mr. Boardman gave notice that he would, at an early day, ask leave to introduce a bill entitled "An act in relation to Waterloo Union school districts, Nos. 1 and 15.”

Mr. Prosser gave notice that he would, at an early day, ask leave to introduce a bill, entitled "An act to amend the charter of the University of Buffalo, and to authorise it to establish and maintain an academical school."

Mr. Ames gave notice that he would, at an early day, ask leave to introduce a bill entitled "An act to prevent the issue of false receipts and bills of lading, and to punish fraudulent transfers of property by warehousemen, ship owners, carriers and others."

In pursuance of previous notice, Mr. J. A. Willard, for Mr. W. A. Wheeler, asked and obtained leave to introduce a bill entitled 66 'An act exempting the firemen of the village of Malone, in the county of Franklin, from serving on juries and in the militia, and from poll taxes," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

In pursuance of previous notice, Mr. J. A. Willard for Mr. W. A. Wheeler asked and obtained leave to introduce a bill entitled "An act to make valid the proceedings before Edgar A. Keeler, a justice of the peace in the town of Chateaugay, in the county of Franklin," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. Foote asked and obtained leave to introduce a bill, entitled "An act requiring county treasurers to file in the county clerk's office, a report of the moneys and securities in their hands, belonging to infants," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. Foote asked and obtained leave to introduce a bill entitled "An act in relation to certain commissioners appointed by an act passed April 15, 1857, for the adjustment of claims of soldiers of the war of 1812," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on militia and public defence.

In pursuance of previous notice, Mr. W. A. Wheeler, asked and obtained leave to introduce a bill entitled "An act to confirm the proceedings of the board of supervisors of the county of Franklin, in the erection of the town of Brighton, in said county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

In pursuance of previous notice, Mr. Diven asked and obtained leave to introduce a bill, entitled "An act to incorporate the Elmira Water Company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

The bill entitled "An act in relation to courts of special sessions, courts of sessions, and police courts," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

On motion of Mr. Halsted,

Resolved, That the question on agreeing to the report of the judiciary committee cn the Assembly bill entitled "An act to change the name of Clarissa Sadler to Clarissa Woodford," be reconsidered, and that said bill be recommitted to the judiciary committee.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to authorize the adjustment of certain claims and their application upon a debt held by the State against the Bank of Orleans."

"An act for the payment of certain moneys to the Ingham University."

"An act to amend an act, entitled 'An act to facilitate the formation of Agricultural and Horticultural Societies,' passed April 13, 1855."

And after some time spent therein, Mr. Brandreth, from said committee, reported progress on said first mentioned bill, and asked and obtained leave to sit again.
