Railroad, but have not so far been able to get rates that would enable me to ship over said road so as to compete with clay at other points. This company charges $5 per car loaded with tan-bark, staves, lumber, ties, etc., etc. Would they, therefore, have the right to charge more for car loaded with clay? I get clay shipped over the C. & O. Railroad, 45 miles, for 50 cents per ton, or about $11.50 per car load. The distance I wish to ship over the Portsmouth and Tygart Valley road being only 3 to 6 miles. If I can get the $5 rate on the clay per car load, it would enable me to ship 1,000 to 3,000 tons of clay over that line next year. Please advise me at once on this matter, as I am now contracting clay for next year and want to know what I can do on that road, as the most of my clay must come over that line or be hauled in wagons three miles, and this takes off all the profits. The Commission having considered this complaint, addressed the following letter to said company: OFFICE OF RAILROAD COMMISSIONERS OF KENTUCKY, FRANKFORT, KY., November 30th, 1895. MR. T. W. KINNEY, General Superintendent Portsmouth and Tygart Valley Railroad, Brinegar, Kentucky: DEAR SIR: Mr. L. D. O'Roark, of Enterprise, Kentucky, has made complaint to the Railroad Commission that your company exacts, or proposes to exact, a charge of fifty cents per ton for transporting fire clay a distance of three miles over your line. I am directed by the Commission to say to you that it is their judgment that this is an unreasonable charge, which is unwarrantable under the law, and that they have advised complainant to tender you twenty cents per ton as a reasonable compensation for such service, and will sustain him in any further action that may be necessary to reach the market with his fire clay upon these terms. The Commission make the following recommendations of legislation : That an act be passed prohibiting companies, associations and corporations of other States and countries from carrying either persons or property upon or over railways in this State, from one point or place in this State to another point or place in this State, until they have become corporations, citizens and residents of this State. That the law make it clear that the Railroad Commission shall, or shall not, assess all inter-state bridges over which railroad trains are moved. That the law with reference to furnishing information as to the boundaries of common school districts, for railroad assessments, be so amended as to put the entire responsibility of same upon the railroad companies. That an act be passed limiting the rates which may be charged for carrying coal in this State. That an act be passed to facilitate the adjustment of overcharges by allowing the shipper to recover double the amount of the overcharge, a reasonable attorney's fee and costs. That carriers in this State be required to equip all their cars with automatic couplers and continuous brakes and their locomotives with driving-wheel brakes.
