The Assembly sent for concurrence the bill (No. 465, Rec. No. 21) entitled "An act to amend chapter three hundred and nineteen of the Laws of nineteen hundred and three, entitled 'An act to make the office of the sheriff of Herkimer county a salaried office, and to regulate the management of said office,' in relation to the compensation of deputies and undersheriff for attendance at court as court officers," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Kasson, and by unanimous consent, said bill was substituted for Senate bill (No. 105, Int. No. 105), now on the order of third reading.

Also, a bill (No. 382, Rec. No. 22) entitled "An act to amend the General City Law, in relation to appropriations for pension funds," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Mullan, and by unanimous consent, said bill was substituted for Senate bill (No. 253, Int. No. 251), now on the order of third reading.

Mr. Lockwood, from the committee on public education, to which was referred, the Senate bill introduced by Mr. Lockwood (No. 396, Int. No. 384) entitled "An act to amend the Education Law, relative to the powers of the Regents of the University," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole. Mr. Lockwood, from the committee on public instruction, to which was referred the Senate bill introduced by Mr. Lockwood (No. 390, Int. No. 378) entitled "An act to amend the Education Law, relative to the qualifications of teachers in primary and grammar schools," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. G. L. Thompson, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Ferris (No. 440, Int. No. 414) entitled "An act to amend the Conservation Law, in relation to licenses for raising and selling Japanese deer," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Yelverton, from the committee on military affairs, to which was referred the Senate bill introduced by Mr. Towner (No. 307, Int. No. 23) entitled "An act to amend the Military Law, in relation to paying back to the State treasury certain moneys standing to the credit of military organizations disbanded pursuant to law; in relation to compensation to employees in certain armories; and in relation to emergency expenditures in armories," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Walters moved a call of the Senate.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

By direction of the President, the Clerk called the roll, when the following Senators responded:

The Clerk furnished a list of the absentees to the sergeant-atarms, who appeared in due time before the bar of the Senate with Messrs. Lockwood, Baumes, Lowman, Downing, Boylan, Abeles, Ramsperger, Lusk, Davenport, Walker, Lynch, Karle, Carson, Black, Sutherland, Downing and Kelly, each of whom was excused.

Mr. Walters moved that all further proceedings under the call of the Senate be suspended.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Assembly bill (No. 378, Rec. No. 11) entitled "An act making an appropriation for the expenses of the State Comptroller in administering the provisions of chapter six hundred and twenty-seven of the Laws of nineteen hundred and nineteen, entitled 'An act to amend the Tax Law, in relation to imposing taxes upon and with respect to incomes,' was read the third time. The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three
