Mr. G. F. Thompson introduced a bill (Int. No. 234) entitled "An act to provide for a State milk commission, as a State health measure, which shall have control of the production, transportation, manufacture, storage, distribution and sale of milk and the product thereof, and the fixing of the price to be charged for milk in the State of New York by the producer, the middleman, and the retail seller," which was read the first time, and by unanimous consent was also read the second time.

Mr. Walters asked unanimous consent that said bill be referred to the committee on agriculture.

Mr. Walker objected.

Mr. Walters introduced a bill (Int. No. 235) entitled "An act to amend the General Municipal Law, in relation to registry of municipal bonds," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Also, a bill (Int. No. 236) entitled "An act to amend the Education Law, in relation to apportionment of school moneys,"

which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public education.

Also, a bill (Int. No. 237) entitled "An act to amend the County Law, in relation to the salaries of the county judge and surrogate of Onondaga county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

No. 239) entitled "An act to amend chapter six hundred and eighty-six of the Laws of eighteen hundred and ninety-nine, entitled 'An act to authorize the board of estimate and apportionment of the city of New York to provide for the payment of the services rendered to the said city after annexation by the volunteer firemen of that portion of Westchester county annexed to the city of New York by chapter nine hundred and thirty-four of the Laws of eighteen hundred and ninety-five,' in relation to compensation of volunteer firemen," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Karle introduced a bill (Int. No. 240) entitled "An act to empower the city of New York to widen Kills path, a highway situate in the boroughs of Brooklyn and Queens, in said city, by acquiring through purchase or condemnation the lands of the various cemetery corporations or of others, abutting along said highway, from Jamaica avenue in the borough of Brooklyn to Myrtle avenue in the borough of Queens," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Knight introduced a bill (Int. No. 241) entitled "An act to amend the County Law, in relation to compensation of super

visors of Allegany county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (Int. No. 242) entitled "An act to amend chapter five hundred and sixty-four of the Laws of nineteen hundred and ten, entitled 'An act to provide for county roads in certain counties,' in relation to such roads in villages," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Mr. Walters moved that the Senate do now adjourn.

Mr. Baumes introduced a bill (Int. No. 244) entitled "An act to amend chapter one hundred and seventy-five of the Laws of eighteen hundred and seventy-three, entitled 'An act to amend the charter of the Missionary Society of the Methodist Episcopal Church,' now called the Board of Foreign Missions of the Methodist Episcopal Church, in relation to the election of officers," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Law introduced a bill (Int. No. 245) entitled "An act to amend the Election Law, in relation to party conventions and

nominations, official primaries," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Kasson introduced a bill (Int. No. 246) entitled "An act to amend the charter of the city of Gloversville, generally," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Burlingame introduced a bill (Int. No. 247) entitled "An act otamend chapter four hundred and thirty-eight of the Laws of eighteen hundred and ninety-seven, entitled 'An act regulating the appointment of assistant district attorneys for the county of Kings,' in relation to the appointment of additional assistant district attorneys," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways. Also, a bill (Int. Mr. Black introduced a bill (Int. No. 249) entitled "An act to amend chapter seven hundred and six of the Laws of nineteen hundred and one, entitled 'An act to make the office of register of the county of Kings a salaried office and regulating the management of said office,' in relation to compensation to be paid to the register after the close of his term of office," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Mr. Ferris introduced a bill (Int. No. 250) entitled "An act making an appropriation for highway improvement purposes, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance. Mr. Walker offered the following:

Whereas, The Eighteenth Amendment to the Federal Constitution vests in the State power concurrent with that of the Congress to enforce by appropriate legislation the provisions of such amendment;

Whereas, It thus becomes the duty of the Legislature to pro

vide appropriate legislation as contemplated by such amendment and certain measures purporting to effect such enforcement have already been introduced;

Whereas, There exists a serious and extensive conflict and diversity of opinion concerning the scope and applicability of the phrase "intoxicating liquors," as used in such amendment; and

Whereas, It is impossible to enact appropriate legislation to carry out the purposes of such amendment, or to consider, discuss or pass upon such legislation, unless the Legislature have reliable, competent and scientific advice establishing the amount of alcohol necessary to render a beverage intoxicating; therefore, be it

Resolved (if the Assembly concur), That a joint committee of the Legislature, consisting of three members of the Senate, to be appointed by the President of the Senate, and five members of the Assembly, to be appointed by the Speaker of the Assembly, is hereby constituted for the purpose of investigating and considering such questions and particularly the question of the amount of alcohol necessary to render a beverage intoxicating; that such committee be authorized to sit in the city of Albany or the city of New York in its discretion; that it e authorized to subpoena and compel the attendance of witnesses and production of books and papers, including public records and documents; to administer oaths, take proof and testimony, employ counsel, expert witnesses, and a stenographer, and that such committee have all the powers usual or incident to legislative committees, although such powers be not specifically herein set forth. Be it further

Resolved, That such committee report its conclusions to this session of the Legislature on or before the 1st day of March, 1920. Be it further

Resolved. That the actual and necessary expenses of such cornmittee in carrying out the provisions of this resolution, not exceeding the sum of ten thousand dollars ($10,000), be paid from the moneys appropriated for the contingent expenses of the Legislature by the Treasurer on the warrant of the Comptroller and the certificate of the chairman of the committee.

Ordered, That said resolution be referred to the committee on finance.

Mr. Walker moved that the Senate do now adjourn until 10 A. M. Friday.
