Also, Senate bill introduced by Mr. T. D. Sullivan (No. 1352, Rec. No. 260), entitled "An act to amend the Greater New York charter, in relation to the powers of the police department to permit the giving of entertainments in certain places," reported in favor of the passage of the same without amendment, and that the same be made special orders on second and third reading immediately after the consideration of the special orders on third reading heretofore reported; which report was agreed to, and said bills ordered made special orders on second and third reading immediately after the consideration of the special orders on third reading heretofore reported.

Mr. Speaker, from the committee on rules, to which was referred the bill introduced by Mr. W. R. Herrick (No. 366, Int. No. 359), entitled "An act to amend the Civil Service Law, in relation to certification of pay-rolls," reported in favor of the passage of the same, with the following amendments:

Strike out on page 2, line 13, beginning with the word "and" down to and including the word "account" on page 2, line 16, also strike out on page 2, line 17, the word " "and insert on page 2, line 23, after the word "certificate" the following in italics:

"If the State Civil Service Commission or any municipal civil service commission shall find that any person has been transferred, assigned to perform duties or reinstated in violation of any provision of the Civil Service Law or of the rules adopted thereunder, it shall so notify the Comptroller or other fiscal officer of the State or of the appropriate civil division or city thereof and thereafter such officer shall not draw, sign or issue or authorize the drawing, signing or issuing of any warrant on the treasurer or other disbursing officer for the payment of salary or compensation to any such person. Any such person may maintain a proceeding by mandamus to compel the payment of salary or compensation so withheld, if lawfully entitled thereto." [ASSEMBLY Journal.] 285
