In 1898 Professor Jeremiah Smith published a short collection of “Cases on Selected Topics in the Law of Municipal Corporations," with special reference to the wants of his classes, where the time allotted for the subject did not exceed ten lectures. The growing importance of the subject has made it wise to increase the time devoted to study of the subject in many schools, and the time now commonly allotted to it is from thirty to forty lectures. This has made it desirable to prepare a case-book to cover the subject more fully than was possible in Professor Smith's book, and the task of preparation has fallen on the present editor.
The cases in the earlier book were so admirably selected that it would have been folly to make a new selection. Professor Smith placed them all at the service of the present editor, but preferred that his own name should not appear on the title-page. This collection, therefore, which ought to appear as a second edition of his book, or at least as a joint production, must purport to be the work of the undersigned; who takes occasion here to say, that of the 678 pages of cases here collected, 260 are taken without cbange, or with unimportant changes of arrangement, from the earlier collection, and to express his indebtedness for that fact, and for the even greater assistance he has derived from Professor Smith's learning and interest in the subject.
