DEAR SIR.—I regret to have to report that there has been no work done, nor any progress made during the past year, in the matter of the Cornwall Branch Railway.

STEPHEN M. NEWTON, Chairman Executive Committee of Board of Directors, and also acting Superintendent of operations of the Dunkirk, Warren and Pittsburgh Railway Company, being sworn, deposes and says that the statements in the annexed report, which has been signed by him at the end thereof, are true and correct according to the best of his knowledge, information and belief; and deponent further saith that other than the signing of the mortgage bonds, the executive committee have control of the securities of the company and have directed the payments thereof, and this is the reason this affidavit is made by the undersigned; and deponent further saith that the Dunkirk, Warren and Pittsburgh Railroad Company was consolidated with the Conewango Valley Railroad Company of Pennsylvania by articles of consolidation duly filed in the office of the Secretary of State of the State of New York, on the 14th day of May, 1870, under the name of the Dunkirk, Warren and Pittsburgh Railway Company, and that previous to the date of such consolidation there had been no material change since the report for the year 1869 other than a small increase of current expenses.

*The amount of stock subscribed includes town stock, for which writs of mandamus have been served, claimed by company under acts of April, 1867 and 1870, and stock going to contractor in part payment as fast as he earns it. Additional estimates of stock and bonds had become due contractor October 1, for work, iron rails, and laying seven miles of track, but not adjusted at that date, work progressing favorably and entire road to be completed in August, 1871.

+ A new contract has been let to finish and equip entire road for a gross sum; the old contract settled up. The items cannot well be separated until contract is completed.

Of which about forty-two miles is in New York.

Track laying was commenced before October 1, but no estimate had been made at that time.
