On motion of Mr. Baumes, and by unanimous consent, said bill was substituted for Senate bill (No. 1672, Int. No. 388) now in the committee of the whole.

Also, a bill (No. 1674, Rec. No. 374) entitled "An act to amend the Penal Law, in relation to receiving stolen property," which was read the first time, and by unanimous consent was also read the second time.

Also, a bill (No. 1804, Rec. No. 375) entitled "An act to legalize the acts and proceedings of the board of education of union free school district number one, of Haverstraw, in the county of Rockland, with respect to the contract for material furnished and labor performed by W. H. Straut Company, Incorporated, in the repair of the school building during the year nineteen hundred and twenty-seven, and authorizing the payment of the claim therefor from school moneys available or from proceeds of temporary certificates of indebtedness to be included in the next annual tax levy," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Also, a bill (No. 1540, Rec. No. 376) entitled "An act to amend chapter six hundred and sixty-seven of the Laws of nineteen hundred and ten, entitled 'An act to amend, revise and consolidate the charter of the village of Ossining,' in relation to drains," which was read first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of villages.

Also, a bill (No. 1683, Rec. No. 377) entitled "An act to amend the New York City Municipal Court Code, in relation to change of boundaries of the seventh district in the borough of Manhattan, and providing for an additional justice in said borough, and for additional justices in said districts," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on codes.

Also, a bill (No. 1011, Rec. No. 378) entitled "An act making an appropriation for the purchase of land for park purposes by the Erie County Park Commission," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Hewitt, and by unanimous consent, said bill was substituted for Senate bill (No. 660, Int. No. 622) now in the committee of the whole.

Also, a bill (No. 1653, Rec. No. 379) entitled "An act to appropriate the miscellaneous receipts on account of the improvement of the Erie, Champlain and Oswego canals, under chapter one hundred and forty-seven of the Laws of nineteen hundred and three, and acts amendatory thereof and supplemental thereto, for the purpose of said improvement," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Hewitt, and by unanimous consent, said bill was substituted for Senate bill (No. 1263, Int. No. 1107) now on the order of third reading.

Also, a bill (No. 1734, Rec. No. 380) entitled "An act to amend the Banking Law, in relation to loans secured by a sale, assignment or order for the payment or delivery of compensation for service," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Baumes, and by unanmious consent, said bill was substituted for Senate bill (No. 1260, Int. No. 1104) now in the committee of the whole.

Also, a bill (No. 1304, Rec. No. 381) entitled "An act to amend the charter of the city of Schenectady, in relation to city taxes," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Brown, and by unanimous consent, said bill was substituted for Senate bill (No. 959, Int. No. 869) now on the order of third reading.

Also, a bill (No. 1799, Rec. No. 382) entitled "An act to amend the Agriculture and Markets Law, in relation to the sale of farm produce on commission," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on agriculture.

Also, a bill (No. 1913, Rec. No. 383) entitled "An act to amend the Prison Law, in relation to death or disability benefits," which was read the first time, and by unanimous consent was also read the second time.

The Assembly returned the Assembly bill (No. 72, Senate reprint No. 1438, Rec. No. 29) entitled "An act to amend the State Law to conform to the State Departments Law, in relation to lands to be acquired for public defense," with a message that it has concurred in the amendments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly.

The Assembly returned the Assembly bill (No. 744, Senate reprint No. 1398, Rec. No. 192) entitled "An act to amend the Agriculture and Markets Law, in relation to the marking of celery containers," with a message that it has concurred in the amendments of the Senate thereto.

The Assembly returned the Assembly bill (No. 989, Senate reprint No. 1465, Rec. No. 147) entitled "An act to amend the New York City Court Act, in relation to its jurisdiction, mandates and venue," with a message that it has concurred in the amendments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly.

The Assembly returned the Assembly bill NNo. 831, Senate reprint No. 1439, Rec. No. 125) entitled "An act to provide for a supplement to the statutory record of the unconsolidated laws, to

be printed as a volume of the Session Laws of nineteen hundred and twenty-eight," with a message that it has concurred in the amendments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly.

The Assembly sent for concurrence a resolution in the words following:

Resolved (if the Senate concur), That a respectful message be sent to the Governor requesting the return to the Assembly of Assembly bill (No. 1182, Rec. No. 160) entitled "An act to amend the Public Buildings Law to conform to the State Depatrments Law, in relation to fine arts, and repealing certain section of article three-b relating to the bureau of fine arts," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution and it was determined in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly with the message that the Senate has concurred in the passage of the same.

The Assembly returned the resolution by Mr. Dick authorizing the printing of five thousand extra copies of the report of the Commission to investigate defects in the Laws of estates, with a message they have concurred in the passage of the same.

No. 1246) entitled "An act to amend chapter one hundred and ninety-two of the Laws of nineteen hundred and twenty-five, entitled 'An act to create the Albany port district, to provide for the appointment of the Albany port commission, and to define its powers, duties and jurisdiction, and making an appropriation for expenses incident thereto,' as amended by chapter five hundred and twentythree of the Laws of nineteen hundred and twenty-seven, reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.
