they fhall be paid, One Half to the Informer, and the other Half to the Collector of the Land Tax of fuch County or Stewartry, wherein the faid Default fhall be committed, to be by him applied in Aid of the Expenditure incurred by reafon of this Act.

SCHEDULE.

QUESTIONS to which, by Directions of an Act paffed in the Fifty firft Year of the Reign of His Majefty King George the Third, intituled, An Ad for taking an Account of the Population of Great Britain, and of the Increafe or Diminution thereof, written Anfwers are to be returned by the Rector, Vicar, Curate or Officiating Minifter, and Overfeers of the Poor, or by fome other fubftantial Houfe holder of every Parish, Township and Place (including thofe Places alfo which are Extra parochial) in England; and by the Schoolmasters or other Perfons to be appointed under the faid Act for every Parish and Place in Scotland; figned by them refpectively, and attefted upon Oath or Affirmation by the faid Overfeers, or by such other substantial Householders as aforefaid, in England, and by the Schoolmasters or other fuch Perfons as aforefaid in Scotland. QUESTIONS addreffed to the OVERSEERS in England; and to the SCHOOLMASTERS in Scotland: Who are refpectively required to take an Account of the Refident Population by proceeding from Houfe to Houfe on the Twenty feventh Day of May One thoufand eight hundred and eleven, and on the Days immediately fubfequent thereto, if one Day fhall not be fufficient; and they are alfo required to fpecify in Writing the Name of the Parish or Place in the Schedule, and whether it be ufually called a Parish, Townfhip, Tything, Quarter, or by what other Denomination. ift. 2d. How many Houfes are now building, and therefore not yet
inhabited?

3d. How many other Houfes are uninhabited?
4th. What Number of Families in your Parish, Township or
Place, are chiefly employed in and maintained by Agricul-
ture; how many Families are chiefly employed in and main-
tained by Trade, Manufacture or Handicraft; and how
many Families are not comprized in either of the Two
preceding Claffes?

N. B. The total Number of Families in anfwer to
this Queftion must correfpond with the Number of
Families in anfwer to the 1st Question.

5th. How many Perfons (including Children of whatever Age)
are there actually found within the Limits of

X. Provided always, and be it further enacted, That, whenever Transportation any Sentence of Tranfportation paffed by any Court Martial holden in the East Indies, or in His Majesty's Settlements of the Cape of Good Hope or Ceylon, or in any Settlements occupied by His Majefty's Forces beyond the Cape of Good Hope, is to be carried into Execution, or Mercy fhall be extended to any Offender liable to the Punishment of Death by the Sentence of any Court Martial in the Eaft Indies, upon Condition of Tranfportation, the fame fhall be notified in Whiting by the Commander in Chief of His Majefly's Forces in India, or, in the Abfence of the Commander in Chief, then by the Adjutant General for the time being to fome Judge of One of the Supreme Courts of Judicature of the Prefidencies of Fort William, Fort Saint George or Bombay, or the Chief Justice or other Judge at the Island of Ceylon or the Cape of Good Hope, or any fuch Order for Trans- other Settlement as aforefaid; and thereupon fuch Judge fhall make portation. an Order for the Tranfportation of fuch Offender, upon the Terms and for the Time which fhall be fpecified in fuch Notification, and fhall alfo make fuch other Order or Orders, and do all fuch other Acts co fequent upon the fame as any fuch Judge is authorized to make or do under an Act paffed in a Parliament holden in the Thirty ninth and Fortieth Years of His Majefty's Reign, intituled, An A for eftablishing further Regulations for the Government of the British Territories in India, and the better Adminiflration of Justice within the fame, with respect to Offenders ordered to be tranfported by Sentence of the Criminal Courts in India, and the Governor and Council of fuch Prefidency refpectively fhall and they are hereby required to take Order for the Tranfportation of all fuch Offenders accordingly.

XVII. And be it further enacted, That no Officer, Non-commiffioned Officer or Soldier who fhall be arrested and committed to Prifon upon a Charge of any Criminal Offence, fhall receive any Part of his Pay from the Day of fuch Commitment till the Day of his fence, acquitted, Return to the Regiment, Troop or Company to which he hall belong, provided that if he fhall be acquitted of the Offence for which he was committed, he fhall upon his Return to his Corps be entitled to receive all Arrears of Pay which were growing due during the Time of his Confinement; but if he fhall be convicted, he shall forfeit all Right to any Pay from the Day of his Commitment during the Time of his Confinement, as well under the original Commitment as under any Commitment confequent upon fuch Conviction, and until the Day of his Return to the Regiment, Troop or Company to which he fhall belong: Provided always, that it thall be lawful for the Secretary at War for the time being, to order the Iffue and Payment to any fuch Officer, Non-commiffioned Officer or Soldier, during any fuch Commitment or Imprifonment, or either of them, or any Part thereof, of the Pay of any fuch Officer, Noncommiffioned Officer or Soldier, or of any Proportion of fuch Pay, or of any Arrears thercof, either during fuch Commitment or Imprifonment, or after the Difcharge of fuch Officer, Non-commiflioned Officer or Soldier after Conviction or otherwife, as fhall appear to the Secretary at War to be proper, and the Order of the Scretary at War for the Payment of fuch Pay or Arrears, fhall be a fuffiçient Discharge for fuch Payment.
