and may be fued and profecuted in the name of his Majefty, his heirs or fucceffors, by and with the confent of his Majesty's attorney general in England, or advocate general in Scotland; and all actions, fuits, or informations, fued or profecuted for any penalty forfeited by virtue of this or the faid recited act, shall and may be fued and profecuted in the name of his Majefty, his heirs or fucceffors, or in the name of his Majefty's faid attorney general, or advocate general, refpectively, or by any person who shall profecute or fue for the fame, in the manner in the faid recited act directed: provided, That all actions, fuits, or informations, fued or profecuted in the name of any fuch farmer or farmers, fhall be held and deemed to be popular actions, fuits, or informations, respectively, to all intents and purposes whatsoever.

XII. And be it further enacted by the authority aforefaid, That it fhall and may be lawful for any person or perfons farming the faid rates and duties as aforefaid, to have and use the like remedies for the recovery thereof, against the perfons appointed to receive the fame, by extent or otherwife, which may as for duties be had or used for any duties payable directly to the King's mapayable to his jefty.

And, in order to prevent difputes concerning the faid bereinbefore recited duties, in cafes where the fame may be collected in one diftritt, divifion, or collection, and the tickets may be delivered in a different diftrict, divifion, or collection; be it further enacted, That the faid duties fhall belong, and the tickets iffued thereupon fhall be returned and accounted for to the perfon or perfons refpectively who shall be the farmer or farmers of the feveral duties arifing within the district, divifion, or collection where fuch tickets fhall have iffued, and where the poftmafters, innkeepers, or other licensed persons iffuing the fame thall refide; and the gatekeepers at whofe gates fuch tickets fhall be delivered, fhall return the fame to the farmer of the rates and duties from whose district fuch ticket shall have iffued, at the time and in the manner the fame are directed to be returned to the feveral collectors by the said recited act.

XIV. XVI. XVII. HEREAS by an act made and passed in the fixth year of Preamble, the reign of his prefent Majefty, intituled, An act for reciting opening, and establishing certain ports in the island of Jamaica and Dominica; for the more free importation and exportation of certain goods and merchandizes; for granting certain duties to defray the expences of opening, maintaining, fecuring, and imVOL. III. larly mentioned and provided in an act of parliament, made in the twelfth year of the reign of King Charles the Second, intituled, An act for the encouraging and encreasing of shipping and navigation; and in another act of parliament, made in the twentyfecond and twenty-third years of the reign of King Charles the Second, intituled, An act to prevent the planting of tobacco in England, and for regulating the plantation trade; and in another act of parliament, made in the twentieth year of his present Majefty's reign, intituled, An act to allow the trade between Ireland and the British colonies and plantations in America and the Weft Indies, and the British fettlements on the coaft of Africa, to be carried on in like manner as it is now carried on between Great Britain and the faid colonies and fettlements; or in any of the faid acts, with refpect to the goods, wares, or merchandize therein enumerated or described.

VII. VIII. And it is hereby further enacted by the authority aforefaid, That no duty of gunpowder, nor any fee or reward whatever, fhall be demanded, taken, or received, by any officer or officers whatever in the faid iflands of Jamaica, Grenada, Dominica and New Providence refpe&tively, for any entry, coquet, clearance or passport, for any foreign thip or veffel, or for any goods, wares or merchandize, imported into or exported from the faid iflands refpectively, in fuch foreign fhips or veffels, under the like pains and penalties as are inflicted upon officers exacting or receiving greater fees than are allowed by an act made in the fifth year of the reign of his prefent Majefty, intituled, An act for more effectually fecuring and encouraging the trade of his Majefty's American dominions; for repealing the inland duty on coffee impofed by an act made in the thirty-fecond year of his late majesty King George the Second, and for granting an inland duty en all coffee imported, (except coffee of the growth of the British demi
