B. by the said C., severally and successively in tail-male, the messuages &c., hereinafter &c., shall be and remain, and the grant, release, and confirmation contained in the said indenture of release and settlement shall, as to the said messuage &c., operate and enure, and the said C. D., his heirs and assigns, shall stand and be seised of the same messuages &c., to the use of the said E. F., his heirs and assigns, for ever, subject to the yearly rents and payments hereinbefore mentioned.

XXV. And this Indenture further witnesseth, that, for the considerations aforesaid, and pursuant to, and by force and virtue, and in exercise and execution of the power or authority to the said A. B. by the said hereinbefore in part recited indenture of release and settlement for this purpose given, limited, or reserved, and all other powers and authorities whatsoever enabling him in this behalf, He the said A. B., by this deed or instrument in writing so signed, sealed, and delivered by him, and intended to be attested as aforesaid, Doth request and direct that the said C. D. do and shall, by this present deed or instrument in writing, dispose of and convey, by way of absolute sale, the messuage &c., hereinafter &c., and every of them, and every part thereof, with their appurtenances, To such uses and upon such trusts as are hereinafter contained, subject to the yearly rents and payments hereinafter mentioned, and doth hereby consent and approve, that, for the purpose of effecting such disposition or conveyance as aforesaid, the said C. D. do and shall, by this present deed or instrument in writing, exercise, in manner hereinafter mentioned, the powers of disposition, conveyance, revocation, determination, limitation, and new appointment, by the said indenture of release and settlement given and limited to the

said C. D. and E. F. jointly, and now vested in the said C. D. solely, as hereinafter is mentioned.

XXVI. And this Indenture also witnesseth, that, in Revocation of consideration &c., by the said G. H. to the said C. D. uses. in hand well and truly paid, at the request and by the direction of the said A. B., testified by his executing these presents, and to be by the said C. D., his executors, administrators, or assigns, applied and disposed of in the manner by the said indenture of release and settlement directed for the application of the money to arise from the sale or sales of such of the said estates in the same indenture comprised as should be sold in pursuance and exercise of the power for that purpose therein contained, the receipt and payment &c.; and pursuant to, and by force and virtue, and in exercise and execution of the power or authority in the said C. D. for this purpose vested by the said hereinbefore recited indenture of release and settlement, and of all other powers or authorities whatsoever in anywise enabling &c., He the said C. D., in compliance with and in consequence of the request and direction, consent and approbation of the said A. B., hereby given and signified, as hereinbefore is mentioned, Doth by this present deed or instrument in writing, by him sealed &c., revoke, determine, and make void all and every the uses, trusts, powers, and provisions in and by the said hereinbefore recited indenture of release and settlement limited, declared, and expressed of or concerning the said messuage &c., hereinafter &c., so far as the same uses, trusts, powers, and provisoes, or any of them, relate to or affect the said messuage &c., or any part thereof.

XXVIII. And this Indenture further witnesseth, that, in consideration of the sum of £ so by the said G. H. paid as hereinbefore is mentioned, and also in consideration of the sum of 10s. to the said A. B. &c. and for further assuring the said messuage &c. to the said G. H., his heirs and assigns, to such uses as hereinafter mentioned, He the said C. D., at such request, and by such direction, and with such consent and approbation of the said A. B., and so signified as hereinbefore is mentioned, and according to the estate, right, title, and interest of him the said C. D. in the said messuages &c., and so far as he the said C. D. can or lawfully may, both at law and in equity, and also the said A. B., Have, and each of them Hath granted, bargained, sold, released, and confirmed, and by these presents Do, and each of them Doth grant, bargain, sell, release, and confirm unto the said G. H., (in his actual possession now being &c.), and to his heirs, All &c.

XXIX. She the said A. B., by virtue &c., by this deed or writing under her hand and seal, signed, sealed, and delivered or executed by her in the presence of two credible witnesses, and, as to her execution thereof, to be attested by the same witnesses by their severally subscribing their names to a memorandum of attestation indorsed on these pre

sents (a), Doth revoke, determine, and make void all and every of the uses, estates, trusts, powers, and limitations in the said hereinbefore in part recited indenture of release limited and appointed, of and concerning all and every of the freehold messuages &c., situate and being &c., and thereby granted and released, or expressed or intended so to be; And by this her deed or writing so executed by her, and to be attested as aforesaid (b), Doth limit, declare, and appoint that ¡mmediately after the execution of these presents, All the said freehold messuages, farms, lands, tenements, hereditaments, and premises, situate &c. aforesaid, and by the said indenture of release granted and released as aforesaid, or expressed or intended so to be, shall remain, continue, and be, and that all persons seised and to be seised thereof shall henceforth stand and be seised of the same respectively, and every part and parcel thereof respectively, with the appurtenances, To the use of the said C. D., his executors, administrators, and assigns, for and during and unto the end of the term or time of years, to be computed from the day next before the day of the date of these presents, and thenceforth next ensuing, and fully to be complete and ended, without impeachment of or for any manner of waste; Nevertheless, upon the trusts, and for the ends, intents, and purposes, and under and subject to the provisions, declarations, and agreements hereinafter expressed, declared, and contained of or concerning the same term; and after the determination of the said term of years, in the mean time subject thereto and to the trusts thereof, To such and the same or the like uses, upon such and the same or the like trusts, and for such and the same or the like ends, intents, and purposes,

(a) When by trustees under a power to sell and exchange,
