An Act

To incorporate the Litiz Academy, in the village of Litiz, Lancaster county, and the Pottsville Institute, in the county of Schuylkill, and relative to Washington and Dickinson Colleges.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the academy for the education of boys, Litiz Acadein the village of Litiz, Lancaster county, at present under my incorpothe direction of John Beck, as principal thereof, is hereby rated. erected into one body corporate and politic, in deed and in law, by the name, style and title of "The Litiz Academy," Style & title. and by the same name shall have perpetual succession, and be able to sue and be sued, plead and be impleaded, in any Privileges & court of law, or elsewhere, and shall be able and capable in law and equity to take and hold lands, tenements, goods and chattels, of whatever nature or quality, real or personal, or mixed, which are now, or hereafter may become the property of said academy, by gift, grant, bargain, sale, conveyance, assurance, will, devise, bequest, or otherwise, from any person or persons capable of making the same, and the same to grant, bargain, sell, or dispose of: Provided, Proviso. That the yearly value or income of the said real and personal estate, shall not at any time exceed the sum of two thousand dollars, to be applied exclusively for the erecting of such buildings as may be necessary, and for the purchase of books, or of such apparatus for the use of said academy, and also, for such other purposes as may from time to time be necessary for the well being of the same, and that no misnomer shall defeat any gift, grant or sale to the said academy, contrary to the true intent of the person or persons making the same.

SECTION 2. That the trustees of said academy shall be Trustees five in number, and until others shall be appointed, shall consist of the following named persons, viz: the Rev. Peter Woll, the present pastor of the church of the United Brethren at Litiz, John Beck, the present principal of said academy, Jacob Kreider, Christian H. Rauch, and Jacob B. Tshudy, members of the society of the United Brethren's church at Litiz, and the said pastor, and the said principal, and their respective successors, shall at all times be trustees of said academy, by virtue of their said offices, and the said Jacob Kreider shall continue in office until the second Mon

be held for that purpose, shall, by ballot, elect one person out of their own number to serve as trustee, for the term of three years: Provided always, That in case a vacancy or vacancies shall happen, by death or otherwise, of any of the trustees appointed or elected, the remaining trustees, or a majority of them, shall appoint a trustee or trustees, until the next general meeting or election, at which meeting, the members of said society shall elect another trustee or trustees to supply said vacancy or vacancies, as the case may be.

SECTION 3. That the said trustees, or any three of whom being a quorum, shall have power to manage the said concerns of the academy, to have the funds thereof in their care, to change the annual meetings for the election of trustees from time to time, as they may find convenient, to appoint a secretary and treasurer, and to determine all matters and things necessary to the good order and well being of the said academy, and with the consent and approbation of the elders' conference of the said society, to enact and enforce such by-laws and ordinances as they may think proper for the management of the same: Provided always, That the said by-laws and ordinances shall not be inconsistent with the constitution of this state or of the United States, nor in anywise contrary or in violation of the stated rules and statutes of the society of the United Brethren's church at Litiz: And 2d Proviso. provided further, That the internal government of the academy shall be entirely under the direction of the principal thereof, and the said by-laws, and all the proceedings of the said trustees, shall fairly and regularly be entered in books, to be kept for that purpose.

SECTION 4. That the principal of said academy, and his successors, shall remain in said office until he or they shall be removed according to the stated rules and regulations of the said society, or otherwise, and all vacancies which may arise by such removal, shall be supplied according to the same rules.

SECTION 5. That the said trustees and their successors, shall have full power and authority to use one common seal, and to alter and renew the same at pleasure.

ECTION 8. All by-laws, ordinances and proceedings of,

or bequest to the same: Provided, The interest of the parties shall sufficiently appear on the face of the gift, grant, will, or other writing, whereby any estate or other interest was intended to pass to the said corporation, nor shal! any nonuser of the rights, liberties, privileges, jurisdiction and authority hereby granted to the said corporation, create, or in anywise cause a forfeiture thereof.

SECTION 9. That the said trustees and their successors, shall have full power and authority to use one common seal, and to alter and renew the same at pleasure.

SECTION 10. That all the real estate situated in the borough of Washington, in the county of Washington, which Washington belongs to the trustees of Washington college, be and the College. same is hereby exempted from taxation in support of the poor, as well as for borough, county and school purposes.

Dickinson
College.

SECTION 11. That the real estate belonging to the trustees of Dickinson college, situate in the county of Cumberland, shall hereafter be exempt from taxation.

SECTION 1. SECTION 2.
