Appropriating the sum of five hundred thousand dollars to the Common School fund.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the sun of five hundred thousand dollars be, and the same is hereby appropriated to the Common School fund, $500,000 appropriated. to be paid on the first day of June next, and distributed according to the several laws of this commonwealth, regulating the distribution of such appropriations, said sum to be drawn from any moneys in the treasury not otherwise appropriated, and to be applied by the several districts, either for the building, repairing, or purchasing school houses, or for education, as they may deem best.

Resolved, That it is hereby declared to be the true intent and meaning of the fourth paragraph of the tenth section of the act of June thirteenth, eighteen hundred and thirty-six, entitled "An act to consolidate and amend the several acts relative to a General System of Education by Common Superintens Schools," that the Superintendent of Common Schools shall, dent of Com. Schools may and may employ such assistance in the department of state, as shall actually be necessary for the performance of the employ assis business of the Common School System.

Resolved, That the Canal Commissioners are hereby authorized and required to re-examine the work done, and damages sustained by the contractor in the construction of dam number two, Ligonier line, and settle and adjust the claims of J. Noble Nisbet therefor, upon principles of justice and equity, and shall have power to send for persons and papers, and the Auditor General is hereby authorized to audit and settle the same in the way and manner other claims of the same nature are audited and settled.

Relating to the claim of Hugh Keys.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the Canal Commissioners be, and they are hereby authorized and required to examine the work done by Hugh Keys, in building a viaduct over the Beaver dam branch of the Juniata, and settle and adjust his claims, upon principles of justice and equity, having a due regard to the provisions of the contract, and the Auditor General is hereby authorized to audit the same, in the way and manner other claims against this commonwealth are audited; and that the Canal Commissioners have power to issue subpoenas to witnesses, and, if necessary, to compel their attendance by attachment.

Resolution

To pay Engineers on the Lewisburg and Hollidaysburg Railroad.

WHEREAS, the Canal Commissioners, in pursuance of an act passed eighth day of February, eighteen hundred and thirty-six, directed a survey to be made and estimate, and report upon the practicability and importance of laying out and locating a railroad from Lewisburg, in Union county, to intersect the public works at or near Hollidaysburg, in Huntingdon county; And whereas, The said survey and estimate has been made, in pursuance of the orders of the said Canal Commissioners, but the sum appropriated was not sufficient to pay off the engineers and hands employed in making the said survey; And whereas, Justice and good faith requires that those persons should be paid; And whereas, Surplus remains in the treasury unexpended, of an appropriation made by the legislature for the purpose of surveying the route from Laughlinstown to Pittsburg, and examining into the practicability of crossing the Allegheny mountain at the Portage Railroad without planes; Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the Canal Commissioners are hereby authorized Accounts of to settle and adjust the account of Charles De Hass, civil Charles De engineer, and others, employed in the survey of a railroad Hass & oth- from Lewisburg, to intersect the public works at or near Hollidaysburg, and whatever balance may appear justly due them, the said Canal Commissioners are hereby authorized to draw in favor of the said Charles De Hass, and those who assisted in making the aforesaid survey, on the State Treasurer, for the same, and the State Treasurer is hereby authorized to pay said drafts out of the funds appropriated for surveying the route from Laughlinstown to Pittsburg, and examining the Portage Railroad.

Resolution

Relative to removing the office of the Schuylkill Bank, at Port
Carbon, to Pottsville.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That it shall be lawful for the Schuylkill bank, in the city of Philadelphia, to remove their branch from Port Removal of Carbon, in Schuylkill county, to Pottsville, in said county, at any time after the first of July, eighteen hundred and thirty-seven.

Resolved, That when the office of discount and deposit aforesaid shall have been removed, it shall be the duty of the Five Direc directors of the Schuylkill bank, to select from among the tors to be stockholders of said bank residing in Schuylkill county, five elected. directors, to manage the concerns of the said office for one year, or until others are chosen, which selection is to be made from year to year, as long as the said office shall remain in the said borough.
