1 No. 23. Resolution Relative to the Bridge at Duncan's Island. Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the Canal Commissioners be, and they are hereby directed to carry on the work upon the new towing-path bridge across the Susquehanna, at Duncan's Island, as rapidly as may be consistent with its proper and economical construction, and that in case the appropriation of sixty thousand dollars already made to that object, shall be exhausted before the second week of the next session of the legislature, it shall and may be lawful for the Governor to draw his warrant, or warrants, on the State Treasurer, in favor of the proper disbursing officer, for such further sum or sums as are necessary to carry on the work, such moneys to be accounted for by the disbursing officer in the usual way, and such sums not to be larger than he is by law allowed to receive at any one time. Resolution Relative to the payment of the money due to persons holding cer tificates issued by William B. Mitchell, late Superintendent on the Columbia and Philadelphia Railway. Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the Auditor General be, and he is hereby required to audit and settle the account of each and every person or persons who hold certificates of William B. Mitchell, (late superintendent of the Columbia and Philadelphia railway,) that sums of money are due to him or them, (which remain unpaid,) for work done on any of the public improvements of this commonwealth, or for materials furnished for the construction of the same, and upon the settlement of their accounts, the Canal Commissioners are hereby directed to pay the sums that shall be found to be due to the several claimants, out of the improvement fund, and their accounts for the payment of the same, shall be audited and allowed as other accounts now are: Provided, That before payment as Proviso, aforesaid, the said several claimants shall severally duly execute and deliver to the commonwealth such an assignment of their said several claims against the said William B. Mitchell, as shall be legally advised, devised and required: Provided, That nothing in this act shall be construed to release the sureties of the said William B. Mitchell, from any responsibility they may be under to the commonwealth, but the claims of the several persons whose certificates may be paid by virtue of this act, shall be transferred and vested in the commonwealth; And provided further, That 2d proviso. the Auditor General shall in no case pay the full amount of any of the said certificates, unless the same is in the hands of the original holder, or in case of his decease, in the hands of his legal representatives, and that fact may be established by the claimant; and the Auditor General shall insist on proof, and whenever said certificates have been transferred, the Auditor General shall only allow such sum as the holder may have bona fide paid therefor, with the legal interest thereon from the time of such transfer, and the balance so remaining, after paying the amount so paid by the assignee or holder, as aforesaid, shall be paid to the original holder of said certificate or scrip, or to his heirs, executors or administrators, whenever due proof of said claim shall have been made, and that any assignment made of said certificate or scrip, after the passage of this act, shall exonerate the commonwealth from the payment of the same, 3d Proviso. or any part thereof: Provided, The Auditor General shall ascertain, by putting the claimant upon his oath or affirmation, or by other proof, whether the said certificates, or any part thereof, are paid, in which case he shall pay only such 4th Proviso, sums as he finds to be bona fide due and unpaid: Provided, That the sum hereby required to be paid, shall not exceed. twenty thousand dollars, and that if the sum does not cover all the claims, the same shall be divided pro rata among the claimants. It shall be the duty of the Canal Commissioners to give notice of the time and place they may determine upon for the receiving of the said claims, in one or more newspapers, published in the cities of Pittsburg, Lancaster and Philadelphia, and Northumberland, for three months, within one year after the passage of this resolution.
