Aside from the grave question of the power of the Legislature now to erect an additional judicial district of the Supreme Court, this bill is condemned as unnecessary and undesirable legislation by the justices of the Supreme Court, Appellate Division, Second Department, within which the territory comprising the proposed new district is situated, and is also opposed by trial justices sitting within the district and who are likewise fully cognizant of existing conditions in the courts. For the foregoing reasons, the bill is disapproved. On motion of Mr. Boyle, said message together with said bill was ordered laid upon the table. The Senate returned the concurrent resolution in relation to the expenses of the committee on Soldiers' Home, with a message that they have concurred in the passage of the same without amendment.
