so far as they affect John Hollins McBlair; and the President can, if he so desire, in the exercise of his own discretion and judgment, nominate and, by and with the advice and consent of the Senate, appoint said John Hollins McBlair, late a first lieutenant in the Fífteenth United States Infantry Regiment, to the same grade and rank of first lieutenant in the Army of the United States in the infantry service, and to place him upon the retired list of the Army as of the date of April eighth, eighteen hundred and sixty-four, with the pay of his grade and rank from April thirtieth, eighteen hundred and eighty-four, and with a full discharge from all liability for any sums paid to or received by him previously to said date.

CHAP. 247.—An act for the relief of T. A. Kendig.

Be it enacted by the Senate and House of Representatives of the Theodore A. Kendig. United States of America in Congress assembled, That the sum of three thousand five hundred and thirty-eight dollars and fifty-nine cents be, and the same is hereby, appropriated, out of any money in the Treasury not otherwise appropriated, to pay Theodore A. Kendig, surviving partner of the copartnership of T. A. Kendig and J. C. McManus, for one month's extra pay on mail routes numbered eightyone hundred and sixty-six and eighty-one hundred and sixtyseven, on which the service of carrying the mail was discontinued by order of the Postmaster-General on May thirty-first, eighteen hundred and sixty-one, which sum of three thousand five hundred and thirty-eight dollars and fifty-nine cents was allowed for payment by order of the Postmaster-General, dated the first day of December, eighteen hundred and seventy-nine; and that the sum so appropriated be made immediately available.

CHAP. 253,-An act for the relief of John W. Blake.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and is hereby, authorized and directed to pay to John W. Blake, of the city of Indianapolis, State of Indiana, out of any money in the Treasury not otherwise appropriated, the pay and allowances of a captain of infantry in the volunteer service from the twenty-third day of June, eighteen hundred and sixty-one, to the twenty-first day of July, eighteen hundred and sixty-one, less any amounts paid him during said term, which shall be in full payment of all claims which the said John W. Blake may have against the Government of the United States for back pay.

CHAP. 254. An act for the relief of Mrs. Selina Bestor, Orson H. Bestor, and E.
Francis Riggs.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay to Mrs. Selina Bestor, Orson H. Bestor, and E. Francis Riggs, out of any money in the Treasury not otherwise appropriated, the sum of twenty-one thousand two hundred and thirty dollars and sixty-seven cents, the same being the amount that was improperly turned over to the United States Treasury, or to the disbursing officers of the United States Navy, by the aforesaid parties in settlement of a deficiency in the money account of Assistant Paymaster Jacob D. Doyle, United States Navy, who at the time the deficiency occurred was insane, and that said sum be distributed as follows: To Mrs. Selina Bestor the sum of fourteen thousand two hundred and thirty dollars and sixty-seven cents; to Orson H. Bestor, the sum of four thousand dollars; and to E. Francis Riggs, the sum of three thou sand dollars.

CHAP. 255.—An act for the relief of Nathan Kimball, postmaster at Ogden, Utah.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Postmaster-General be, and is hereby, directed to credit the account of Nathan Kimball, postmaster at Ogden, Utah, with the sum of one thousand three hundred and twenty-nine dollars and thirty-eight cents, for postal funds stolen or embezzled from the post-office at Ogden, Utah, for which he is responsible to the United States. CHAP. 256.-An act to remove the charge of desertion from the record of Michael
Flaherty.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, and he hereby is, authorized and directed to cause the records of the War Department to be so amended as to remove the charge of desertion from the service record of Michael Flaherty, late a private in Company H, Ninety-first regiment New York Volunteers, and to grant an honorable discharge to the said Michael Flaherty as a private of said company as of the date of July third, eighteen hundred and sixty-five.

CHAP. 258. An act for the relief of Henry Clay and others, owners and crew of the whaling schooner Franklin, of New Bedford, Massachusetts.

Be it enacted by the Senate and House of Representatives of the "Franklin," whaling United States of America in Congress assembled, That the Secretary Payment to Henry of the Treasury be, and he is hereby, authorized to pay, out of any Clay, owner, and crew, money in the Treasury not otherwise appropriated, to Henry Clay, for rescuing passengers, etc., of burning of New Bedford, Massachusetts, agent and managing owner of the "Lorenzo D. whaling schooner Franklin, of New Bedford, the sum of three thousand five hundred dollars, that sum being the estimated loss to the owners, captain, and crew of the schooner Franklin in rescuing the passengers and crew, twenty-six persons, after they had abandoned at sea the burning steamer Lorenzo D. Baker, of Boston, and conveying them safely to New Bedford, thereby causing the schooner to leave her cruising grounds and break up her voyage.

Distribution,

SEC. 2. That one third of the sum appropriated by this act shall be paid to the captain and crew of the Franklin, according to the estimated amount of what would have been their respective shares of the catch.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the President be, and he is hereby, authorized to remit the unexecuted portion of the sentence of court-martial in the case of Thomas W. Houts, late major Seventh Cavalry Missouri State Militia, and to cause said Thomas W. Houts to be honorably mustered out of the volunteer service of the United States, as of the date of said sentence of said court-martial: Provided, That the said Thomas W. Houts shall not in consequence of the passage of this act be entitled to have or receive back pay or allowance.

Lowry, the same being balance due him for services rendered as assistant marshal in the eleventh enumerator's district of East Tennessee in taking the eighth census of the United States.

Honorable discharge

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary Abram F. McCurdy. of War be, and he is hereby, authorized and empowered to issue and grant an honorable discharge from the Army of the United States to Abram F. McCurdy, late a major in the Tenth Ohio Volunteer Cavalry, which discharge shall bear date as of May thirtieth, eighteen hundred and sixty-four, and with the rank of a major, and said discharge, with said rank, as of said date, shall be granted, notwithstanding his dismissal from the service by virtue of the proceedings and sentence of a general court-martial promulgated in General Orders Numbered Ninety-eight, May thirtieth, eighteen hundred and sixty-four, from Headquarters Department of the Cumberland: Provided, That no pay or allowances shall be paid said Major McCurdy by reason of such honorable discharge. S. Storms, Company E, Thirteenth Illinois-Cavalry, for inefficiency and worthlessness, and then to disapprove, revoke, and set aside so much of special orders numbered three hundred and twenty-two, December thirty-first, eighteen hundred and sixty-four, Headquarters Department of Arkansas, as dismissed second lieutenant N. S. Storms, Company E, Thirteenth Illinois Cavalry, for inefficiency and worthlessness, and to grant and cause to be issued to said North S. Storms a certificate of honorable muster out of the service as of the date of December thirty-first, eighteen hundred and sixty-four. And said Not to have pay, etc. North S. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay "Daniel Webster," to the owners (through their legal representatives) of each of the vessels Midas, Progress. Lagoda, Daniel Webster, and Europa, out for rescue of 900 seaof any moneys in the Treasury not otherwise appropriated, the sum of nineteen thousand eight hundred and sixty-one dollars and twentyseven cents to the owners of the vessel Midas, twenty-one thousand five hundred and twenty-seven dollars and ninety-five cents to the owners of the vessel Daniel Webster, twenty-three thousand six hundred and eleven dollars and twenty cents to the owners of the vessel Lagoda, twenty-six thousand one hundred and eleven dollars

SEC. 2. That said moneys shall be paid over to the owners of each of said vessels, for the benefit of themselves; and of such of the officers and crews of said vessels, respectively, as were engaged in that particular season of the cruise in the Arctic Ocean during which said rescue was made, and such moneys shall be distributed by the owners between themselves and said officers and crews in the proportion to their respective lays, and in the same manner as the ordinary earnings from the said cruise would have been distributed. The Secretary of the Treasury shall not be bound to see to the application of said moneys by the owners.

SEC. 3. That said owners, respectively, shall deliver to the Secretary of the Treasury, upon the receipt of said money, and in behalf of themselves and said officers and crews, a full discharge of all claims equitable or otherwise, which they have, or think they in any way have, against the United States on account of the aforesaid losses and services.

Be it enacted by the Senate and House of Representatives of the Elizabeth C. Custer. United States of America in Congress assembled, That the Secretary of the Interior be, and hereby is, authorized and directed to pay to Mrs. Elizabeth C. Custer, widow of General George A. Custer, a pension at the rate of one hundred dollars per month, from and after the passage of this act, in lieu of the pension which she now receives

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the President Military record cor of the United States be, and hereby is, authorized to revoke Special Orders numbered four hundred and ninety-six, War Department, Adjutant-General's Office, Washington, November seventh, eighteen hundred and sixty-three, and Special Orders numbered one hundred and twenty-two, Headquarters of the Army, Adjutant-General's Office, Washington, June nineteenth, eighteen hundred and seventysix, dismissing William L. Lenan, first lieutenant of Company B, Thirty-eighth Regiment Indiana Volunteers, from the service of the United States for disobedience of orders and absence without leave under the name of William L. Lenan, and to accept the resignation of said William L. Lenan as first lieutenant of said company and regiment as of date May second, eighteen hundred and sixty-three. and to cause to be issued to him a certificate of such acceptance of his resignation and of honorable discharge from the service as of said date.
