act supplemental to an act entitled An act to consolidate the cities of Brooklyn and Williamsburgh and the town of Bushwick into one municipal government and to incorporate the same,' passed April seventeenth, eighteen hundred and fifty-four," is hereby amended, by adding to the said fifth section, at the end thereof, the words, "and the Bushwick railroad company."

§2. This act shall take effect immediately.

AN ACT to amend an act passed eighteen hundred and fifty-three, chapter one hundred and seventeen, entitled "An act to authorize the formation of companies for the erection of buildings."

Passed April 22, 1867.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The first section of chapter one hundred and seventeen of the laws of eighteen hundred and fifty-three, entitled "An act to authorize the formation of companies for the erection of buildings," is hereby amended by inserting after the words "a company for the erection of buildings," the following words, or the construction or leasing of elevators and warehouses for the storage and elevating of grain, and for the making, purchasing and selling of materials for the construction of buildings." $2. This act shall take effect immediately.

AN ACT to incorporate the New York Homoeopathic Medical College Hospital in the city of New York.

Passed April 22, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Bryant, Lyman Clary, A. B. Conger, Ezra Cornell, Erastus Corning, John P. Crosby, Daniel Drew, Edmund Dwight, Professor Theodore W. Dwight, J. Stanton Gould, Horace Greeley, A. Oakey Hall, Marshall Lefferts, John Lord, Henry R. Low, E. H. Ludlow, Benjamin F. Manierre, E. Marcy, Ralph Mead, Orson B. Munn, John A. Nicholson, Louis Pettee, William C. Prime, Horatio Robinson, James A. Robinson, Duncan Sherman, Jackson S. Shultz, John T. S. Smith, Daniel D. Smith, Martin Thatcher, Salem H. Wales, Louis de V. Wilder, and such persons as may hereafter associate with them in such manner and upon such terms as shall be specified in their by-laws, are hereby constituted a body corporate and politic, by the name of "The New York Homœopathic Medical College Hospital," and by that name shall have the right to sue and be subject to be sued in all courts, in like cases as natural persons, and shall possess all the powers and liabilities which are declared by the third title of the eighteenth chapter of the first part of the Revised Statutes to belong to corporations; and shall be capable of taking, by direct purchase or otherwise, of holding, of conveying or otherwise disposing of any real or personal estate for the uses and purposes of said corporation; such estate not to exceed at any time the net annual income of fifty thousand dollars, and not to be applied to any other purposes than those for which this corporation is created.

$ 2. The objects of this corporation are to establish and maintain in the city of New York a hospital, at which shall be received such persons as may require medical or surgical treatment; and all patients in said hospital shall be under the professional care of surgeons and physicians belonging to the homœopathic school of medicine. The said hospital shall be under the superintendence of the commissioners of public charities and corrections of the city of New York, and have the same rights and powers now possessed by hospitals under charge of that board.

$3. The members of this corporation, at any annual meeting to be held at the time and place fixed by the by-laws, shall elect from their own num

ber, by ballot, a board of managers of said hospital. A majority of votes shall be necessary for such election, and the number constituting such board shall be declared in the by-laws. The term of office of said managers shall be one year, and till their successors shall have been elected.

§ 4. The board of managers shall annually elect from among the members, as soon as may be convenient after the annual election, a president, two vice-presidents, a secretary and treasurer, who shall hold office for one year and until their successors shall have been chosen. The several persons named in the first section of this act shall constitute the first board of managers under the same regulations, and shall hold office till the first annual meeting.

$5. The board of managers shall have power to transact the business of the corporation; to fill vacancies in the board till the next annual meeting; to make by-laws for the government of their proceedings, the management and disposition of the property and concerns of the corporation, and the admission of members, and to appoint such officers, assistants and servants as they may deem necessary. $6. Seven managers, including the president or one of the vice-presidents, shall have authority to transact business, provided a notice of the meeting, in writing, shall have been previously given to each member, or left at his residence or place of business, of a meeting of the board; but for the sale or alienation of real or personal estate belonging to the corporation, or for the leasing of any such real estate for a longer period of time than one year, or for the discharging of any officer, or for the suspension or dismissal of any physician or surgeon of the aforesaid New York Homoeopathic Medical College Hospital, the approval of a majority of all the members of the said board shall be necessary.

AN ACT to amend chapter eight hundred and nineteen of the laws of eighteen hundred and sixty-six, entitled "An act to incorporate the village of New Brighton."

Passed April 22, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section two of title two of chapter eight hundred and nineteen of the laws of eighteen hundred and sixty-six, is hereby amended so as to read as follows:

"On the third Tuesday after the passage of this tion of trus- amendment, a special election shall be held for the election of four trustees of said village. The trustees so elected shall respectively hold office until the commencement of the terms of their successors, to be chosen at the regular annual elections provided for in the act hereby amended. Augustus Prentice, James W. Simonton, Francis George Shaw, and William H. J. Bodine, acting trustees of said village, are hereby appointed to perform the same duties with regard to such special election as are imposed upon the trustees of said village in section ten, title two of the act hereby amended, with regard to annual elections; Mark Cox, acting clerk of said village, is hereby also appointed to perform the same duties with regard to such special election as are imposed upon the clerk of said village; and said special election shall be held and conducted in the same manner as is prescribed for the regular annual elections in said section ten, title two, of said act. The tax trustees con- assessed in said village, for the year eighteen hundred and sixty-six, by the acting trustees above named, in conformity with the act hereby amended, and all other acts and proceedings of said persons acting as a board of trustees for said village of New Brighton in conformity with said act, are hereby legalized and confirmed; and the trustees who shall be elected under this amendment shall, within ten

days after their organization as a board of trustees, issue their warrant, requiring the treasurer of said village to collect any unpaid balance of said tax, but without penalty for previous non-payment, provided the same shall be paid within thirty days from the date of the issue of such warrant; but, in case any portion of said tax shall remain unpaid at the expiration of said thirty days, then the penalties mentioned in section three, title five, of the act hereby amended, shall attach as therein provided."

$2. Section seventeen of title three, of said act, and all other provisions of said act, inconsistent with chapter five hundred and seventy-eight, laws of eighteen hundred and sixty-six, entitled "An act to regulate the sale of intoxicating liquors within the metropolitan police district of the State of New York;" or with chapter seventy-four, laws of eighteen hundred and sixty-six, entitled "An act to create a metropolitan sanitary district and board of health therein, for the preservation of life and health and to prevent the spread of disease;" or with chapter six hundred and eighty-six, laws of eighteen hundred and sixty-six, amendatory thereof; or with chapter eighty-four, laws of eighteen hundred and sixty-six entitled "An act to amend an act, passed April twenty-five, eighteen hundred and sixty-four, entitled 'An act to amend an act, entitled 'An act to establish a metropolitan police district and to provide for the government thereof,' passed April fifteen, eighteen hundred and fifty-seven, passed April ten, eighteen hundred and sixty;" or with chapter five hundred and ninety, laws of eighteen hundred and sixty-six entitled "An act concerning the metropolitan police for Richmond county," passed April fourteen, eighteen hundred and sixty-six, are hereby repealed.

$3. Section four, of title one, of chapter eight hundred and nineteen of the laws of eighteen hundred and sixty-six, entitled "An act to incorporate the village of New Brighton," is hereby amended by adding thereto the following:
