and procure pumps, hydrants, and other necessary fixtures therefor, and to carry into effect any lawful resolution which may be adopted by the said inhabitants, at any annual election or special meeting thereof.

37. And the said trustees shall be a board of health of said village, with all the powers of boards of health, and shall have power to do all that may be required to be done to prevent the coming or spread of diseases. The expenses incurred by said board of health in each year (including the year eighteen hundred and sixty-six), to the amount of not exceeding three hundred dollars, shall be a charge upon the county of Ulster, and the said trustees, or board of health, may audit the bills thereof, and certify the same to the board of supervisors of said county, or may order the same to be paid from the general fund of said village or corporation, and present to the said board of supervisors a bill thereof, in favor of said village, in its corporate name, and in either case the said board of supervisors shall allow the same, and the same shall be collected and paid as other county charges are collected and paid; and all the expenses incurred by the said board of health exceeding three hundred dollars in any year, shall be raised by tax upon said village in addition to all other taxes, and paid from the general fund. And for the purposes aforesaid, or any or either of them, or of executing any powers conferred upon them by this act, or otherwise, the said trustees shall have full power to make, establish, publish, modify, amend or repeal ordinances, rules, regulations and by-laws, and prescribe, fix, and enforce such penalties or fines as they may deem proper for the violation of them respectively, not exceeding fifty dollars, exclusive of said cost and Publication expense, for any one offense; but every such ordinance, rule, regulation, or by-law, shall be published at least twice in one of the newspapers printed in said village, before it shall take effect, and every such ordinance, rule, regulation or by-law, together with a certificate by the clerk of the village, of the time of the publication thereof, shall be posted, entered, or recorded in a book to be provided and kept for that

purpose, and the said record, or a copy thereof, certified by the clerk of said village, shall be presumptive evidence in all courts and places, and in all actions and proceedings, of the due passage of such ordinance, rule, regulation or by-law, and of its having been duly published.

$19. It shall be the duty of the president to preside Duty of at all meetings of the said trustees; to call special meetings of the same when in his opinion the public interest will be thereby promoted, or when he shall be requested to do so by any two trustees; to take care that the ordinances, rules, regulations and bylaws of said village or corporation are faithfully executed; to prosecute for all violation thereof, and to perform any other duties which the said trustees shall lawfully impose upon him.

$20. The clerk of said village shall have the of clerk. custody of the records, books and papers of the said corporation; he shall record, in the manner prescribed by said trustees, their ordinances, rules, regulations, by-laws, resolutions and proceedings, and the proceedings at elections and meetings of the inhabitants of said village. The books and papers in the office of said clerk shall at all times, on demand, be produced for inspection to any taxable inhabitant of said village, and upon like demand and the tender of fees at the rate of six cents per folio therefor, he shall furnish copies of any papers or records filed with him as such clerk. Copies of all papers duly filed in bis office, and transcripts from the records of said corporation, certified by him under the corporate seal, shall be evidence in all courts, and in all actions or proceedings, in like manner as if the original were produced.

21. The treasurer shall keep an accurate account of treasof all moneys received and paid by him, and shall, whenever required by the trustees, and at least once in each year, exhibit all books, vouchers and other matters appertaining to his office as treasurer of said corporation; and no money shall be paid out by him except by order of the trustees.

shall be delivered to him, within the time specified in such warrant, or the renewal thereof, and within that time return the said warrant to the said trustees and pay over to the treasurer all the money collected thereon. For which purpose the said collector shall possess the same power, proceed in the same manner, and be entitled to demand and receive the same compensation as collectors of taxes in towns, except as otherwise provided in this act.

$ 23. It shall be the duty of the assessors, within sixty days after any tax is legally directed to be levied or assessed, to prepare and deliver to the board of trustees, and file with the clerk, a tax roll and assessment of such proposed tax upon the taxable inhabitants and property of said village, and a duplicate thereof (both of which shall be deemed originals), to one of which shall be attached the warrant for the collection of said tax, and to the other a copy of said warrant, with a receipt of the collector for said tax roll and warrant. And it shall be the duty of said assessors, in making such assessments, to proceed as near as may be in the same manner, and they shall have the same powers as assessors of towns, except as otherwise provided by this act, and they shall be entitled to the same compensation as

town assessors.

S24. It shall be the duty of the street commissioner, under and subject to the direction and control of the trustees, to act as overseers of highways, and take general supervision and charge of all the highways and streets in said village. The trustees may at any time limit, regulate or restrain him in the performance of his duties.

$25. It shall be the duty of the police constable to preserve peace and good order and enforce the ordinances, rules, regulations and by-laws of said corporation, and they shall have the same powers as town constables, and the trustees may in their discretion, confer like powers on the police and night watchmen.

TITLE IV.

OF TAXES AND ASSESSMENTS.

$26. The trustees shall have power to raise by tax from the taxable inhabitants of said village, and the property therein liable to taxation, such sum of money as they shall deem proper, but not exceeding the sum of four thousand dollars in the year one thousand eight hundred and sixty-seven, and not exceeding three thousand dollars in any year thereafter, which shall be called the general fund, and be expended in the payment of the debts and expenses of the corporation, and to carry into effect the several powers and privileges granted by this act.

327. The trustees may also in any year raise by general tax, such further sum as shall have been voted by a majority of the inhabitants of said village entitled to vote and voting on a proposition to raise such additional tax, at an annual or special meeting called for that purpose. The vote on such proposition shall be taken by ballot, which shall have on the the inside the words "for the tax," or "against the tax."

$28. The taxes herein before mentioned shall, if Upon what practicable, be included in one assessment, and no part of said taxes shall be assessed upon any woodlands, orchards, meadows, pastures or other lands in said village, reserved or used for ordinary farming purposes. No property in said village shall be assessed at a higher valuation than that of the same property on the last completed and corrected assessment roll of the town of Kingston, preceding such village assessment.

$29. $30. The trustees may renew, from time to time, any warrant issued for the collection of any tax or

assessment, or issue a new warrant for the collection thereof, and in such renewal or new warrant specify the time when the same shall be returned, which may be less than sixty days, and direct the collection of the interest aforesaid.

S31. All taxes and assessments under any of the provisions of this act, whether upon real or personal property, shall be a lien upon the real estate upon which the same may be assessed, levied or charged, and upon all the real estate in said village of the person taxed or assessed, and of the person who ought to pay the tax or assessment, from the time of filing the tax or assessment roll or duplicate thereof, or the certificate of a special assessment, as the case may be, and such lien shall have a priority over all other liens and incumbrances.

S32. At the time of returning any warrant for the collection of any tax or assessment, the collector shall make a return, under oath, to the trustees, of the amount collected by him and stating in detail any and every tax or assessment, or part thereof, if any, mentioned in said warrant, remaining unpaid, and that he has not, upon diligent inquiry, been able to discover any goods or chattels belonging to, or in the possession of, the persons charged with, or liable to pay the sums unpaid, whereon he could levy the

same.

$33. The trustees shall have power to collect by civil action, any tax or assessment or part thereof imposed under any of the provisions of this act, which shall be returned by the collector as unpaid, and all tax or assessment rolls and certificates of special assessments and duplicates thereof filed with the clerk or delivered to the collector, or certified copies thereof, shall be prima facie evidence in all courts and places, and in all actions and proceedings, that the taxes or assessments therein contained have been duly and regularly assessed and imposed, and of the right of recovery thereof.

$ 34. Whenever any tax or assessment or part thereof imposed under any of the provisions of this act, shall have been returned by the collector as unpaid, the trustees are authorized to cause the real estate
