$ 3. The trustees shall hold a meeting of their board for the transaction of public business on the first Monday of every month, at which the president of the village shall preside, and special meetings may be called at any time by the president or by any four of the trustees. In the absence of the president they shall appoint one of their number to perform his duties, and in the absence of the clerk from any such meeting, they may appoint any person to perform his duties for the time being. A majority of the trustees shall constitute a quorum for the transaction of business.

S4. The trustees of said village may make, publish, ordain, amend and repeal all such ordinances, by-laws, and public regulations, not contrary to the laws of this State, as may be necessary to carry into effect the powers given to said trustees by this act, and enforce observance of all rules, regulations, resolutions, ordinances, and by-laws, made in pursuance of this act, by imposing penalties on any person or persons, or corporations violating the same, not exceeding, in any one case of violation, one hundred dollars, to be recovered with costs in a civil action, Publication in any court having cognizance thereof. Every such ordinance or by-law, imposing a penalty for the violation of its provisions, shall, after the passage thereof, be subscribed by the president and clerk, and published at least once a week for two weeks successively, in one or more newspapers printed in said village, and proof of said publication, by the affidavit of the printer or publisher of said newspapers, taken before the president of said village, or any other officer authorized to administer oaths, and filed with the clerk of the village, or any other competent proof of such publication, shall be evidence of the legal publication of such ordinance or by-law, in all courts and All officers places. son, who shall collect or receive in any official capacity any moneys in payment or on account of any fines or penalties so imposed by the ordinance of the said trustees, to pay the moneys so received by him within ten days thereafter, to the treasurer of said village; and in default of such payment to said treasurer, after notice and demand, the person so collecting and receiving said moneys and making said default shall be guilty of a misdemeanor. It shall be the duty of any justice of the peace or constable within said village, whenever required so to do by ordinance of said trustees, to make oath in writing as to the moneys so collected or received by him as aforesaid, and to file the same with the clerk of said village.

35. The trustees shall have power, from time to time, to prescribe the duties of all officers and persons appointed by them under this act, subject to the provisions of the same, and may remove such persons so appointed at any time.

$6. The trustees, and each of them, or any of the police constables shall have power, and are hereby authorized at any and all times, to arrest or cause to be arrested, with or without process, all persons who shall sell strong and spirituous liquors and wines within the limits of said village contrary to law; all habitual drunkards, all drunken persons, or persons found intoxicated in the streets of said village, or riotous person or persons engaged in quarreling and fighting in any of the streets in said village, in addition to those persons enumerated in the first section of title fifth, chapter twentieth, of the first part of the Revised Statutes, all of whom shall be deemed disorderly persons; and the said officers shall have power, with or without process, while in pursuit of said disorderly person, to enter or cause to be entered, any building or place within the limits of said village, and arrest or cause to be arrested, any such disorderly person or persons, and shall take them forthwith before any justice of the peace resid

officer arresting any such offender may detain him in custody, or commit him to the county jail, or any other convenient and secure place for safe keeping, until a justice can be found, not to exceed forty-eight hours, when the officer shall immediately bring him before such justice of the peace, to be tried as hereinafter provided; said officer, or either of them, shall have power to command assistance, whenever he shall deem it necessary.

$ 7. When any person charged or complained the peace in against as a disorderly person, under the provisions of this act, shall be arrested and brought before any justice of the peace in said village, the said justice shall proceed forthwith to hear, try and determine the complaint or charge on which such person is so arrested, or he may, in his discretion, adjourn the hearing or trial, on cause shown, not to exceed five days, and in the mean time shall commit the accused to the county jail, or any other convenient and secure place, until such day, or suffer him to go at large, on his executing a bond, with sureties, under the approval of said justice, conditioned that he will appear on said adjourned day; and upon the conviction of any such offender, either by confession or competent testimony, the said justice shall have the power, and is hereby authorized to punish by fine not exceeding fifty dollars, or by imprisonment in the county jail of Westchester county, not to exceed six months, or by both such fine and imprisonment.

TITLE IV.

OF THE ASSESSMENT, LEVYING AND COLLECTING OF
TAXES.

$1. The trustees are authorized and empowered to raise money by tax, in addition to the amount authorized to be raised by section one, title five of this act, to be assessed upon the estate, real and personal, within the bounds of said corporation, and to be collected from the several owners and occupants thereof, for the purchase of any real or personal property for the use of the said village, and to repair the roads and bridges in said village, and to defray the ordinary and contingent expenses of the said corporation; but

no tax shall be levied and collected under this section to an amount exceeding five hundred dollars in any one year, except as in this act hereinafter provided, and except also such sums as may be required to pay the expenses of lighting the streets with gas, until the same shall have been authorized by a vote of the majority of the taxable inhabitants of said village, qualified to vote under this act, present at an annual election or meeting, or at a special meeting duly called for that purpose. No tax under this section shall be voted to be raised at any such meeting, unless notice shall be given by the trustees specifying the amount and object of such tax. Every such notice shall be published once in each week, for two successive weeks previous to such meeting, in a newspaper printed in said village. The persons entitled to vote to raise such taxes may by resolution authorize the trustees to cause to be raised by a general tax upon all the taxable property in said village, the amount or amounts specified in such notice.

$2. Whenever any tax shall have been directed to Assessment be levied, the assessor or assessors of said village shall assess the said tax so directed to be levied upon the taxable property, real and personal, in the said village, in conformity as nearly as practicable with the provisions of law in respect to the assessment of taxes by town assessors; and when the assessment Review of rolls have been completed by said assessor or assesors, he or they shall deliver the same to the said board of trustees, who shall thereupon give ten days' notice, to be published in the village newspaper or newspapers, and posted in at least ten of the most public places in said village, of the time and place at which they will meet to review and correct the said assessment roll so made by said assessor or assessors as aforesaid; but no alteration shall be made in the assessment roll by the trustees, except upon a statement under oath of the party applying for such alteration, which statement shall be reduced to writing, and subscribed by the party so applying, and filed with the clerk of the village; and when the said trustees shall have reviewed and completed the said assessment roll, to deliver the same to the

S3. The collector shall proceed to collect the amount of such tax, together with such fees or compensation for his services as the trustees, by a by-law, shall have provided, not exceeding five per cent on the amount collected; and after deducting his said fee or compensation, he shall pay the residue to the treasurer of the village, within thirty days from the receipt of said warrant by him, who shall give the collector a receipt for the same, and the said collector shall file the treasurer's receipt therefor with the clerk, together with his warrant and the tax-list annexed thereto; and the money, when collected and paid to the treasurer, shall be applied by the treasurer to the purpose for which such tax was raised, under the direction of the said trustees.

4. Whenever any person or corporation upon sale of land whose estate or property shall have been assessed, pursuant to the provisions of this act, any tax, shall neglect or refuse to pay the same, and no personal property can be found whereon the same can be levied, the collector shall make return thereof to the trustees, who are authorized to cause the land or estate on which such tax is assessed, to be sold at public auction for a term of time, for the payment of such tax, giving eight weeks' notice of such sale by advertisement in any newspaper published in said village, which notice shall contain a brief description of the premises, the amount of the tax, requiring the owner or owners to pay the same, by a day therein specified; and if such tax be not paid at the time and place specified in such notice, the real estate so advertised shall be sold under the direction of the trustees, by the collector or some other person for that purpose
