Marbletown, in said county, in the same manner as other contingent charges of said town are by law directed to be levied and collected, the sum of twelve hundred dollars, together with collecting fees, to be used for building and repairing the following named bridges, viz: four hundred dollars for the purpose of paying the balance remaining unpaid, for the erection of the bridge across the Rondout at Coxing, and for siding and roofing the same; four hundred dollars to be applied to the building of a bridge across the Esopus creek, near the house of Jacob B. Davis, in said town; and the remaining four hundred dollars to be applied in paying a balance of debt incurred by rebuilding the Marbletown bridge, near the house of William L. Merritt.

§2. The said sum of money, when so raised and collected, shall be paid over to commissioners hereinafter named, for the purposes aforesaid.

§3. Jacob H. Depuy, Andrus Wood and Jonathan Auchmoody, of said town, are appointed commissioners for the bridge across the Rondout at Coxing, whose duty shall be to pay said balance remaining unpaid for the erection of said bridge, and to side and roof the same, with all reasonable diligence.

$4. John R. Cole, Jacob B. Davis and Levi Benson, of said town, are appointed commissioners for building a bridge across the Esopus creek near the house of Jacob B. Davis, in said town.

§ 5. Cornelius E. Wynkoop, Matthew Oliver and William L. Merritt, of said town, are apppointed commissioners, whose duty shall be to pay the balance of a debt incurred in rebuilding the Marbletown bridge across the Esopus creek, near the house of William L. Merritt, in said town.

§ 6. It shall be the duty of the said commissioners to account to the board of town auditors of said town, for the moneys they may receive by virtue of this act, at the next annual meeting of said board after the receipt of such moneys aforesaid.

§ 7. This act shall take effect immediately.

CHAP. 50.

AN ACT further to extend the act incorporating the New-
York African Society for mutual relief.

[Passed March 12, 1840.]

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The "Act incorporating the New-York African Society for mutual relief," passed the twenty-third day of March,

in the year of our Lord one thousand eight hundred and ten, is hereby continued for the further term of fifteen years, from and after the twenty-third day of March, one thousand eight hundred and forty.

§ 2. The legislature may alter or repeal this act. §3. This act shall take effect immediately.

CHAP. 51.

AN ACT to divide the town of Bushwick.

[Passed March 16, 1840.]

The People of the State of New-York, represented in Senate and Assembly, do enact as follows :

§ 1. All that part of the town of Bushwick, in the county Town of of Kings, included within the chartered limits of the village burgh of Williamsburgh, is hereby erected into a separate town, by erected. the name of Williamsburgh; and the first town meeting shall be held on first Tuesday in April, one thousand eight hundred and forty, at the justices' court room in said town.

§ 2. The trustees of the village of Williamsburgh, some or Town one of them, shall preside at the first town meeting to be held meetings. in said town; to whom the same authority is hereby given for that purpose, as is given by the laws of this state to the presiding officer or officers of town meetings therein; and the clerk of the village of Williamsburgh, or in his absence, such person as the electors shall then appoint, shall discharge the duties required by law of town clerks at town meetings.

§ 3. The town of Williamsburgh is hereby divided into Collection three assessment and collection districts; two assessors shall districts. be elected from the freeholders of each district, and one collector from each district, at the town meeting to be held on the first Tuesday of April next. The first assessment district is comprised in the following limits and boundaries: beginning in the centre of Grand-street against the East river; thence easterly along the centre of Grand-street to the centre of Union avenue; thence southerly along the centre of said avenue to the line of the city of Brooklyn; thence westerly along the line of said city to the East river; thence northerly along the said river to the place of beginning. The second assessment district is comprised within the following limits and boundaries: beginning in the centre of Grand-street against the East river; thence northeasterly along the East river to Bushwick creek; thence easterly along the centre of said. creek to the centre line of Union avenue; thence southerly along the centre of said avenue to the centre of Grand-street aforesaid; thence westerly along the centre of said street to the East river and place of beginning. district shall comprise and contain all the land and property of said town which is not included in the first and second districts.

§ 4. The town of Williamsburgh shall elect a supervisor for said town, and the board of supervisors of the county of Kings shall have power to review and equalize the assessment rolls of the assessment districts of said town, according to Chapter thirteen, Article third, of the Revised Statutes.

§ 5. All the remaining part of the town of Bushwick, shall be and remain a town by the name of Bushwick, and the first town meeting therein shall be held at the house of Martin Meeker, in said town, on the first Tuesday of April next.

§ 6. This act shall take effect on the first Tuesday of April, one thousand eight hundred and forty.

CHAP. 52.

AN ACT to require the board of supervisors of the county of Geneseee to correct the assessment rolls for the year one thousand eight hundred and thirty-eight.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The board of supervisors of the county of Genesee, at their next annual meeting, are required to review the equali zation of the assessment rolls of the several towns of that county, for the year one thousand eight hundred and thirtyeight, and, as far as in their power, correct the errors occasioned by the incorrect footings of said assessment rolls.

§ 2. If it shall be ascertained upon such review that injustice was done to any town or towns by reason of the incorrect footing of the assessment rolls, or the misconception of the clerk of said board, it shall be the duty of said board to credit all sums which were improperly levied upon any town or towns of said county; and the amount so credited to any town or towns, shall be deducted from the proportion of county expenses imposed upon such town or towns for the current year. § 3. If too small a proportion of the county charges were imposed upon any town or towns of said county, which was occasioned by the reasons mentioned in the next preceding section, it shall be the duty of said board to add the amount necessary to correct the mistake to the amount of county charges to be levied upon said town or towns for the current year, and shall cause the same to be levied and collected in the usual manner.

CHAP. 53.

AN ACT to amend the charter of the Buffalo and Williams-
ville McAdam Road Company.

[Passed March 16, 1840.]

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The Buffalo and Williamsville McAdam Road Company shall possess the general powers and be subject to the general liabilities, prescribed in Title first of the eighteenth Chapter of the first Part of the Revised Statutes, except so far as the same are inconsistent with their act of incorporation. § 2. This act shall take effect immediately.

CHAP. 54.

AN ACT to divide the town of Spafford in the county of

Onondaga.

[Passed March 18, 1840.]

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

Marcellus,

§ 1. All that part of the town of Spafford, in the county of Part of Onondaga, bounded on the north and west by the present lines annexed to of said town on the east by a line commencing at the south- Skaneateles east corner of the town of Skaneateles, and running thence south along the east line of lot number sixty, in the original township of Marcellus, and now in the town of Spafford; and thence due south to the south line of lot number sixty-nine in the township aforesaid; thence west along the south line of lot number sixty-nine to the west line of said town, is hereby annexed to the town of Skaneateles, and shall hereafter constitute a part of said town of Skaneateles: and all that part And part to of the town of Spafford, bounded on the east and north by the present lines of said town, on the west by a line commencing at the southeast corner of the town of Skaneateles, and running thence south along the east line of lot number sixty, now in the town of Spafford, and thence due south to the south line of lot number sixty-nine in the township aforesaid; thence east along the south line of said lot number sixty-nine to the southeast corner of the same; thence south along the west line of lot number seventy to the southwest corner of said lot; thence east on the south lines of lots number seventy and seventy-one in the township aforesaid, to the west line of the town of Otisco, is hereby annexed to the town of Marcellus, and shall hereafter constitute a part of said town of Marcellus. § 2. This act shall take effect immediately.

CHAP. 55.

AN ACT in relation to the town lines between the towns of
Perth, Mayfield and Broadalbin.

[Passed March 18, 1840.]

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The old line formerly known and distinguished, before the division of Montgomery county, as the line between the town of Amsterdam on the one side, and the towns of Mayfield and Broadalbin on the other, is hereby established as the line between the town of Perth and the said towns of Mayfield and Broadalbin.

§ 2. The public acts of all town officers, elected as such, for the town of Perth, living south of said line mentioned in the first section of this act shall be as valid as if said line had been established at the time said town was erected.

§ 3. This act shall take effect immediately.

CHAP. 56.

AN ACT for the relief of Henry W. Ewers.

[Passed March 18, 1840.] The People of the State of New-York, represented in Senate and Assembly, do enact as follows :

§ 1. The canal board are hereby required to re-examine the claim of Henry W. Ewers for an increased compensation for constructing section twenty-five of the southern division of the Chenango canal, and to allow him such sum, beyond the contract price, as shall be just and equitable, on account of the excavation being rendered more expensive by a dam erected by a Mr. Guernsey across a stream running near said section, after the contract for the construction of said section had been entered into by said Ewers.

§ 2. The canal board are hereby further required to allow to said Henry W. Ewers such additional compensation for constructing sections twenty-five, forty-eight and sixty, of the southern division of the Chenango canal, as will be just and equitable, by reason of the excavation proving harder and more expensive, on account of water or otherwise, than was contemplated by the engineers or commissioners at the time of entering into said contract.

§ 3. All sums which may be allowed under this act shall be paid by the commissioners of the canal fund, out of any moneys appropriated for the Chenango canal.

4. This act shall take effect immediately.
