1708a. Appropriations for support of the Army; available from beginning of fiscal year. That the appropriations and authority with respect to appropriations contained, respectively, in the regular annual appropriation Acts for the fiscal year ending June 30, 1933, for the Department of Agriculture, the Treasury and Post Office Departments, and the military and nonmilitary activities of the War Department, shall be available from and including July 1, 1932, for the purposes respectively provided in such appropriations and authority for the service of such fiscal year. No part of any appropriation made by this Act shall be used in any way to pay any expense in connection with the conduct, operation, or management of any post exchange, branch exchange, or subexchange within any State, Territory, or the District of Columbia, save and except for real assistance and convenience to military personnel and civilians employed or serving at military posts in supplying them with articles of ordinary use, wear, and consumption not furnished by the Government. 1712. Same; not available for expenses in connection with Organized Reserves. 1717. Appropriations for mileage; expenditure for inspection and investigations restricted.

This section, based on act of August 6, 1894 (28 Stat. 237), should be omitted as repealed by 156, ante.

1717a. Appropriations for nonmilitary activities of the War Department; available for travel expense.-Mileage, traveling expenses, or per diem in lieu thereof, transportation of dependents, including packing and crating, and transportation of baggage, as authorized by law, for officers, warrant officers, and enlisted men of the Regular Army and civilian employees, traveling on duty pertaining to or on detail to or relief from nonmilitary activities provided for in this Act under appropriations for the Quartermaster Department, Signal Corps, and Engineer Department, shall be paid from the appropriation in connection with which such travel is performed. 1721a. Appropriations for subsistence; not available for purchase of butter substitutes.* Provided, That none of the money appropriated in this Act shall be used for the purchase of oleomargarine or butter substitutes for other than cooking purposes, except to supply an expressed preference therefor or for use where climatic or other conditions render the use of butter impracticable. 1722a. 1725a. Each permanent specific annual appropriation available during the fiscal year ending June 30, 1934, is hereby reduced for that fiscal year by such estimated amount as the Director of the Bureau of the Budget may determine will be equivalent to the savings that will be effected in such appropriation by reason of the application of this section and section 7. Sec. 4 (a), Title II, act of Mar. 20, 1933 (48 Stat. 14).

The above provision is added as a new paragraph of this section.

1730. Appropriations for manufacture at Government-owned establishments; availability beyond fiscal year.

The first paragraph of this section, based on section 5a, added to the act of June 3, 1916, by section 5, act of June 4, 1920 (41 Stat. 765), U.S.C. 10: 1195, was superseded by the second paragraph of the section, and should be omitted.

1733. Appropriations; transfer between executive departments.-(a) Any executive department or independent establishment of the Government, or any bureau or office thereof, if funds are available therefor and if it is determined by the head of such executive department, establishment, bureau, or office to be in the interest of the Government so to do, may place orders with any other such department, establishment, bureau, or office for materials, supplies, equipment, work, or services, of any kind that such requisitioned Federal agency may be in a position to supply or equipped to render, and shall pay promptly by check to such Federal agency as may be requisitioned, upon its written request, either in advance or upon the furnishing or performance thereof, all or part of the estimated or actual cost thereof as determined by such depart

ment establishment, bureau, or office as may be requisitioned; but proper adjustments on the basis of the actual cost of the materials, supplies, or equipment furnished, or work or services performed, paid for in advance, shall be made as may be agreed upon by the departments, establishments, bureaus, or offices concerned: Provided, however, That if such work or services can be as conveniently or more cheaply performed by private agencies such work shall be let by competitive bids to such private agencies. Bills rendered, or requests for advance payments made, pursuant to any such order, shall not be subject to audit or certification in advance of payment.

(b) Amounts paid as provided in subsection (a) shall be credited, (1) in the case of advance payments, to special working funds, or (2) in the case of pay. ments other than advance payments, to the appropriations or funds against which charges have been made pursuant to any such order, except as hereinafter provided. The Secretary of the Treasury shall establish such spec al working funds as may be necessary to carry out the provisions of this subsection. Such amounts paid shall be available for expenditure in furnishing the materials, supplies, or equipment, or in performing the work or services, or for the objects specified in such appropriations or funds. Where materials, supplies, or equipment are furnished from stocks on hand, the amounts received in payment therefor shall be credited to appropriations or funds, as may be authorized by other law, or, if not so authorized, so as to be available to replace the materials, supplies, or equipment, except that where the head of any such department, establishment, bureau, or office determines that such replacement is not necessary the amounts paid shall be covered into the Treasury as miscel laneous receipts.

(e) Orders placed as provided in subsection (a) shall be considered as obligations upon appropriations in the same manner as orders or contracts placed with private contractors. Advance payments credited to a special working fund shall remain available until expended. Sec. 1, act of Mar. 4, 1915 (38 Stat. 1984), as amended by sec. 7, act of May 21, 1920 (41 Stat. 613), as amended by see, 601, Title VI, Part II, act of June 30, 1932 (47 Stat. 417); U.S.C. 31: 686. (a) Notwithstanding the provisions of this title, such section 7, as in force prior to the date of the enactment of this Act, shall remain in force with respect to the disposition of funds transferred thereunder prior to such date.

(b) Nothing in this title shall be construed to authorize any Government department or independent establishment, or any bureau or office thereof, to place any orders for material, supplies, equipment, work, or services to be furnished or performed by convict labor, except as otherwise provided by existing law.

(c) The provisions of this title are in addition to and not in substitution for the provisions of any other law relating to working funds. Sec. 602, Title VI, Part II, act of June 30, 1932 (47 Stat. 418); U.S.C. 31: 686b.

Naval working fund: Hereafter any executive department or independent establishment of the Government ordering materials or services from the Navy shall pay promptly by check upon written request from the Paymaster General of the Navy, either in advance or upon completion of the work, all or part of the estimated or actual cost thereof, as the case may be, and bills rendered in accordance herewith shall not be subject to audit or certification in advance of payment: Provided. That proper adjustments on the basis of the actual cost of delivery of work paid for in w/dvance shall be made. Act of May 21, 1926 (44 Stat. 605), making appropriations for the Navy Department; U.S.C. 31: 686a. The above provision, wild from the original text of Military Laws, 1929, is added

as a new paragraph.

1734. Same; transfer between bureaus.-Not to exceed 12 per centum of any appropriation for an executive department or independent establishment, including the municipal government of the District of Columbia, for the fiscal year ending June 30, 1934, may be transferred, with the approval of the Director of the Bureau of the Budget (or, in the case of the War Department and Navy Department, with the approval of the President), to any other appropriation or appropriations under the same department or establishment, but no appropriation shall be increased more than 15 per centum by such transfers: Provided, That a statement of all transfers of appropriations made hereunder shall be included in the annual Budget for the fiscal year 1936, and a statement of all transfers of appropriations made hereunder up to the time of the submission of the annual Budget for the fiscal year 1935, and all contemplated transfers during the remainder of the fiscal year 1934, shall be included in the annual Budget for the fiscal year 1935: Provided further, That no part of any appropriation for "public works" nor any part of any allotment or portion available for public works" under any appropriation, shall be transferred pursuant to the authority of this section to any appropriation for expenditure for personnel unless such personnel is required upon or in connection with "public works". "Public works" as used in this section shall comprise all projects falling in the general classes enumerated in Budget Statement No. 9, pages A177 to A182, inclusive, of the Budget for the fiscal year 1934, and shall also include the procurement of new airplanes and the construction of vessels under appropriations for "Increase of the Navy". The interpretation by the Director of the Bureau of the Budget, or by the President in the cases of the War Depart ment and the Navy Department, of "public works" as defined and designated herein shall be conclusive. 1734a. Same; transfer from State Department.-For an additional amount for necessary special or technical investigations in connection with matters which fall within the scope of the jurisdiction of the International Joint Commission, including personal services in the District of Columbia or elsewhere, traveling expenses, procurement of technical and scientific equipment, and the purchase, exchange, hire, maintenance, repair, and operation of motor-propelled and horse. drawn passenger-carrying vehicles, $115,000, to be disbursed under the direction of the Secretary of State, who is authorized to transfer to any department or independent establishment of the Government, with the consent of the head thereof, any part of this amount for direct expenditure by such department or establishment for the purposes of this appropriation. 1734b. Same; transfer from Federal Farm Board.
Provided, That
during the fiscal year 1932 when the Federal Farm Board requires cooperative
work by any department or independent establishment of the Government within
the scope of the functions of such department or establishment and which such
department or establishment is unable to perform within the limits of its appro-
priations, the Federal Farm Board may transfer from this appropriation to
