MASTER AND SERVANT EVIDENCE. 330(3)—INJURIES TO THIRD PERSON-SUFFICIENCY OF In an action for injuries sustained by plaintiff in stumbling over a milk receiver, evidence held insufficient to show that the receiver was placed before plaintiff's door by defendant's agent, who made delivery of milk in the building on the day of the accident. Appeal from Municipal Court, Borough of Manhattan, Second District. Action by Yetta Wagner against the Sheffield Farms Company, Incorporated. Judgment for plaintiff, and defendant appeals. The action was brought to recover damages for personal injuries caused by plaintiff stumbling over a milk receiver, which had been placed in front of plaintiff's door in a tenement house. The accident occurred at 10 a. m. The uncontradicted testimony of defendant's driver was that on the day in question he made the deliveries of milk in that building at 7 o'clock a. m., and he denied having at that time anything to do with the milk receiver, which bore the initials of another company and admittedly was not the property of the defendant. Plaintiff introduced some evidence that defendant and another milk company at times used each other's receivers in making deliveries; but this evidence was not sufficient to prove defendant's use of said receiver on the day of the accident, and there is no evidence to justify a finding that said receiver was placed in position before plaintiff's door by any act of the defendant or defendant's agent. The judgment must therefore be reversed, with $30 costs, and the complaint dismissed, with costs. All concur.
