After some time spent thereon, the President resumed the chair, and Mr. Paterson, from said commmittee, reported progress on the first named bill, and asked and obtained leave to sit again.

Mr. Paterson, from the same committee, reported in favor of the passage of the second and third named bills, without amendment, which report was agreed to.

Ordered, That said bills be engrossed for a third reading.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to amend the charter of the Citizens' Fire Insurance company."

"An act conferring certain powers on the board of supervisors of the county of Tioga."

"An act to divide the county of Wyoming into two school commissioner districts, and for the appointment of a school commissioner."

On motion of Mr. Wadsworth, and by unanimous consent, the rules were suspended, and the bill entitled "An act to amend an act entitled 'An act for the incorporation of companies formed to

navigate the lakes and rivers,' passed April 15, 1854;" was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

Resolved, That the joint resolutions relative to territorial legislation, be made the special order for Wednesday next at 7 o'clock p. m.

The Senate met pursuant to ajournment.

Prayer by Rev. Dr. Baldwin.

The journal of yesterday was read and approved.

Mr. Williams presented a petition of citizens of Wayne county, for a law imposing tolls on through freight on railroads; which was read and referred to the committee on canals.

Mr. Sloan presented a petition of the mayor, and aldermen of the 5th ward, and fire marshal, for the repeal of a portion of the fire laws, relating to the 5th ward, Brooklyn; which was read and referred to the committee on the incorporation of cities and villages.

Mr. Smith presented a petition of citizens of Staten Island, Richmond county, for the removal of the quarantine station, and asking a new commission for that purpose; which was read and referred to the committee on commerce and navigation.

Mr. Spinola presented six petitions from citizens of Brooklyn, in favor of the passage of the act in relation to the election of local officers in the city of Brooklyn; which were read and referred to the committee on the incorporation of cities and villages.

Mr. Truman presented a remonstrance of citizens of the county of Tioga, against the repeal of the usury law; which was read and referred to the committee on banks.

Also, a remonstrance of tax payers of the village of Binghamton, against city charter; which was read and referred to the committee on the incorporation of cities and villages.

Also, a petition of citizens of Tioga county, for the repeal of the usury law; which was read and referred to the committee on banks.

Mr. Stow presented three petitions from citizens of New-York and Brooklyn, for the passage of an act to prevent public officers from using or accepting free passes or tickets upon railroads; which were read and referred to the committee on railroads.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill entitled "An act to repeal an act to provide for assessment of damages upon laying out of highways through unenclosed, unimproved and uncultivated lands, passed April 15, 1857;" reported in favor of the passage of the same; which report was agreed to, and said bill committed to the committee of the whole.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill entitled "An act to provide for the repairing and reconstructing in part the bridge across the Canandaigua outlet, at the village of Alloway, in the town of Lyons, Wayne county, and for raising money for that purpose by tax upon said town;" reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Mandeville, from the committee on roads and bridges, to which was referred the bill entitled "An act entitled an act authorising the laying out and constructing a highway in the county of Essex;" reported adversely thereto, and in favor of the adoption of the following resolution:

Resolved, That the bill ought not to pass.

On motion of Mr. Loveland, the report of the committee was laid on the table.

Ms. Scott, from the committee on the erection and division of towns and counties, to which was referred the bill entitled "An act to annex a part of the town of Clermont to the town of Germantown, in the county of Columbia;" reported in favor of the passage of the same; which report was agreed to, and said bill committed to the committee of the whole.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the petition of tax payers of the town of Islip, Suffolk county, for a law to extend the time for collection of taxes, reported a bill entitled "An act to extend the time for the collection of taxes in the several towns of this State;" which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. J. A. Willard, from the committee on the internal affairs of towns and counties, to which was referred the bill entitled "An act to define the fees of town collectors;" reported in favor of the passage of the same; which report was agreed to, and said bill committed to the committee of the whole.

Mr. Darling, from the committee on engrossed bills, reported as correctly engrossed the bills entitled as follows:

"An act to amend an act entitled 'An act to incorporate the Ulster county Savings institution,' passed April 12, 1851."

"An act to provide for the payment of the salary of the Deputy State Engineer and Surveyor, for the last and the present fiscal year."

"An act conferring certain powers on the board of supervisors of the county of Tioga."

"An act in relation to the New-York dispensary, the Northern dispensary, the Eastern dispensary, the De Milt dispensary, and the North Western dispensary of the city of New-York."

Mr. Brandreth from the committee on railroads, to which was referred the bill entitled "An act to prevent public officers from using or accepting free tickets or passes upon railroads;" reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

A message from the Assembly was received and read, requesting the concurrence of the Senate to the bill entitled:

"An act to amend an act entitled 'An act for the construction of a workhouse in the county of Monroe,' passed May 27, 1853;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

A message from the Assembly was received and read, in the words following, to wit:

Resolved, That the Hon. the Senate, be respectfully requested to return to this House the Assembly bill entitled "An act to pay certain persons for services performed ás officers of the Assembly."

Mr. J. D. Willard, offered the following resolution, viz:

Resolved, That the Assembly bill entitled "An act to provide for the payment of certain persons for services performed as officers of the Assembly," be returned to the Assembly, pursuant to the request of that body.

Mr. Spinola moved to lay the resolution on the table.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative,

Mr. Sloan gave notice that he would at an early day, ask leave to introduce a bill in relation to savings banks in the State of New-York.

Also, a bill in relation to the appointment of commissioners to take private property for public purposes.

Mr. Halsted gave notice that he would at an early day, ask leave to introduce a bill to authorise the appraisal and payment of canal damages to Horatio Jones, 3d, and others.

Mr. Wadsworth gave notice that he would at an early day, ask leave to introduce a bill to authorise the Buffalo and Pittsburgh railroad company to consolidate with the Buffalo and Bradford railroad company.

Mr. Brandreth gave notice that he would at an early day, ask leave to introduce a bill for the incorporation of the American school for developing the mineral wealth of the United States.

In pursuance of previous notice, Mr. Williams asked and obtained leave to introduce a bill entitled "An act to amend the Revised Statutes in relation to obtaining property under false pretences;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

By unanimous consent, Mr. Ames asked and obtained leave to introduce a bill entitled "An act to authorise the Rome and Oswego plank road company to borrow money to rebuild, repair, and for other purposes;" which was read the first time, and by unanimous consent was also read the second time, and referred to, the committee on roads and bridges.

In pursuance of previous notice, Mr. Wadsworth asked and obtained leave to introduce a bill entitled "An act to incorporate the Emigrant Savings bank of Buffalo;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

By unanimous consent, Mr. Brandreth asked and obtained leave to introduce a bill entitled "An act for the incorporation of the American School of Mines, for developing the mineral wealth of the United States;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on manufactures.

In pursuance of previous notice, Mr. Stow asked and obtained leave to introduce a bill entitled "An act to enforce the liability as common carriers of persons engaged in express business;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. J. A. Willard asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act in relation to the support of the poor in Jefferson county,' passed April 12, 1852;" which was read the first
