WEDNESDAY, JANUARY 13, 1858.

The Senate met pursuant to adjournment.

Prayer by Rev. Mr. Dickson.

The journal of yesterday was read and approved.

Mr. Burhans presented a petition of John Strain and others, to repeal the act authorising towns to loan their credit for the Albany and Susquehannah railroad; which was read and referred to the committee on railroads.

Mr. Brandreth presented a petition of James G. Wilson, for a settlement of his accounts with the Sing Sing prison; which was read and referred to the committee on State prisons.

Mr. Ames presented a petition of Peter Schenck and others, to erect the village of Oswego Falls into a separate road district; which was read and referred to the committee on the incorporation of cities and villages.

Mr. Truman presented a petition of 86 inhabitants of Broome county, for the appropriation of fifty per cent of the revenue hereafter arising from the excise law, to assist in founding inebriate asylums; which was read and referred to the committee on charitable and religious societies.

Also, a petition for an act to incorporate the city of Binghamton; which was read and referred to the committee on the incorporation of cities and villages.

Mr. Mandeville presented a petition of the common council of the city of Hudson, for a law amending their city charter; which was read and referred to the committee on the incorporation of cities and villages.

Mr. Diven, from the committee on finance, to which was referred the bill entitled "An act to provide for certain expenses of government;" reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

Mr. Loveland, from the committee on public printing, to which was referred the resolution relative to the printing of the report of the Inspectors of State prisons; reported in favor of the adoption of the following resolution, viz:

Resolved, That 1,000 extra copies of the report of the Inspectors of State prisons be printed-500 for the inspectors, and 500 for the Senate.

Which report was agreed to.

The President presented the reports of the Commissioners of the Canal Fund, and of the Auditor of the Canal Department; which were read, laid on the table, and ordered printed.

Also, the report of the Commissioners to examine the Treasurer's accounts; which was read, laid on the table, and ordered printed.

Mr. Stow offered the following resolution, viz:

Resolved, That 400 extra copies of the report of the Commissioners to examine the accounts of the Superintendent of the Banking Department, &c., be printed for the use of the said Superintendent, and 50 extra copies for the use of the Commissioners.

Ordered, That said resolution be referred to the committee on public printing.

Mr. Loveland asked and obtained leave of absence for Mr. W. A. Wheeler, for two days.

Mr. Noxon gave notice that he would, at an early day, ask leave to introduce a bill to provide for the redemption of real estate sold upon the foreclosure of mortgages; also, a bill to amend the act entitled "An act to exempt from sale on execution the homestead of a householder having a family," passed April 10, 1850.

Mr. Mather gave notice that he would, at an early day, ask leave to introduce a bill to allow aliens to hold and convey real estate.

Mr. Schell gave notice that he would, at an early day, ask leave to introduce a bill to amend the charter of "Orphans' Home" of the city of New-York.

Mr. Stow gave notice that he would, at an early day, ask leave to introduce a bill in relation to the election of officers of moneyed corporations; also, a bill for the restoration by receivers to banking associations, moneyed corporations, joint stock associations for banking purposes, and individual bankers, whose debts have been paid or secured, of their property, &c., remaining in the receiver's hands.

Mr. Johnson gave notice that he would, at an early day, ask leave to introduce a bill for the extension of the time of the payment of taxes in the city of Albany.

In pursuance of previous notice, Mr. Mather asked and obtained leave to introduce a bill entitled "An act in relation to the NewYork dispensary, Eastern dispensary, Demilt dispensary, and North Western dispensary;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on charitable and religious societies.

In pursuance of previous notice, Mr. J. A. Willard asked and obtained leave to introduce à bill entitled "An act to enable the supervisor of Lowville, the president of the board of trustees of Lowville academy, and John Doig, to take and hold title to certain premises in Lowville, upon trust;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on literature.

In pursuance of previous notice, Mr. Darling asked and obtained leave to introduce a bill entitled "An act to divide the county of Wyoming into two school commissioners' districts;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on literature.

Mr. Mather offered the following resolution, viz:

Resolved, That George W. Schiffer, be and he is hereby appointed Bank Messenger.

Ordered, That said resolution be laid on the table.

Mr. Foote offered the following resolution, viz:

Resolved, That 2,000 extra copies of the report of the Superintendent of the Banking Department, be printed for the use of the Senate, and 300 additional copies for the use of the Bank Depart

ment.

Ordered, That said resolution be referred to the committee on public printing.

Mr. Foote offered the following resolution, viz:

Resolved, That a committee of two be appointed to wait upon the Assembly and inform that body that the Senate have elected Hon. John B. Halsted, President pro tem.

Ordered, That said resolution be laid on the table.

On motion of Mr. Spinola,

Resolved, That the Clerk be directed to furnish each of the Messengers of the Senate with stationery to the amount of ten dollars, the same as at previous sessions.

On motion of Mr. Hubbell,

Resolved, That so much of the Governor's message as relates to the State Lunatic Asylum at Utica, be referred to a select committee of five, to report by bill or otherwise, as shall be deemed most advisable.

By unanimous consent, Mr. Stow, from the committee on canals, to which was referred the petition of Washington Hunt and others, for an enlargement of the powers of the Lockport Hydraulic company, reported a bill entitled "An act in relation to the Lockport Hydraulic company;" which was read the first time, and by unanimous consent, was also read the second time and committed to the committee of the whole.

By unanimous consent, Mr. Truman, from the committee on charitable and religious societies, to which was referred the bill entitled "An act to authorise certain Methodist Episcopal churches in the city of Brookly to sell burial grounds, and remove remains therefrom;" reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

The hour of 12 o'clock having arrived, the Senate went into executive session, and after some time spent therein the doors were opened and legislative business resumed.

On motion of Mr. Schell,

The consideration of the resolutions offered by Mr. Diven relative to territorial legislation in Kansas, were made the special order for to-morrow, immediately after the regular order of business. On motion of Mr. Schell, the Senate adjourned!

THURSDAY, JANUARY 14, 1858.

The journal of yesterday was read and approved.

The President appointed as the select committee, to which was referred so much of the Governor's message as relates to the State Lunatic Asylum at Utica, Messrs. Hubbell, Stow, Pratt, O. B. Wheeler, and Ames.

Mr. O. B. Wheeler presented a petition of the directors of the Monticello and Wurtsboro plank road company, to change the name to Monticello and Wurtsboro turnpike company; which was read and referred to the committee on roads and bridges.

Mr. Diven presented a petition of inhabitants of the town of Horseheads, Chemung county, asking to change the dividing line between that town and the town of Elmira; which was read and referred to the committee on the erection and division of towns and counties.

Also, a petition of Willis B. Sayre, asking for damages for injury to lands, occasioned by the Chemung canal, and for preventing further damage; which was read and referred to the committee on claims.

Mr. Noxon presented a petition of the chiefs and headmen of the Stockbridge tribe of Indians, for the appointment of a committee to investigate and report upon their claim to lands in the counties of Columbia, Rensselaer and Albany, in which the Indian title has not been extinguished; which was read and referred to the committee on Indian affairs.

Mr. Ely presented a petition of Lewis Ormel, Steinhelt and Vivian, for permission to hold real estate in the city of New-York; which was read and referred to the committee on the judiciary.

Mr. Noxon, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act in relation to local assessments for local improvements in the city of Brooklyn;" reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was referred the petition of Horace Allen for relief, reported a bill enti

tled "An act for the relief of Horace Allen in respect to damages sustained by him by means of the improvement of Rackett river;" which was read the first time, and by unanimous consent, was also read the second time and committed to the committee of the whole.

Mr. Ely, from the committee on the incorporation of cities and villages, to which was referred the petition of the common council of the city of Hudson, for an act altering the charter of said city, reported a bill entitled "An act to amend an act entitled 'An act to amend and consolidate the several acts in relation to the city of Hudson,' passed April 10, 1854, as amended by an act passed April 15, 1857;'" which was read the first time, and by unanimous consent, was also read the second time and committed to the committee of the whole.

Mr. Mather gave notice that he would, at an early day, ask leave to introduce a bill to repeal "An act authorising the mayor, aldermen and commonalty of the city of New-York, to erect a new city hall in said city; to raise money by loan for that purpose, and to appoint commissioners for that purpose."

Mr. Spinola gave notice that he would, at an early day, ask leave to introduce a bill to protect the citizens of Brooklyn from imposition by the several gas companies of said city.

Mr. Pratt gave notice that he would, at an early day, ask leave to introduce a bill to amend an act entitled "An act to incorporate the Ulster Co. Savings Institution," passed April 12, 1851; also, a bill entitled "An act to amend an act to sell the burial ground at the Wallabout, in the city of Brooklyn, and to provide places of burial," passed Feb. 7, 1857.

Mr. Laflin gave notice that he would, at an early day, ask leave to introduce a bill to amend the charter of the Atlantic Mutual Insurance company of the city of New-York.

Mr. Noxon gave notice that he would, at an early, day ask leave to introduce a bill to amend section 53, part 2d, chapter 6, title 4 of the Revised Statutes, relative to suits against heirs and devisees.

Mr. Boardman gave notice that he would, at an early day, ask leave to introduce a bill entitled "An act to repeal an act to provide for assessment of damages upon laying out of public highways through unenclosed, unimproved and uncultivated lands," passed April 15, 1857.

Mr. Ames gave notice that he would, at an early day, ask leave to introduce a bill to amend the charter of the Chamber of Commerce of the city of New-York.

In pursuance of previous notice, Mr. Noxon asked and obtained leave to introduce a bill entitled "An act to provide for the redemption of real estate sold upon the foreclosure of mortgage;" which was read the first time, and by unanimous consent was also [SENATE JOURNAL.]
