favor of the adoption of the following resolution, which was agreed to, viz:

Resolved, That 400 extra copies of the report of the Commissioners to examine the accounts of the Superintendent of the Banking Department, be printed for the use of the said Superintendent, and 50 copies extra for the use of the Commissioners.

In pursuance of previous notice, Mr. Schell asked and obtained leave to introduce a bill entitled "An act to improve the public health of the city of New-York;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on medical societies.

In pursuance of previous notice, Mr. Noxon asked and obtained leave to introduce a bill entitled "An act to amend section 53, part 2d, chapter 6, title 4, of the Revised Statutes, relative to suits against heirs and devisees;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. J. A. Willard asked and obtained leave to introduce a bill entitled "An act to incorporate the permanent committee on education for the ministry of the General Assembly of the Presbyterian church in the United States of America;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on charitable and religious societies.

In pursuance of previous notice, Mr. Pratt asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act to incorporate the Ulster county Savings institution,' passed April 12, 1851; which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on banks.

In pursuance of previous notice, Mr. Boardman on behalf of Mr. Williams, asked and obtained leave to introduce a bill entitled "An act to repeal an act entitled 'An act to provide for assessment of damages upon laying out of public highways through unenclosed, unimproved and uncultivated lands," passed April 15, 1857; which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on roads and bridges.

Mr. Diven, from the committee on finance, to which was referred the petition of the Long Island railroad co., that the time for the payment of the Long Island railroad State stock, be fixed by law, reported a bill entitled "An act fixing the time for the reimbursement of the stock of this State, designated 'Long Island railroad State stock;'" which was read the first time, and by unanimous consent, was also read the second time, and committed to the committee of the whole.

Mr. Mather gave notice that he would, at an early day, ask leave to introduce a bill to authorize each judge of the Court of

Appeals, and each justice of the Supreme Court, to employ clerks and for other purposes.

On motion of Mr. Darling,

Resolved, That the Railroad Commissioner appointed by the Governor and Senate, under the provisions of the act entitled "An act to establish a board of Railroad Commissioners and to define their powers and duties," passed April 14, 1855, be requested to report to the Senate whether he has prepared the annual report required for the fiscal year ending September 30, 1856, as directed by section 2 of the act, chapter 633 of 1857, and if not, the reason why it has not been done, and what he, has done or caused to be done, and also what compensation he has received, and what sums he has paid for clerk hire, and to whom the same has been paid, under the provisions of said section.

Mr. Smith moved to reconsider the vote of yesterday adopting the amendment and resolution of the report of the committee on public printing, relative to printing extra copies of the report of the Superintendent of the Bank Department.

By consent of the mover the resolution was laid on the table. Mr. Noxon moved that the Senate do now adjourn until Monday evening at 7 o'clock.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative, as follows:

Mr. Darling moved to amend by striking out "Monday at 4 o'clock" and inserting "to-morrow at 11 o'clock."

Mr. Paterson moved that the Senate do now adjourn.

The Senate met pursuant to adjournment.

The journal of Friday last, was read and approved.

Mr. Darling presented a petition of citizens of Cattaraugus co., for a law authorizing the construction of a bridge across the Allegany river, in the town of Cold Spring, on the Allegany Indian Reservation; which was read and referred to the committee on roads and bridges.

Mr. J. D. Willard presented a petition for the relief of the Brunswick Association, for insuring against loss of property by fire; which was read and referred to the committee on insurance companies.

Mr. Loveland, from the committee on public printing, to which was referred the resolution to print extra copies of the report of the State Engineer and Surveyor, reported in favor of the adoption of the following resolution, viz:

Resolved, That 2,000 extra copies of the report of the State Engineer and Surveyor, with the accompanying documents, be printed for the use of the Legislature, and 1,000 copies for the State Engineer.

Mr. Foote moved to amend the resolution by striking out "Legislature" and inserting "Senate."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Paterson moved to amend the resolution by striking out "2,000" and inserting "1,000."

The President put the question whether the Senate would agree to the motion, and it was decided in the affirmative.

Mr. O. B. Wheeler, from the committee on roads and bridges, to which was referred the petition of the Monticello and Wurtsboro plank road company, for change of name; reported a bill entitled "An act in relation to the Monticello and Wurtsboro plank road company;" which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Darling gave notice that he would, at an early day, ask leave to introduce a bill to amend chap. 427 of the Laws of 1855, in relation to the collection of taxes on lands of non-residents, and to provide for the sale of such lands for unpaid taxes.

Mr. Doherty gave notice that he would, at an early day, ask leave to introduce a bill authorizing and empowering the police [SENATE JOURNAL.]

justices of the city and county of New-York to appoint necessary clerical assistance in their respective courts; also, a bill to repeal sections 2, 3, 4, 14 and 15, and to amend an act entitled "An act for the regulation and government of the Central park of the city of New-York," and to change the boundary line of said Central park; also, a bill in relation to weight marks and tare on baled hay, and for the regulation of hay scales in the city of New-York. Mr. W. A. Wheeler gave notice that he would, at an early day, ask leave to introduce a bill repealing the law forbidding corporations to plead usury.

In pursuance of previous notice, Mr. Truman asked and obtained leave to introduce a bill entitled "An act to incorporate the city of Binghamton;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on the incorporation of cities and villages.

In pursuance of previous notice, Mr. Stow asked and obtained leave to introduce a bill entitled "An act to declare the Buffalo and Lake Huron railway a corporation under general law;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

In pursuance of previous notice, Mr. Stow asked and obtained leave to introduce a bill entitled "An act to amend the 132nd section of the Code;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. Paterson asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act authorising the payment of money to Geo. Guenther for work done on the Erie canal,' passed April 15, 1857;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on claims.

In pursuance of previous notice, Mr. Spinola asked and obtained leave to introduce a bill entitled "An act to repeal an act entitled 'An act appointing a clerk to take testimony in the courts of Kings county;'" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on the judiciary.

On motion of Mr. Smith,

Resolved, That the Clerk be directed to procure 300 diagrams of the Senate chamber, for the use of the Senate.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the bills entitled as follows:

"An act to provide for certain expenses of Government."

"An act to authorise certain Methodist Episcopal churches in the city of Brooklyn, to sell burial ground and remove remains therefrom."

"An act in relation to assessments for local improvements in the city of Brooklyn."

After some time spent thereon, the President resumed the chair, and Mr. Darling, from said committee, reported in favor of the passage of the first mentioned bill; which report was agreed to.

Mr. Darling, also reported in favor of the passage of the second mentioned bill, with amendment; which report was agreed to. Ordered, That said bills be engrossed for a third reading.

Mr. Darling also reported progress on the last mentioned bill, and asked and obtained leave to sit again.

On motion of Mr. Paterson, the Senate adjourned.

TUESDAY, JANUARY 19, 1858.

The Senate met pursuant to adjournment.

The journal of yesterday was read and approved.

Mr. Spinola presented a petition of all the owners of the lots fronting on Broadway, (late Division avenue) in the city of Brooklyn, for permission to construct a railroad on said street; which was read and referred to the committee on the incorporation of cities and villages.

Mr. W. A. Wheeler presented a petition of sundry inhabitants of the county of Franklin, for an act to amend an act for laying out a certain road in said county; which was read and referred to the committee on roads and bridges.

Mr. Ely presented a memorial of J. H. Ransom, Franklin Johnson and sixty other merchants of the city of New-York, praying that 50 per cent of the revenue arising from the excise law be appropriated to assist in founding the New-York State Inebriate lum; which was read and referred to the committee on charitable and religious societies.

Mr. Sloan presented a petition of the Citizens' Fire Insurance company to increase their capital stock; which was read and referred to the committee on insurance companies.

Also, a memorial of the Chamber of Commerce, New-York, for a change of the usury laws; which was read and referred to the committee on banks.

Mr. Darling, from the committee on engrossed bills, reported as correctly engrossed, the bills entitled as follows:

"An act to provide for certain expenses of Government."
