The President then put the question whether the Senate would agree to the resolution as amended, and it was decided in the affirmative.

Mr. Spinola moved to reconsider the vote on adopting the following resolution, viz:

Resolved, (if the Assembly concur,) That the late State Engineer and Surveyor, have time until the first of March next, to complete the annual report in relation to railroads for the last fiscal year, and that he be authorised to employ such clerks as may be necessary, not exceeding two in number, to assist in making the tabulations required for said report, and to superintend the printing of the same.

The President put the question whether the Senate would agree to the motion, and it was decided in the affirmative, as follows:

On motion of Mr. Stow, the question on adopting the resolution was laid on the table.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the bill entitled as follows: "An act to amend an act entitled 'An act authorising the payment of money to George Guenther, for work done on the Erie canal,' passed April 15, 1857."

After some time spent thereon, the President resumed the chair, and Mr. Spinola, from said committee, reported in favor of the passage of said bill, without amendment; which report was agreed to. Ordered, That said bill be engrossed for a third reading. On motion of Mr. Smith, the Senate adjourned.

FRIDAY, JANUARY 22, 1858.

The Senate met pursuant to ajournment.

The journal of yesterday was read and approved.

Mr. Burhans presented a petition of inhabitants of Schenectady county, asking for a law instructing the Canal Board to close locks

on the Sabbath; which was read and referred to the committee on canals.

Mr. Darling presented a petition of inhabitants of Cattaraugus county, for a law in relation to closing the locks on the canals on the Sabbath; which was read and referred to the committee on canals.

Mr. Paterson presented a remonstrance of citizens of Rochester against the passage of a law authorising a redemption on lands sold on mortgage; which was read and referred to the committee on the judiciary.

Mr. Stow presented a petition of H. N. Hughes and others, for interest on canal drafts; which was read and referred to the committee on claims.

Mr. Noxon presented a remonstrance of the Land Reform association of the city of New-York, against any modification of the Alien law; which was read and referred to the committee on the judiciary.

Mr. Paterson, from the committee on claims, to which was recommitted the bill entitled "An act for the relief of Horace Allen;" reported in favor of the passage of the same, with amendments, which report was agreed to and said bill committed to the committee of the whole.

Mr. Noxon, from the committee on the judiciary, to which was referred the bill entitled "An act to change the names of Richard Monroe and Emma Elizabeth Kenmore, to Richard Monroe Fisk and Emma Elizabeth Fisk;" reported in favor of the passage of the same, with amendments, which report was agreed to and said bill committed to the committee of the whole.

Mr. Burhans gave notice that he would, at an early day, ask leave to introduce a bill to enlarge the powers and duties of the office of notary public, in and for the State of New-York.

In pursuance of previous notice, Mr. Truman asked and obtained leave to introduce a bill entitled "An act conferring certain powers on the board of supervisors of the county of Tioga;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

In pursuance of previous notice, Mr. Darling asked and obtained leave to introduce a bill entitled "An act to amend chapter 233 of the Laws of 1857, in relation to the distribution of Indian annuities;" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on Indian affairs.

By unanimous consent, Mr. Foote asked and obtained leave to introduce a bill entitled "An act to organize a military corps in the city of New-York, to be known as the "Scott Life Guard;" which was read the first time, and by unanimous consent was

also read the second time, and referred to the committee on the militia and public defence.

In pursuance of previous notice, Mr. Spinola asked and obtained leave to introduce a bill entitled "An act to incorporate the Mercantile Library association of the city of Brooklyn;" which was read the first time, and by unanimous consent, was also read the second time, and referred to the committee on literature.

By unanimous consent, Mr. Spinola asked and obtained leave to introduce a bill entitled "An act to authorise the laying of a railroad track in Broadway and through certain other streets in the city of Brooklyn and New Lots, in the county of Kings;" which was read the first time, and by unanimous consent was also read the second time and referred to the committee on the incorporation of cities and villages.

By unanimous consent, Mr. Spinola asked and obtained leave to introduce a bill entitled "An act to incorporate the Long Island steamboat company;" which was read the first time, and by unanimous consent was also read the second time and referred to the committee on commerce and navigation.

On motion of Mr. Paterson,

Resolved, That all persons presenting claims for damages in all matters relating to the canals, before presenting the same to the Legislature shall obtain from the Canal Department full written or printed information in relation to such claim, so far as in the knowledge of said department.

On motion of Mr. Noxon, the special order set down for to-day at 12 o'clock, being the consideration of the concurrent resolutions relative to territorial legislation in Kansas, was postponed until Tuesday next at 12 o'clock.

On motion of Mr. Spinola, the Senate adjourned to Tuesday next at 11 o'clock.

TUESDAY, JANUARY 26, 1858.

The Senate met pursuant to adjournment.

On calling the roll the following Senators were found to be present, viz:

A quorum not being present, on motion of Mr. Smith, the Senate took a recess for 20 minutes.

On re-assembling, no quorum being present, adjourned to 11 o'clock a. m., to-morrow.

WEDNESDAY, JANUARY 27, 1858.

The Senate met pursuant to adjournment.

The journal of Friday last and yesterday, were read and approved.

The President presented the answer of the Comptroller, transmitting the contract for the public printing; which was read and referred to the committee on public printing.

Mr. Mather presented a petition of Jos. Richter and 150 others, praying the Legislature to pass the act allowing aliens to hold and convey real estate; also, a memorial of J. W. Schmidt, Consul General of Baden, on same subject; which were read and referred to the committee on the judiciary.

Mr. Ely presented a memorial of the managers of the society for the reformation of juvenile delinquents; which was read and referred to the committee on finance.

Mr. Sloan presented a remonstrance of nineteen aldermen of the city of Brooklyn, against the passage of an act cutting off the terms of the financial officers of the city of Brooklyn; also, a remonstrance of seventeen aldermen of the city of Brooklyn, against the passage of an act repealing so much of a law as lengthens the term of office of the attorney and counsel of the city of Brooklyn; which were read and referred to the committee on the incorporation of cities and villages.

Also a petition of Cornelius Dubois, for appointment of commissioners to inquire into and report what damages petitioner has sustained under the act in regard to the harbor of New-York; also, a petition of R. Southwick and others, for the passage of a law regulating rates of ferriage between the city of New-York and Long Island; which were read and referred to the committee on commerce and navigation.

Mr. O. B. Wheeler presented a petition of James Farrelly, for an act authorising him to hold the land of which his son Nicholas Farrelly died the owner; which was read and referred to the committee on the judiciary.

Mr. J. D. Willard presented a petition of supervisors of Rensselaer county, in relation to certain taxes in the town of Schodack; which was read and referred to the committee on grievances.

Mr. Smith presented a petition of tax payers of the town of Islip, Suffolk county, for a law to extend the time for the collection of taxes; which was read and referred to the committee on the internal affairs of towns and counties.

Mr. Stow presented a petition of Hiram Blodgett and others, to repeal the law increasing Central railroad fare; also to re-impose [SENATE JOURNAL.]

tolls; also, to repeal tax law of last year; which were read and referred to the committee on canals.

Mr. Wadsworth presented a petition of inhabitants of the county of Erie, in relation to funeral processions on the White's Corner and Buffalo plank road; which was read and referred to the committee on roads and bridges.

Also, a pretition of I. Jewett White, for relief; which was read and referred to the committee on claims.

Also, two petitions for the amendment of the act entitled "An act for the incorporation of companies formed to navigate the lakes and rivers, passed April 15, 1854;" which were read and referred to the committee on commerce and navigation.

Also, a petition of creditors of the Hollister bank of Buffalo, asking an extension of time to receivers for the closing up the affairs of banks in liquidation; which was read and referred to the committee on banks.

Mr. Foote presented a petition of Lewis Clements, for a law to pay damages for failure of title to land; which was read and referred to the committee on the judiciary.

Mr. Smith presented a remonstrance against the proposed law allowing redemption from sales under mortgages; which was read and referred to the committee on the judiciary.

Mr. Boardman presented a remonstrance of Wm. C. Dryer and others, on the same subject; which was read and referred to the committee on the judiciary.

Mr. Sloan presented a petition of the members of the Brooklyn common council, for amendment of the city charter, so as to give members compensation; which was read and referred to the committee on the incorporation of cities and villages.

Mr. Hubbell presented a petition of Wm. S. Parkhurst and others, for a law to pay interest on protested canal drafts; which was read and referred to the committee on claims.

Mr. Noxon presented three remonstrances of citizens of Monroe county, against law providing for redemptions on mortgage foreclosures; which were read and referred to the committee on the judiciary.

Also, a memorial of the Commissioners of the Metropolitan Police district, praying for an amendment to the 12th section of the "Act to establish a Metropolitan Police district, and to provide for the Government thereof;" which was read and referred to the select committee on that subject.

Also, a petition for the repeal of section two of "An act for the appointment of a commission for the preservation of the harbor of New-York from encroachment, &c., passed March 30, 1855;" which was read and referred to the committee on commerce and navigation.

Mr. Scott presented a petition of citizens of Saratoga Springs, for the repeal of section 8, of chapter 167 of the Laws of 1851, enti
